Before the Grantee shall commence the construction of said railroad, there shall be filed with and approved by this Board, specifications and surveys with maps showing all grades and curves of said proposed line of road, together with the exact location of all tracks, culverts , bridges . and and poles; and the difference , if any, in all grades between such county road or roads and the proposed line of said railroad, all of iich shall be subject to change or alteration in the discretion of and upon the request of this Board . • Before such specifications , surveys , or maps shall be approved, at least ten days notice of the filing thereof shall be given by this Board by publication in some newspaper of general circu- lation in the county of weld, and by posting a copy thereof in the office of the County Clerk and Recorder of said county; Rrovided However , That before said Grantee shall commence construction of said railroad and within six months after the acceptance in writing of this Grant or franchise by the Grantee and be- fore such approval shall become operative , there shall be filed a bond in the penal sum of TWENTY- FIVE THOUSAND ($25 ,000 . " ) DOLLARS in some good reliable Bonding company, payable to the Board of County Commissioners of the County of ,Weld, and subject to the approval of this Board, conditioned that the said railroad company, its successors or assigns , shall at the end of six months after the acceptance of this Grant and Franchise in writing, begin the actual permanent construction of said railr©ad, . and in good faith thereafter faithfully and continuously prosecute the construction there- 4 of and that within Two (2) years after the commencement of said actual permanent construction said railroad shall be finally completed and in actual running operation, barring providential and un= avoidable interference , and if each and all of the conditions of said Bond are not fully complied wig with, then and in that case , this Board, or its successors in office , may declare a forfeiture there- , of and shall forthwith proceed to collect the full amount of said Bond . Section 6 . . The right , privilege , and authority is hereby given to the grantee to use all bridges , culverts , viaducts , or other publicIstructures along said road upon the conditions here- inafter set down. Section 7. The said The Interurben Construction Company, its successors and assigns , shall construct and maintain its railroad on either side of the county road or highway, as it may elect before beginning construction, but said election, when made, shall be final and shall be made for one side or the other of the said road or highway for the entire line and it shall in no case be permitted to pass from one side to ,the other of said highway, without first having secured per- mission so to do , by resolution of the Board of County Commissioners, and it shall at its own ex- pense, in good substantial manner strengthen and repair any and all bridges , culverts and syphons on said county road which shall be used or occupied jointly by said electric railroad and county, or replace the same , all in the manner hereinafter set forth, and it shall thereafter during the ex- istence _ _of this franchise , pay all of the necessary expense of keeping said bridges , culverts and syphons in good repair, and shall pay all expense of keeping public and private crossings planked and in good repair; and shall at its own expense , widen any and all bridges , culverts , syphons , cuts and embankments on said public roads and highways which are used or occupied jointly by the , said grantee and the traveling public , to not less than the full width of the highways as laid out , and shall whenever the traveled part of any public road is crossed or interferred erred with by its said 421 electric railroad, so cross with, and so construct its said electric railroad and so repair said county road, that the county road will be in as good condition as before the said crossings or in- terferring, and the Board of County Commissioners shall be the judge as to whether this condition has been fully complied with. Section 8. Wherever ditches now cross said road or any intersecting road, which ditches will of necessity be crossed by said railroad, the grade of the same shall be in no way impared or in- t erferred with and said railroad shall be so constructed as to not interfere with any ditches or coma's running along or beside said public roads without the written permission of the owner or own- ers of said ditches or canals first had and placed of record in the office of the County Clerk and Recorder of Weld County, Colorado; and all ditches , canals and laterals crossed by said railroad company shall be syphoned with tile or pipe of sufficient size and dimension to carry the water re- quired to be run in such ditches, canals or laterals , and re-inforced by concrete and of the full width of the highway . Whenever any portion of the County Road along which said railroad shall be constructed shall be swamp or seepage land the said railroad shall be so constructed as not to im- pede the drainage of the highway and wherever necessary the land used, by the right of way shall first be tiled so as to permanently drain the same and the adjacent road . The right of way