The following requirements are recommended to be a part of any approval: _ COMMENTS: . WCR 7 is identified in the 1-25 Mixed Use Development Area Comprehensive Plan Map 2.2, Structural Transportation Network, as a four-lane undivided secondary road requiring 100 feet of future right-of-way. There is presently 60 feet in place. Please refer to Figure 2.10 of the MUD for arterial/four-lane roads with painted median. REQUIREMENTS: A 20-foot dedication will be required adjacent to WCR 7 to combine the existing and new right-of-way for a total of 50 feet from the center or section line of WCR 7 for future expansion on the west side. The applicant will be responsible for future expansion to match half the arterial/four-lane with painted median at the time that WCR 7 is expanded to a four-lane roadway. The applicant will enter into a Road Improvements Agreement with Weld County on future expansion of WCR 7. The typical road cross section will reflect Figure 2.10 of the Mixed use Development Design Standards which requires 60 feet of right-of-way, 12-foot driving lanes, and eight-foot parking adjacent to the curb, gutter, and sidewalk in the area of Lots 1 through 10. The typical cross section from the gate entrance to the residential locations will reflect two 12-foot driving lanes, with curb and gutter on both sides with additional sidewalks next to the lake only. Storm water drainage from the development will be directed into the existing lake. Due to the four feet of freeboard the lake has excess storage capacity. Our staff have also observed the proposed site. The application has satisfactorily addressed water and sewer service. Water will be provided by the Left Hand Water District and sewer will be provided by the St. Vrain Sanitation District. The application materials also adequately address the potential environmental impacts as described in Section 6.3.1.2.1 of the PUD Ordinance. We recommend that the following conditions be a part of any approval: 1) The applicant shall obtain water and sewer service from the Left Hand Water District and the St. Vrain Sanitation District. 2) In the event that 5 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and the Environment. Silt fences shall be maintained on the downgradient portion of the site during all parts of the construction phase of the project. 3) During development of the site, all land disturbance shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 4) In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods which are technologically feasible and economically reasonable in order to minimize dust emissions. a) If land development creates more than a 25 acre contiguous disturbance,or exceeds 6 months induration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. Lighthouse Cove/Don LaPaver March 1, 1999 Page 2 Additionally, our staff observed that there are several gravel mining operations and a dairy in the vicinity of this proposed development. We also observed several rural-type homes near the proposed development. Many of these homes have livestock that include but may not be limited to cows and horses. In addition, we also observed open agricultural fields in the vicinity of the site, some of which may be used as biosolids application sites. It is our opinion that any future property owner should be made aware that these agricultural uses exist and that they may be exposed to noise, dust, flies, odors, etc. in excess of the common urban experience. The projected student impact upon the St. Vrain Valley School District of 10 new single-family lots on 75 acres is a total of 7 students. Any students living in this subdivision would attend Mead Elementary School, Mead Middle School, and Skyline High School under the present school boundaries. However, due to potential growth in these schools this development and other existing developments in this feeder could be placed in another attendance area in the future. While this development does not impact the middle and senior high schools capacity, the elementary is already over capacity. In addition, there are other approved developments in these attendance areas which will, together with this proposal, have a significant cumulative impact on these schools. As the volume of developments increases in the Mead Elementary area with no alleviation of the existing overcrowded conditions: the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. Therefore, the District would typically oppose this development because it adds to the enrollment of an already overcrowded school. Should this proposal be considered for approval, the District would request the cooperation and participation of the developer and County in implementing a separate agreement to help mitigate the impacts on the schools. The Developer has indicated in the submittal materials a willingness to comply with the $427 fee per unit (per the attached chart). If this were to be accomplished the District would have no conflict with the development. The District would like to discuss this further with the developer. This is a request for a zone change to facilitate development of 10 estate lots on a peninsula within a man made lake created through sand and gravel construction materials mining. Prime Farmland: N/A - This area has been mined for construction materials and has been substantially regraded. Water Quality: Proposed development plans include hookups to St . Vrain Sanitation District and the Left Hand Water District . One item of potential concern is the direct inflow of subdivision stormwater into the adjacent lake without filtration in a settling pond or created wetland. Noxious Weed Control: No mention in proposal . Soils Limitations: N/A Other Concerns: N/A at this time. Summary Comments: Proposal appears to meet Weld County' s criteria and long range plan for development in this area. In order to minimize impacts to surface and groundwater quality, developers should plan for a settling pond or constructed wetland to filter stormwater runoff .
