HomeMy WebLinkAbout991568.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JULY 12, 1999 TAPE #99-24 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, July 12, 1999, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther E. Gesick Director of Finance and Administration, Donald D. Warden MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of July 7, 1999, as printed. Commissioner Geile seconded the motion, and it carried unanimously. READ ORDINANCE BY TAPE: READ ORDINANCE #89-JJ BY TAPE: Commissioner Baxter moved to read Ordinance#89-JJ by tape. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Kirkmeyer moved to approve the Certification of Hearings conducted on July 7, 1999, as follows: 1) Special Review Permit#1231, Darrell Bearson. Commissioner Baxter seconded the motion, which carried unanimously. ADDITIONS TO AGENDA: The following was added to the Agenda under Presentations: 1) Presentation of Fair Books to Board - Weld County Fair Royalty CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the consent agenda as printed. Commissioner Vaad seconded the motion, and it carried unanimously. 991568 re ,f;Z171/ix Pi /J12C BC0016 PRESENTATIONS: PRESENTATION OF FAIR BOOKS TO BOARD - WELD COUNTY FAIR ROYALTY: Shannon Nussbaum, Fair Attendant, presented the Board with the 1999 Weld County Fair Books. PUBLIC INPUT: There was no public input. WARRANTS: Donald Warden, Director of Finance and Administration, presented the following warrants for approval by the Board: All Funds $733,718.86 Commissioner Kirkmeyer moved to approve the warrants as presented by Mr. Warden. Commissioner Baxter seconded the motion, which carried unanimously. BUSINESS: NEW: CONSIDER PRELIMINARY ABSTRACT OF ASSESSMENT AND MASTER PROTEST LOG: Stan Sessions, Weld County Assessor, submitted the Preliminary Abstract of Assessment and Master Protest Log. He stated the assessment was completed prior to the due date and the system is current up through May 1999. Mr. Sessions further stated the Subdivision splits are completed through the end of 1998, staff has started working on 11999, there were limited protests this year, and not many should be appealing to the Board of Equalization. (Clerk's Note: No motion was made, report stands as presented.) CONSIDER RESOLUTION RE: AUTHORIZE BOARD OF COUNTY COMMISSIONERS TO CONVENE AS A BOARD OF EQUALIZATION FOR CALENDAR YEAR 1999: Commissioner Kirkmeyer moved to approve said resolution. Seconded by Commissioner Geile,the motion carried unanimously. CONSIDER CONTRACT AMENDMENT #2 FOR JTPA OLDER WORKER PROGRAM AND AUTHORIZE CHAIR TO SIGN: Walt Speckman, Director of Human Services, stated this amendment is requesting $38,000 to provide employment counseling, training, job development, and job placement for low- income adults 55 year of age or older. Mr. Speckman stated the term of the contract is July 1, 1999, through June 30, 2000. Commissioner Baxter moved to approve said amendment and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. CONSIDER TEMPORARY ROAD CLOSURES - WELD COUNTY ROAD 31 BETWEEN WELD COUNTY ROAD 80 AND STATE HIGHWAY 14; WELD COUNTY ROAD 110 BETWEEN HIGHWAY 85 AND WELD COUNTY ROAD 27; WELD COUNTY ROAD 17 BETWEEN JOHNSTOWN CITY LIMITS AND WELD COUNTY ROAD 54;AND WELD COUNTY ROAD 74 BETWEEN WELD COUNTY ROADS 27 AND 29:Commissioner Kirkmeyer moved to approve said temporary closures. Seconded by Commissioner Vaad, the motion carried unanimously. Minutes, July 12, 1999 991568 Page 2 BC0016 CONSIDER REQUEST FROM VEGETATION MANAGEMENT SPECIALIST TO ENTER UPON CERTAIN LANDS: Commissioner Geile moved to approve said request. Seconded by Commissioner Baxter, the motion carried unanimously. CONSIDER POLICY REGARDING SETTING AND POSTING OF SPEED LIMITS IN CONSTRUCTION ZONES ON WELD COUNTY ROADS: Frank Hempen, Jr., Director of Public Works, stated this policy will establish 35 miles per hour as the standard speed in all Weld County Road projects unless otherwise posted under his authority. In response to Commissioner Baxter, Mr. Hempen stated a further reduced speed will be posted in construction zones he feels are difficult working situations or there is a high amount of traffic. He further stated the Public Works Department is working with the Sheriff's Office to help enforce the speed limit and give citations to violators. In response to Commissioner Vaad, Lee Morrison, Assistant County Attorney, stated Home Rule municipalities and governments do not have the authority to double fines as seen on State projects. Commissioner Vaad moved to approve said policy. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. PLANNING: FIRST READING OF ORDINANCE#89-JJ, IN THE MATTER OF THE REPEAL AND RE-ENACTMENT, IN ITS ENTIRETY, OF THE WELD COUNTY ZONING ORDINANCE: Mr. Morrison indicated the reading of Ordinance#89-JJ consists of playing six tapes. He stated the Board can hear staff's presentation and any public input; however,the motion must wait until the tapes are completed. Anne Best-Johnson, Department of Planning Services, stated the Planning Commission recommended approval to the Board of Commissioners on May 18, 1999, and submitted additional recommendations, marked Exhibit A. Ms. Johnson also submitted correspondence from the FEMA Mitigation Division regarding floodplain management measures, marked Exhibit B. She stated the Zoning Ordinance maps have been updated and are in the Clerk to the Board's Office. In response to Commissioner Geile, Ms. Johnson staled the Four Percent Rule states an accessory structure can be 1,750 square feet in size as long as the total square footage does not exceed twice that of the principal dwelling. Following discussion, Chair Hall called a break until 2:00 p.m., to complete the reading of Ordinance #89-JJ by tape. Upon reconvening, there was no public testimony concerning this matter. Commissioner Kirkmeyer moved to approve Ordinance#89-JJ on first reading. Seconded by Commissioner Baxter, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the consent agenda. Ordinance #89-JJ was approved on first reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