herein granted shall in no case exceed twelve feet in width, shall be along the side of the road elected as aforesaid and all cutoffs , sidetracks and turnouts shall be constructed on the side furtherrstA from that portion of the highway reserved for public travel and in no case shall be constructed on road outside of the right of way herein granted. Section 9. Any bridge or bridges, culvert or culverts , syphon or syphons , hereafter con- structed upon any of the said county roads or public highways , and which are to be used jointly by the grantee herein and the traveling public shall be not less than the full width of the highway as laid out when the same are used jointly by the public and said grantee , and all bridges when so used shall be constructed with sufficient guard rails not less than five feet in height , one of which sail be constructed between the portion used by the public and the portion used by the rail- road, and the other on the outer side of that portion of the bridge used by the public . Section 10 . The grantee herein shall have the right to construct and maintain bridges for its sole and separate use, as it may elect , and when it shall so construct such bridges shall not be bound or held to contribute or pay one half or any portion of the expense for erection or necessary expense of keeping in repair any county bridge not used jointly by it and the public ; and nothing in this franchise and grant shall be construed as compelling the grantee herein to use or occupy jointly with the public or otherwise any of the county bridges upon any county road along or across which the grantee shall be operating its said railroad. Section 11 . Whenever it shall become necessary to build or construct any new bridges or cul- verts upon said county road or intersecting county roads or highways over, along or across which the grantee shall be operating the said railroad, the grantee herein shall pay to the party con- structing or erecting the same one half of the necessary expense for the erection and construction of the bridges or culverts which shall be used jointly by the public and the said railroad, and the said grantee shall thereafter contribute and pay one-half of the necessary expense of keeping said bridges or culverts, used jointly by the public and said grantee, in good repair; and the County of Weld shall contribute and pay, out of the County Road fund, the other one-half of the expense of ✓ ' r42 ,6 construction, and thereafter maintain any such culverts or bridges when the same are- used jointly by I the public and the said grantee , Said bridges and culverts shall be constructed under the, joint supervision of the owner or operator of said railroad, and the Board of County Commissioners of the County of Weld. Section 12. If the grantee herein, or its assigns , shall fail, refuse or neglect for the per- iod of six (6 ) months after the granting of this franchise , to commence work of construction of said electric railroad, and in good faith continuously prosecute the construction thereof to a final coan- plation within two years thereafter, or i the grantee , its successors or assigns , shall refuse or ` neglect to operate and maintain said railroad in good condition and in good faith for the period of one ( 1) year at any one time after the granting of this franchise or right of way or shall fail, neglect or refuse to faithfully keep and perform each and every of the terms and conditions herein, the grantee, its successors or assigns , shall forfeit all their right;, title and interest in and to such franchise and right of way, and the same shall be null and void, and the same shall be can- celled immediately in manner as by law provided. Section 13 . Before entering upon the County Roads of said County of Weld for the purpose of construction, the said The Interurben Construction Company, itssuccessors or assigns shall furnish a bond executed by a reliable surety company subject to the approval of the Board of County Commis- sioners of the County of Weld, in the State of Colorado , in the sum of Ten Thousand Dollars ($10 ,000 ) , payable to the said Board of County Commissioners of said County; conditioned for the in- demnification of said County, or said Board of County Commissioners , or any person, firm or cor- poration, against all loss or damage sustained by said County or Board of County Commissioners , person, firm or corporation, by reason of , or growing out of, the construction, operation, altera- tion, extension, or repair of said system of electric railroad; and further conditioned that the said grantee , its successors or assigns , shall comply with all existing, or hereafter to be enacted, laws of the state of Colorado , relative to the construction, maintenance , and operation of said electric J � railroad; and conditioned further that the grantee herein shall repair and keep in repair any :nd all roads or crossings for the damage or injury to which it may have been responsible; and that such bond shall be kept in force and effect during the term of this franchise . Section 14. The easements , rights of way, and all the privileges and franchises herein granted, may be assigned by The Interurben Construction Company, the grantee herein, and thereupon the said assignee shall become possessed of all