GREGERSON WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #1918, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #1918 was submitted by Francis D. Gregerson, 5584 Weld County Road 24, Longmont, Colorado 80504, for property which is located in the W1/2NW1/4, Section 12, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 76.155 acres and 3.845 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1918 submitted by Francis D. Gregerson be, and hereby is, approved conditional upon the following: 1. The second access for Lot A onto Weld County Road 11, located directly south of the mailboxes, shall be closed. 2. All accesses shall be clearly delineated on the plat. 3. Water Service can be provided to Lot B by CWCWD. SEWER: Lot A is serviced by six existing septic systems. Lot B is proposed to be serviced by a septic system. The first is to enable him to sell the dairy at some future time and be able to sell the recorded exemption at the same time to make the dairy complete, since the housing is very important to the dairy. The second reason is that the applicant may instead wish to build a single-family dwelling in which to retire, making other arrangements for employee housing. • STAFF RECOMMENDATION The Weld County Planning Department, Health Department and the Tri-Area Planning Commission recommend that this recorded exemption be denied. It is the opinion of the Department of Planning Services that this recorded exemption does not meet the intent of the Agricultural Goals and Policies of the Weld County Comprehensive Plan, as amended; specifically: ► A.Policy 1 Agricultural zoning will be established and maintained to protect and promote the County's agricultural industry. Agricultural zoning is intended to preserve prime agricultural land and to provide areas for agricultural activities and uses dependent upon agriculture without the interference of incompatible residential, commercial, and industrial land uses. * If the recorded exemption is approved proposed Lot A with the 7 mobile homes and one principal dwelling will become separate from the dairy operation. Proposed Lot A has the potential to become a mobile home park thus infringing upon surrounding agricultural uses. ► A.Policy 4 Applications for the division of land which is zoned agricultural shall be reviewed in accordance with all potential impacts of the division on the agricultural community. The criteria shall include but not be limited to: ► A.Policy 4.1.4 The level of development associated with the site. * The seven mobile homes and one principal residence on the smaller parcel appears to promote urban development in an agricultural community. ► A.Policy 4.1.7 Utilization of existing housing. residences./Ss/Abr, * The smaller lot will utilize eight existing.mo e-homes. Currently no residences are present on the larger parcel. 961.570 ,RE-1918, Gregerson Page 3 • It is also staff opinion that the applicant has failed to demonstrate compliance with The Weld County Subdivision Ordinance as follows: ► 11.4.2.2 Compatibility with existing surrounding land uses. * Surrounding land uses include agricultural production. ► 11.4.2.3 Consistency with the intent of the zone district the recorded exemption is located within as expressed in the Weld County Zoning Ordinance. * The intent of the Agricultural Zone District is to provide areas for the conduct of agricultural activities and activities related to agriculture and agricultural production without the interference of other incompatible land uses. If the recorded exemption is approved the existing mobile homes that were originally permitted by accessory to the farm have the potential to become separated from the farm use with different ownership. ► 11.4.2.4 Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. * Staff believes that it is not orderly and efficient development to create a lot of 3 acres with seven mobile homes and one principal dwelling unit. Staff believes that if this recorded exemption is approved that the existing mobile homes on proposed Lot A, which were permitted as accessory to the farm, may in fact become a "mobile home park". If the recorded exemption is approved the mobile homes would no longer be consistent with the permits that originally allowed them to be located on Lot A. The potential for multiply ownership on a small lot could lead to further development on the site. ► 11.8.2 An Adequate sewer service is available to serve the uses permitted on both proposed lots. The sewer service shall comply with the requirements of the applicable zone district and the Weld County Health Department. * The Weld County Health Department has indicated that high densities of septic systems may contribute to shallow groundwater impairment. Gregerson to more fully explain the reason the exemption is sought. Mr. Gregerson owns a large dairy in the W'/z NE1/4 and NWV4SE1/4 of Section 12 - approximately one-half mile due west of the proposed recorded exemption parcel. The RE parcel now has mobile homes on the site for housing Gregerson's dairy employees. Mr. Gregerson previously leased the NW'/a from George C. Johnson, Jr., but he has recently purchased the entire NW'/a. The recorded exemption is sought for two reasons. The first is to enable him to sell the dairy at some future time and be able to sell the recorded exemption at the same time to make the dairy complete, since the housing is very important to the dairy. The second reason is that he may instead wish to build a single-family dwelling in which to retire, making other arrangements for employee housing. If he were to choose the latter option, the mobile homes would be completely removed and only one dwelling would be built on the property. Mr. Gregerson understands your concern about selling the RE parcel to a third party who might use it for low-income housing. Since this is not his intent, he has no objections to stipulations and conditions in the recorded exemption preventing such a sale. He is in agreement that if the RE parcel were sold to another party- separate from the dairy- the mobile homes would need to be removed and the current Weld County Ordinance would permit only one dwelling on that parcel. Apparently the Bill Cruise contacted me with his gum g g p pp y Gregerson's, on 160 acres adjacent to the actual dairy propose to create two 80 acre parcels and then do a recorded exemption of three acres for the smaller lot on the 80 acre parcel furthest from the dairy. The three acres now contains mobile homes which are grandfathered but are accessory to the dairy. Mr. Cruz proposes that the concern of the Planning staff that the mobile homes would stay even though they weren't being used for the benefit of the dairy could be addressed by means of a covenant running in favor of the County which would provide that the three acre parcel would have to remain in the same ownership as the dairy or the mobile homes would have to be removed. This is obviously a rather unusual circumstance. I believe Planning is aware of this problem and has expressed concerns in terms of enforcement. Mr. Gregorson is seeking the exemption to ensure the continued use and possible expansion of the current farm labor housing. Lot A is 3.84 acres and currently has one principal residence and seven mobil homes for labor at the dairy. Lot B is 76.1 acres of irrigated farm land which will not be changed. All new dwellings will require septic systems built in accordance with the requirements of the Weld County Health Department. There will be no changes to the land uses. The soils classification for the proposed property is Vona sandy loam with 3-5 % slopes. The permeability is moderate to rapid, with the available water capacity moderate. Surface run off is medium and erosion hazard low. This type of soil has good potential for urban development. The only limiting soil feature is rapid permeability in the substratum which causes a hazard in ground water contamination from sewage lagoons. Septic tank absorption fields may have a slight problem. Care should be taken as to how many new residences and septic systems are put on the 3 acre parcel The board of supervisors would like to see a site specific investigation before any new construction is started.
