RE: APPROVAL OF RECORDED EXEMPTION #1799 - ERBES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1799, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS,the request for Recorded Exemption#1799 was submitted by Ronald A. Erbes,
928 13th Street, Greeley, Colorado, 80631, for property which is described as Lot B of RE #561,
located in part of the NW%of Section 31, Township 8 North, Range 65 West of the 6th P.M., Weld
County, Colorado, being more particularly described in the plat which shall be provided by the
applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS,this request is to divide the property into parcels estimated to be approximately
138 acres and 6 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1799 submitted by
Ronald A. Erbes be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(ISDS) regulations.
2. Allowed accesses to Lots A and B shall be limited to those documented in the
recorded exemption application. No new accesses shall be permitted on this site.
3. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This request for a recorded exemption is submitted by Ronald A. Erbes. The parcel of land
under consideration is described as Lot B of RE-561 in part of the NW4 of Section 31, T8N,
R65W of the 6th P.M., Weld County, Colorado. The property is located‘south of and adjacent to
Weld County Road 88 and east of and adjacent to Weld County Road 37, within the Urban
Growth Boundary of the Town of Pierce. The Pierce Lateral Ditch runs along a portion of the
southwest boundary of the site, providing a physical barrier from adjoining property. There are
no existing structures on proposed Lots A or B.
North Weld County Water District is able to provide water to both proposed lots. The Weld
County Health Department has indicated no objection to the use of individual septic systems on
the site. The Town of Pierce responded with no objection to this request. Three accesses supply
ingress and egress to the property from Weld County Roads 88 and 37.
Recorded Exemption 561, approved by the Board of County Commissioners in 1982, divided a
164 acre parcel into two parcels of 144 acres and 20 acres, more or less. Lot A of RE-561
contains a residence and is located on Weld County Road 37, southwest of the subject property.
Mr. Erbes is now proposing to divide the existing 144 acre parcel into 138 acres and 6 acres,
more or less. The recorded exemption application states that Mr. Erbes wishes to install a center
pivot sprinkler on proposed Lot B and deed proposed Lot A, the unirrigated northeast corner,to
his farm employee. While this six-acre site is presently used for agricultural production, it is

not identified as prime farmground according to Soil Conservation District soil survey
documents (see attached map).
The Department of Planning Services' staff recommends approval of this request. Subdivision of
the property meets the intent of the recorded exemption policy. The property owner wishes to
divide four acres from the site in order to provide a residential homesite for a worker employed
on the farm. Installation of a center pivot sprinkler on proposed Lot B will make future farming
practices more efficient. The use of an unirrigated corner for a rural residential parcel does not
conflict with the Agricultural goals and policies of the Weld County Comprehensive Plan when
the land is identified as non-prime by the Soil Conservation District.
Staff recommendation for approval is conditional upon the following:
1. A Weld County septic permit is required for any proposed home. The septic system shall
be installed according to Weld County Individual Sewage Disposal (ISDS)regulations.
2. Allowed accesses to Lots A and B shall be limited to those documented in the recorded
exemption application. No new accesses shall be permitted on this site.

forth in Section 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.

RECORDED EXEMPTION QUESTIONNAIRE
1 . Explain the reason for the proposed recorded exemption and how
each proposed lot will be used.
The reason for the recorded exemption is to separate a corner of
the property not irrigated by the center pivot sprinkler system and
transfer it to my employee who works the farm. I am installing a
center pivot sprinkler in order to achieve the best use of the
irrigation water on the farm after the current crop year.
The proposed Lot A will be utilized as a rural home site and
improvement area for my tennant, Lot B will continue in its present
use as an irrigated farm.
2 . Describe the location, size and present use of the area where
each proposed new lot will be created.
The subject property is located approximately 2 miles east of
Pierce on Weld County Road 88 at the intersection of Weld County
Roads 37 & 88.
The proposed Lot A will be approximately 3 1/2 to 4 acres in size,
the proposed Lot B, will be approximately 140 acres .
The present use which exists in the area is irrigated farming and
other agricultural uses .
3 . Explain how the proposal is consistent with the Weld County
Comprehensive Plan and any adopted municipal plan, if
applicable.
This proposal is consistent with the Comprehensive Plan of Weld
County in the division of non-productive agricultural property to
an employee on the farm.
4 . Explain how the uses permitted will be compatible with the
existing uses surrounding the proposed recorded exemption.
The uses permitted on both of the proposed lots will be those
currently in place and allowed under the Agriculture zoning.
Uses on surrounding properties is the same as those utilized on the
subject proposed Lots A & B. These uses are consistent and very
compatible with the area and will add positively to the appearance
of the proposed lot and surrounding area. No change of use or in
zoning is sought .

5 . Explain how the proposal is consistent with the intent of the
zoning district it is located within.
This proposal is consistent with the intent of the Agricurtural
zoning currently in place which allows uses and activities related
to Agriculture. Both of the proposed Lots will continue to be used
in a fashion consistent with past uses, no changes in zoning and or
use are required or anticipated.
6 . Explain how the proposal is consistent with efficient and
orderly development.
This proposal is consistent with existing uses in the area and
would not have a negative impact on the efficient and orderly
developement of the area in any way. This proposal would create a
lot which is suitable to and blends in well with the surrounding
area and its uses.
7 . Explain how adequate provision for the protection of the
health, safety, and welfare of the inhabitants of the
neighborhood and the County will be acomplished.
By adhereing to and following all ordinances, regulations, and
requirements as set forth by Weld County. Proper water and sewage
disposal methods will be installed. Access to both proposed
Lots A & B exist from Weld County Roads 37 & 88 and sufficient
utilties are available to adequately serve the property.