the rights of said company of any nature or description, and be subject to all the liabilities of the grantee herein. Section 15 . The railroad company, its successors and assigns , shall , within thirty days after the approval of. this order , file its acceptance in writing of the same with the clerk of this Board and such acceptance in writing by the grantee herein, of the foregoing resolution, shall be sufficient to fix the rights of the grantee and shall create a contract between the Board of County Commissioners of the County of Weld, State of Colorado , and the said the Interurben Construction Company, its successors and assigns . Commissioner E. J. Estes Moved that the resolution above cited be mended so as to provide for the payment to Weld County of Two (2) per cent of the-- Gross receipts of the Company on a basis of the total mileage of public highways of Weld County occupied and used by said railroad company. A vote being had upon said motion, the result was as follows: Commissioner S. A. Bradfield and R.W.DeVinn#y • 423 against said amendment and Commissioner E. J. Estes for the adoption of said amendment , whereupon the motion was declared lost . The question of the passage of the resolution as offered then being declared by Chairman R. W. DeVinny to be in order, a vote upon the passage of the same was thereupon taken which resulted as follows : Commissioner S. A. Bradfield for the adoption of the resolution, Commissioner E. J. Estes against the adoption of the resolution for the reason that the same does not provide for the annual payment to the county of Two (2) per cent of the Gross receipts of the company based upon the total mileage of public highways used and occupied by said Railroad. Chairman R. W. DeVinny voted for the adoption of the resolution, whereupon a majority of the Board having voted in the affirmative , the chairman declared the resolution passed and adopted as the action of the Board. /7 / IN THE MATTER OF REDEMPTION CERTIFICATE FROM TAX SAME OF l 92. A ■ , , A A } H E Witmer , having filed his affidavit showing that in 1892 he became the purchaser of tax sale certificates No . 910 and 911 for the N.i- N.W4 section 24, Pp . 5N. , R. 64 W. , t o , . D A that said certificates of purchase have since been lost, and the same have never been redeemed; 4 that he has made diligent search for the same and is still unable to find them; that said tax sale is a cloud upon the title to said land and he asks that the Board , by proper order entered of record, authorize the County Treasurer of Weld County to issue his certificates of redemption from said sale . It appearing to the Board that the said H. E. Witwer has filed his indemnifying bond in the penal sum of $50 . to save and keep harmless the said County of Weld and all of its officials from all damages that may be occasioned by said redemption without the surrender of the original certi- ficates of purchase , it was , on motion ordered that the County Treasurer be and he is hereby au- thorized and directed to issue proper redemption certificates for said real estate from the tax w y sale of 1892 upon payment of the proper fee therefore . 0 : IN THE MATTER OF REDEMPTION OF TAX SALE CERTIFICATE NO . 134 SALES OF 1906 . The application of JAMES WED5w 1 praying for the redemption of tax sale certificate. 1 sales of 1906 , account of Double Assessment on 5• E. Ndiec f44 46W Number 34, was presented and after carefully examining same and being fully advised in the premises , it was on motion ordered that the County Treasurer be and he is hereby authorized and diracted to issue his proper redemption certificate therefore . The clerk is hereby directed to draw a Voucher and warrant in the sum of $35 . 75, payable to the County Treasurer , to cover said redemption fee . I IN THE MATTER OF COUNTY ROAD NUMBER 499. On motion of Commissioner S. A. Bradfield, duly seconded, the following resolution was unanimously passed and adopted, viz: -- WHEREAS , It appearing to the Board that the right of way of County Road Number 499, as now deeded to the County, is a little out of line at the south end thereof , and WHEREAS, it further appearing that A. M. MoClenahan and Jennie S. McClenahan, owners of the 424 land abutting upon said road has shown a willingness to quit claim to Weld County a strip of land Fifteen feet in width off the entire East side of the S.W.4 N.W.4 and N.w.e S.W.* section 33.1, Tp . 6N, R. 66 West , provided that Weld County will deed back to him a strip of equal width off the east side of the fifty foot strip they deeded to Weld county May 8, 1906 , as shown by Quit Claim Deed, l d recorded in book 212 at page 417 of the records of the County Clerk and Recorder of said Weld County. THEREFORE BE IT RESOLVED AND ORDERED By the Board of County Commissioners of Weld County, Colorado , that the tender of A. M. and Jennie S. McClenahan be and the same is hereby accepted, and that R. W. DeVinny Chairman of this Board be and he is hereby appointed and constituted a special Commissioner with full power and authority to transfer said property and make and execute for and on behalf of Weld County, Colorado a Quit Claim Deed to Mr . McClanahan and Mrs Jennie S. McClenahan for a strip of land Fifteen ( 15) feet in width commencing at a point fifty feet east of the North- , west corner of the S.E.e N.W.e of section 33 , Tp . 