RE: APPROVE AMENDMENT TO AGREEMENT FOR USE OF GEISERT PIT FOR
FIREWORKS SHOW WITH GREELEY INDEPENDENCE STAMPEDE COMMITTEE
AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to Agreement for Use
of Geisert Pit for Fireworks Show between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, and the Greeley Independence
Stampede Committee, commencing June 25, 1997, and continuing until terminated, with further
terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Amendment to Agreement for Use of Geisert Pit for Fireworks
Show between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and the Greeley Independence Stampede Committee be, and
hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 25th day of June, A.D., 1997.

AMENDMENT TO AGREEMENT FOR USE OF GEISERT PIT FOR FIREWORKS SHOW
THIS AMENDMENT TO AGREEMENT, made and entered into thisoejday of
, 1997, by and between the County of Weld, State of Colorado, by and through the
Bo d of County Commissioners of the County of Weld, whose address is 915 Tenth Street,
Greeley, Colorado 80631, hereinafter referred to as "County," and the Greeley Independence
Stampede Committee, whose address is Island Grove Regional Park, 600 North 14th Avenue,
Greeley, Colorado 80631, hereinafter referred to as "Stampede."
WITNESSETH:
WHEREAS, Stampede annually provides fireworks shows for persons attending the
Greeley Independence Stampede Rodeo, and
WHEREAS, on or about June 10, 1996,the parties approved an "Agreement for Use of
Geisert Pit for Fireworks Show" ("the Agreement"), which Agreement allowed Stampede to use
the County's Geisert Gravel Pit to ignite the fireworks for its July 4, 1996, show, and to do so on
July 4th every year thereafter, and
WHEREAS, Stampede plans to provide another fireworks show at the commencement of
this year's celebration, and may do so at other times of the annual celebration in years thereafter,
and
WHEREAS, the parties now desire to amend their Agreement such that it provides
Stampede the authority to use the Geisert Pit for the purpose of igniting fireworks for shows on
nights during the annual Stampede celebration in addition to July 4th.
NOW, THEREFORE, in consideration of the mutual promises and covenants contained
herein, the parties hereto agree to amend their Agreement for Use of Geisert Pit for Fireworks
Show as follows:
Replace Sections 1., 2., 4., 5., 6., and 7., with the following language:
1. TERM: This Agreement shall apply to all fireworks shows sponsored by the
Stampede. The initial date to which this Agreement shall apply shall be June 26,
1997; however,the Agreement shall apply to every Stampede celebration
thereafter until and unless this Agreement is terminated pursuant to the
termination procedures set forth herein. If any Stampede fireworks show is
canceled because of inclement weather and rescheduled to a different date,
County consents to such rescheduling as long as no County's Public Works
Department operations are impaired by such rescheduling, as determined by the
Department's Operations Director. All of the terms and conditions set forth

herein shall apply to said rescheduled fireworks show.
2. USE OF GEISERT PIT: County hereby grants to Stampede the right to use the
Geisert Pit as a place for the ignition of fireworks for Stampede's fireworks shows
at such location thereon as directed by the Operations Director of County's Public
Works Department. No such fireworks show shall be scheduled at a time when
County's Public Works Department operations would be impeded by such
activities as determined by said Operations Director. County consents to the
Stampede's contracting with a private company to perform the ignition duties for
such fireworks shows, as long as said fireworks shows are conducted in
accordance with the terms and conditions set forth herein.
4. INSURANCE: Stampede agrees to provide to County insurance coverage in the
amount of$150,000 per person, $600,000 aggregate which names "the County of
Weld, State of Colorado, by and through the Board of County Commissioners of
the County of Weld, its officers and employees" as insured or additional insured.
Such insurance shall only be for the conducting of fireworks shows on the Geisert
Pit pursuant to the terms and conditions set forth herein. Stampede agrees to
provide to County evidence of such insurance at least 14 days prior to the
commencement of the annual Stampede celebration.
5. TERMINATION: This Agreement may be terminated by either party hereto
by providing written notification to the other party at least 60 days prior to the
commencement of the annual Stampede celebration.
6. CLEAN UP: Stampede agrees to remove from the Geisert Pit any and all trash,
equipment, or items either generated by or used in the course of a fireworks show.
Said removal shall be no later than 8:00 A.M. of the day following the fireworks
show.
7. FUNDING: No portion of this Agreement shall require County to fund part or
all of the Stampede's fireworks shows.
The remaining provisions of the Agreement shall remain the same.
