RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST DOUGLAS AND ESTHER BORN FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Douglas and Esther Born, VI #2030, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of November, 1995, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Douglas and Esther Born, property owners, were not present or represented
at said hearing, although all parties were notified of said hearing by Department of Planning
Services staff, and
WHEREAS,the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office until November 28, 1995, to allow adequate time for
the property owners to bring the subject property into compliance and for an inspection of the
property by the Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
by November 28, 1995.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on November 28, 1995, the Weld County Attorney
be, and hereby is, authorized to proceed with legal action against Douglas and Esther Born to
remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the
properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.

County Zoning Ordinance. The property is not in compliance at this time. There is still an
unscreened noncommercial junkyard located on the property. It consists of one engine and a
derelict car that can be seen from the road. The property owner does have screening up and did
indicate that he could have the engine put behind his screening and that the remaining derelict
vehicle would be screened within two weeks. The screening that still needs to be completed
consists of an area on the East side of his property. The area is about fife-teen feet in length. The
rest of the noncommercial junkyard has been screened or removed.

September 8, 1994 Property inspected. Screening is complete. Property is in violation
because of vehicles still outside the screened area.
October 10, 1995 New Complaint made. Assigned to Susan McMullen
October 13, 1995 Property inspected. Screening is complete, but vehicles are outside the
screened area. The property is in violation.
October 16, 1995 Susan McMullen left a phone message asking for Mr. Born to send the
Department of Planning Services a letter outlining the Use and History of
the property.
October 18, 1995 Phone conversation between Susan McMullen and Dougles Born. He
said that he received my message and that he would send me a letter.
He was also informed him that he would be scheduled before the board.
October 20, 1995 Received Mr. Born's letter.
October 26, 1995 Property inspected. Property is in violation.

October 27, 1995 Letter sent to property owner indicating that the violation case was
scheduled before the Board of County Commissioners.
The noncommercial junkyard is a violation of Section(s) 31.2 and 31.3.9 of the Weld County
Zoning Ordinance. To correct the violation a screening plan must be submitted and approved
by the Department of Planning Services before installation or the noncommercial junkyard must
be removed from the property.
The Department of Planning Services also recommends that the County Attorney be authorized
to proceed with legal action against any other persons occupying the properties, any person
claiming an interest in the properties, and any persons acting in active concert with the
identified parties.

10:00-a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you weregiven sufficient time to remedy the

unscreened noncommercial junkyard located on the property. It consists of several derelict cars
that are not behind the existing screening. To bring the property into compliance the
noncommercial needs to be removed or put behind the screened area. I did contact Mr. Born
about the cars. He did say that he would get the cars on the South side of his property behind
screening. I did tell him that the cars on the East side of his property would also need to be put
behind his screened area. He said that he would attempt to get them all screened before the
hearing, but that he may run out of time with the cars on the East side of his house.

We purchased the place at 7377 WCR 76 the first part
of March 1990. I have been collecting Antique & Historicle
Vehicles for 15 years .
the Conellys bought the acre to the west of us & built a
new house 4 to 6 feet above the normal lay of the ground , in
the summer of 1992 . At the time they bought the acre of land,
we had about 25 to 30 Antique & Historicle Vehicles & bodies
on our acre of land, very visable from the Conellys newly
aquired acre .
In 1994 I spent $30 , 000 to comply with the Conellys com-
plaint to the County of Weld/ . I built a fence & shed in 1994 ,
and both were inspected & approved by Weld County Inspectors .
I am not restoring any Vehicles at this present time .
Several of the vehicles behind the fence are being used for
parts for the Antique Vehicles in my collection. They will be
removed when all usable parts are taken off. Other parts
vehicles may be added as parts are needed for the Antiques in
my collection .
The vehicles & parts in the front or south of the fence &
building will be put away by the 13th of Nov. 1995 .

The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time. There is still an
unscreened noncommercial junkyard on the property. I did observe several derelict vehicles
outside of the screened area. I did talk to Mr. Born about the vehicles. He said that it would take
him a few weeks to get the cars behind the screen.
The complainant had also stated that the screening in place is inadequate. The screening I
observed was intact and six feet, eight inches high. When standing at natural ground level the
vehicles behind the screening can not be seen. When standing on Mr. Connely's artificially
elevated property the vehicles behind the screening can be seen.

Inspected property to determine compliance. The property is not in compliance
at this time. The screening and the 60' x 80' building has been completed,
however there are several derelict vehicles located outside of the building and
the screened area. I spoke with Mr. Born during the inspection and he said that
he had just brought in the old vehicles within the last 10 days and was removing
the usable parts and would then move the vehicles behind the screening. Mr. Born
said that he should have the vehicles moved within the next week.

Dear Mr. Born:
Thank you for your letter of May 7 . The Board of County Commissioners has
decided to allow you until July 11, 1994, to complete the 60' x 80' building.
You will be required to obtain a building permit prior to beginning construction
and comply with the minimum setback and offset requirements.
As we discussed, the screening on the west end appears to be a problem because
of the higher elevation of the adjacent residence. I've enclosed information on
the trees we discussed as a possible solution. Hopefully, with the construction
of the building, you' ll be able to enclose alot of the automobiles .
I would like to thank you for your cooperation in this matter, the progress you
made on your screening, and your decision to construct a building. If you have
any questions, please call me.

My praposal is to erect a new, white steel siding type, fence