6N . , R. 66 West , thence running due south and parallel with the quarter section line a distance of about 2640 feet ; thence West 15 feet to a point 35 feet east of the S.W. corner of the N.E.4 S.W.4 said section 33; thence due north about 2640 feet to a point 35 feet East of the N.W. Eaton, having filed his affidavit showing that in 1871 H. C. ON motion the following resolution was unanimously . passed and adopted, viz: -- BE IT RESOLVED By The Board of County Commissioners of Weld County, Colorado , that the fol- lowing rates be and the same are hereby created, the same to take effect at once, viz: -- , Wards , Ten Dollars per week . Rooms , Eighteen Dollars per week . Gale and Double room, Twenty-Five Dollars per week, each . IN THE MATTER OF PETITION FOR ROAD IN TP. 7 N. , R. 64 AND 65 . A petition signed by W F Willis and numerous others praying for the laying out of a wagon road 60 feet in width, described as follows , viz: -- Commencing at the S . E. Corner of section 27, , Township 7 N. , R. 64 West and extending westwardly along section lines a distance of Six miles , terminating at the S. F. corner of section 27, Pp . 7N . , R. 65 West was presented to the Board when the following action was taken and entered of record, to-wit : -- It appearing to 'the 'Board that the right of way for said road through patented lands is do- nated by the owners thereof , and the Board believing that the public good requires the laying out 0 of said road, on motion it was ordered that the prayer of petitioners be granted and the line of road prayed for be and is hereby declared a public highway . The clerk is directed to record the petition, plat the road as granted, and notify the road overseer of the proper district to open said road to travel at once . The petitions of W L Carrell , R Fowler , George Hill , Morton Jones andMiss Ida Bishop were then examined and on motion ordered disallowed and placed on file . /11 IN THE MATTER OF REDEMPTION OF TAX SALE CERTIFICATEr NO. 116 , SALES OF 1906 . • The petition of J M Kirby praying for the redemption of Tax Sale certificate No . 116 , Sales of 1906 for the SiS.E4 Section 1 , Tp . 1N . , R. 64 West , was presented, and after a careful and diligent search of the records it was found that said property was erroneously assessed in 1905 and sold for the tax thereon December 15 , 1906; that said property was filed on in June 1905, and final proof made September 14, 1906, therefore the same would not be subject to taxation until the year 1907. That said sale has placed a cloud upon the title to said property , and petitioner requests that the County Treasurer be authorized and empowered to issue his redemption certificate therefor . After being well advised in the premises on motion duly made and carried it was ordered that the prayer of petitioner be granted and that the County - Treasurer be and he is hereby authorized to issue the proper redemption certificate upon payment to him of the sum of $21 .59. It is further ordered that the Clerk of this Board draw a warrant in said sum of $21 59 to cover said redemption fee . i ( f IN THE MATTER OF ASSIGNMENT OF TAX SALE CERTIFICATES 990 AND 991, SALES OF DECEMBER 1897. S Sanford appeared before the Board and made application for the assignment to him of Tax Sale Certificates 990 and 991 , Sales of December 1897 for the N.E.e S. E.e Section 22, Pp. 4,N. , R. 62 and the N.W.i Sifik Section 231 Tp . 4N . , R. 62 W and offered to pay the sum of 0 .98 'therefor; after duly, regularly and faithfully considering the matter and ,be,- lieving that the assignment of said property would be for the best interests of the county, in as much as the same will again be placed back upon the tax roll and the county will derive a revenue therefrom, it was on motion ordered that the request of Mr . Sanford be and the same - is hereby granted, and the County Treasurer is hereby authorized and _directed to issue his assignrent upon payment to him of the said sum of '. ; 0 .981 Eighty and 98/100 Dollars . IN TESTIMONY WHEREOF, The Interurben Construction Company has caused its Corporate name to be affixed by its president and attested by the Secretary with his signature and- the Corporate seal , the said President and the' said Secretary being thereto duly authorized this 7th day of September , 1907. Estes , Commissioner . .54/ IN THE MATTER OF PETITION OF THE NORTHERN CONSTRUCTION COMPANY FOR RIGHT OF WAY OVER AND ACROSS CERTAIN COUNTY ROADS. The petition 'of of They Northern Construction Company which is in words and figures as follows , was presented and ordered spread upon these records in full , viz: - To the Honorable Board of County Commissioners of Weld County. Gentlemen: -- The Northern Construction Company, a corporation organized and existing under and by virtue of the laws of the state of Colorado , and the petitioner herein, have cones structed a Railroad from the Town of Windsor in Weld County, Colorado , in a southerly direction, connecting with the Loveland branch of the Great Western Railway at a point about seven miles east of the Town of Loveland, for the purpose of hauling Sugar Beets farm products and for passengers and other traffic necessary in the conduct of its business . In the construction thereof it became necessary to cross through and over a number of Public Highways along and upon the line thereof; And Whereas at each and every crossing there is required for a Right of Way, a strip of land eighty feet in width, the same being forty feet in width on each side of the center line of the track of said constructed rail— road as the same is now surveyed located and constructed. By reason of the premises the said the Northern Construction Company, the petitioner herein, does hereby petition your Honorable Body for a right of way, for a railroad cross— ing, eighty feet in width, the same being forty feet on each side of the center line of the track of the Railroad of said petitioner herein, as the same is now constructed and oper— ated, and to be operated, through, over and across the following described public highways , described as follows , to-wit : -- IN TOWNSHIP 6 NORTH, RANGE 67 WEST OF THE 6TH P. M. , WELD County, COLORADO . Public Highway No . 200, running North and South upon the section line between sections 21 and 22 , at a point where said railroad crosses said Highway diagonally and as now con— structed and located. Public Highway No . 354 running East and West upon the south line of section 33, at a point where said railroad crosses said highway diagonally, as now located and constructed. Also at another point on said Highway where the , said highway runs North and South upon the section line between sections 7 and 8, and where said railroad crosses said highway in a diagonal course , and as the same is now located and constructed, said last described highway being in Township Five, North, Range Sixty-Seven, west of 6th P. M. and is a continuation of the same highway designated as No . 355 in said section 33, lip • 6N . , R. 67 W. above described. Public Highway No . 382 traversing the section line between sections 4 and 5 in Tp . 5N. , R. 67 WEst of the 6th p . m. , at a point *here said railroad crosses the same in a diagonal course , and as the same is now located and constructed. Public Highway No . 154 traversing the North line of section 18 in said Township and Range last above described, at a point where the said railroad crosses the same diagonally as the same is now located and constructed . Also at another point upon the West line of said section 18, where said railroad crosses said Highway in a diagonal course , upon the County line and as the same is now located and constructed. The rights of way petitioned for herein are to be granted to said company for the purposes as herein stated, and such ooupation by this Corporation, its successors and as— signs shall be subject to the conditi , that in the operation and maintenance of said railroad, that said corporation and its assigns will do and perform whatever a reasonable pui• lie necessity may require to maintain said crossings as a public highway, as the public safety and convenience may require . TEN . Estes , Commissioner . ._y " D E Carpenter, County Attorney. 612 IN THE MATTER OF THE FORMATION OF THE HENRYLYN IRRIGATION DISTRICT . The chairman of the Board, R. W. DeVinny, stated that the meeting had been regularly called pursuant to the requirements of the statutes for the purpose of canvass- ing the votes cast at the election held on Saturday , the 25th day of September, A. D. 1907 in the proposed, The Henrylyn Irrigation District , and in the several divisions and voting precincts thereof , as ordered by the Board , notice of which was duly given and advertised in the Counties of Weld and Adams , pursuant to said order as required by law; and for the further purpose of transact- ing such other business as may properly coni..before the Board. Whereupon it was moved by Commissioner S A Bradfield, seconded by Commissioner E J Estes , put to a vote and unanimously carried that the Board proceed to examine the proofs and determine whether or not the notice of said Election has been properly advertised and given in the Counties 'of Weld and Adams as required by law and as commanded in the order of the Board calling said elec- tion. Thereupon the Boardproceeded to examinetheproof ofpublication ofnotice of said p the election and from said examination it was found and determined that the order of the Board calling said election was duly and regularly given in both the counties of Weld and Adams as required by law and that all matters and things necessary to be done prior to the holding of said election has been done and performed as required by law; a copy of the notice of said election as ordered by the Board and as required by law having been duly published in the Fort Lupton Press , a newspaper of General circulation published and printed in the County of Weld and the state of Colorado , for the period of time prior to said election and in the manner as by law provided and also in the Brighton Register , a newspaper of general circulation published and printed in the county of Adams • and the state of Colorado , for the period of time prior to said election and in the manner as by law provided, a copy of said notice being filed with the Board and now on file herein; due proof of the regular publication of the notice aforesaid by the affidavit of the respective publishers of said Fort Lupton Press and the Brighton Register , in all respects as required by law, being on file herein. Whereupon on motion duly seconded and unanimously carried, the Board proceeded to open the returns and canvass the votes cast at the election held in the proposed The Henrylyn Irrigation District to determine the question of whether or not the territory embraced within the boundaries of said district as in said notice and the orders of the Board set forth, should be organized into en irrigation district to be known as The Henrylyn Irrigation District and for an election of a Board of Directors in and for the various divisions of said irrigation district : Then and there the -rte. .67 returns were opened and the votes cast at said election so noticed and advertised in the counties aforesaid, in the manner aforesaid and held on the 28th day of September , A D 1907, were canvassed and counted, from which it was found that Twenty (20) votes were marked "Irrigation District ,Yes" , and none of said votes were marked "Irrigation District , No" , from which it appeared to the Board and was found by said Board that the majority of all the resident freeholders who are legal electors in said proposed district and have paid property taxes in the year last preceding said election have voted and did vote "Irrigation District , Yes"; and thereupon the Board proceeded to canvass AL the votes cast in said district for directors and found the following results : "For director in and for division No . one , J N Bowles , received 20 votes . " "For director in and for Division No . 2, Clarence M Ireland received 20 votes . " "For Director in and for Division No . 3 , Frank A Hens ley received 20 votes . " And no person other than those above named received any votes for the office of director in or for any division of said district . Commissioner E J Estes thereupon presented the following resolution and order for the con- sideration of the Board and moved its adoption by the Board, to-wit : "WHEREAS, heretofore , on the 2nd day of September , A D 1907 , at the regular meeting of the Board of County Commissioners of Weld county, in the state of Colorado , there was presented by Clarence M Ireland, Frank A Hens` ley and Oscar Bowles a petition signed by said persons and others praying for the establishment , organization and creation of an irrigation district to be known as The Henrylyn Irrigation District , which said proposed district as described by the said petition embraced and comprised lands in the county of Weld in the state of Colorado, which county of Weld embraced the largest acreage of said proposed district , at which time in pur- suance of the petition aforesaid due proof of proper publication in the County of Weld of the notice of presentation of said petition to said Board was duly given; and WHEREAS , in said matter of presentation of said petition, establishment of Boundaries of said district and all matters pertinent to the formation of said irrigation district was by the Board duly adjourned for further consideration from said 2nd day of September , A. D. 1907 to and until the 3rd day of September , A D 1907; and WHEREAS , on said the 3rd day of September the said petition was again presented to the Board , at which time said Board did again fully and carefully consider the said petition, the bond filed by said petitioners , the proof of the publication of said petition and the presen- tation of the same and all matters pertinent to the inclusion of the lands in said district , the exclusion of lands therefrom and all matters and things pertinent to and concerning the said petition for the formation of said Irrigation district and at which time said Board did duly fix , determine and establish the Boundaries of said district ; that said Board did at said time order an election to be held of all the qualified electors of said district as by statute in such case made and provided , for the purpose of voting upon and determining whether or not said proposed irrigation district should be organized as an irrigation district as by law provided, to be held on Saturday the 28th day of September , A D 1907, after notice thereof should be given and published as required by law for at least three weeks prior to such election in a newspaper of General circulation printed and published within the County of Adams , in the State of Colo- rado , and in a newspaper of general circulation printed and published in the county of Weld in r68468 the state of Colorado , that said notice was given and duly and regularly printed and published in manner required by the order of said Board as provided by law in both the counties of Adams and Weld in the state of Colorado; and that all matters and things in and about said 'election were done and performed pursuant to the orders of said Board, and pursuant to and in accordance with law; that the returns of said election have been duly made to this Board and the votes cast at said election by this Board duly counted and canvassed; that the said election held as afore- said for the purpose of determining the organization of said district has been carried and that a majority of the qualified voters of said district have voted upon the question submitted to them of the organization of said irrigation district , "Irrigation District , Yes , " said vote being as fellows , to-wit : "Irrigation District , Yes , 20 votes , " "Irrigation District , No , no votes . That said persons are hereby declared to be the duly elected and qualified directors of The Henrylyn Irrigation District , and authorized and directed to exercise , hold and discharge their offices as such directors until their successors are duly elected and qualified as by law pro- vided. 1 It is further ordered that copies of this order including the plat or plats of said The r470 470 Henrylyn Irrigation District , filed herein, duly certified, be immediately filed for record and recorded in the, office of, the, County Clerk and Recorder of the County of Weld in the State of Colorado , and in the office of the County Clerk and Recorder of the County of Adams and I State of Colorado ; the said order so to be recorded and filed for record in the said offices to be given and certified under the seal, of the Board and signed and attested by the Clerk of the Board of County Commissioners in and for the County of !old, in the State of Colorado . The motion of Co mmissioner E J Estes for the adoption of the foregoing resolution was duly seconded by Commissioner S A Bradfield, and being put to as vote, the ayes and noes were called and the said resolution was unanimously adopted, all the commissioners voting aye . •7 �- IN THE MATTER QF AGREEMENT WITH D E CARPENTER, ATTORNEY A The following agreement between Dolph E Carpenter , Attorney and the Board of County Commis- sioners of the County of Weld and State of Colorado , which, is ,in words and figures as follows , was en motion ordered signed by the Board and one copy delivered to Mr . Carpenter and the other placed en file , viz : -- This Agreement between the Board of County Commissioners of the County of Weld and Delph E Carpenter , County Attorney, Witnesseth: -- In order that definite arrangements may be made regarding the remaining fees to be due Deiph -E Carpenter, in the following oases , to-wit : -- Jesse S Gale vs . George D Statler , and the Board of County Commissioners of the County of Weld vs . D. F. Camp , both of which cases are pending in the Supreme court of Colorado on appeal , it is mutually agreed by and between the parties hereto that the sum of 50 00 shall be paid by the Board of County Commissioners and accepted by Mr . Carpenter in full compensation for the balance due him as attorney fees in the case of Gale vs Statler , as soon as decision shall be rendered therein by the Supreme court and also that a like sum shall be due and payable to Mr . Carpenter in full payment of the balance due him as attorney fees in case of The Board of County Commissioners is Camp , as soon as the decision shall be rendered in said case by the Supreme court , PROVIDED, HOWEVER, that the said Deiph E Carpenter shall continue to act in his capacity as attorney for the County in said cases to and until said final decision is rendered, and in the event that he does not act , said fees shall not be due him. It is further agreed that the Board will reimburse the said Deiph E Carpenter for any other and further necessary expenses incurred in the prosecution of said cases for printers bills and costs of like nature , when mutually agreed upon prior to being incurred. (SEE CHAPTER 107 SESSION LAWS OF 1907 . ) Daniel Strohl , Contractor , ap- peared before the Board and stated that he had completed all work, as per specifications and contract furnished by the State Engineer on that certain road near Ault , Weld County, Colorado , for which an appropriation of $2000 . had been made by the Sixteenth Session of the General Assembly of the State of Colorado , as authorized and shown by House Bill No . 6 , and requested that this Board and the State Engineer view the same to the end that said work be accepted as completed and he be released from further work on the same . After carefully going over the entire line of road in company with Mr . Houston, Deputy State Engineer , and the Board feeling that the work had been done in a first class manner , it was on motion duly made, seconded and carried, ordered ( as far as the interests of this Board in said road is concerned) that the work by Mr . Strohl be approved and accepted as com- pleted, and that Mr . Strohl be and he is hereby relieved from further responsibility under his con- tract . Adams , to establish the loss of said tax certificates and to procure an order of this Board for the purpose of procuring tax deeds thereon, and the Board having considered the petition, affidavits , and evidence offered, doth find: 1st: That at the tax sale made by the County treasurer of Weld County, December 9, 1896, for the delinquent taxes of 1895, A M McClanahan purchased the S. That on or about March 16 , 1907, and while E P House was the owner of said certificates each and all of said certificates were destroyed by fire which occured in the building owned by _ said E P House . 3rd. That said E P House has assigned to W R Adams each and all of said certificates and all his interest therein by virtue of said tax sale and said assignment to him from A M McClenahan, and W R Adams is now entitled to have deeds jssued thereon as by law provided, on condition that he and said House execute a bond in the sum of *100 . conditioned to hold Weld County harmless in the premises .
