HomeMy WebLinkAbout971201.tiff RESOLUTION RE: GRANT SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN, S #423, FOR A FIVE-LOT SUBDIVISION (FOUR PUD ESTATE LOTS AND ONE PUD AGRICULTURAL LOT) / GANDER VALLEY - DOUGLAS MYERS, CIO JAMES S. HILLHOUSE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, a public hearing was held on the 25th day of June, 1997, at 10:00 a.m. for the purpose of hearing the application of Douglas Myers, do James S. Hillhouse, 9323 Weld County Road 70, Windsor, Colorado 80550, requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #423, for a five-lot subdivision (four PUD Estate lots and one PUD Agricultural lot) /Gander Valley for a parcel of land located on the following described real estate, to-wit: Lot B of RE #1211, located in the SE1/4 of Section 4, Township 6 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicant was represented at said hearing by James Hillhouse, Partner, and WHEREAS, Section 28.14 of the Weld County Zoning Ordinance provides standards for review of such a PUD Final Plan, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission, and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The applicant has complied with all the application requirements listed in Section 28.9 et seq., of the Weld County Zoning Ordinance. 2. The request is in conformance with Section 28.14 of the Weld County Zoning Ordinance as follows: A. The proposed PUD Final Plan is consistent with the Weld County Comprehensive Plan and is compatible with the future development as permitted by the existing PUD District and plans of affected municipalities. The PUD Plan conforms to the approved PUD District. The Utility Coordinating Advisory Committee reviewed and conditionally approved the PUD utility plan at its March 27, 1997, meeting. The concerns of the Utility Coordinating Advisory Committee are addressed in the Conditions of Approval. C. The uses, buildings, and structures shall be compatible with the existing and future development of the surrounding area as permitted by the existing zoning and with the future development projected by the Comprehensive Plan or Master Plan of affected municipalities. D. The proposed PUD Final Plan conforms with the performance standards in Section 35.3 of the Weld County Zoning Ordinance. E. The proposed PUD Final Plan will be in compliance with the Weld County Zoning Ordinance, Section 50, Overlay Districts. The site is not located within any Overlay Districts. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Douglas Myers, do James S. Hillhouse, requesting a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S#423, for a five-lot subdivision (four PUD Estate lots and one PUD Agricultural lot) /Gander Valley on the above referenced parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the PUD Final Plan plat: A. The Board of County Commissioners shall review and approve the subdivision improvements agreement for off-site and on-site improvements and the form of collateral. The security for the agreement shall be tendered and accepted by the Board of County Commissioners for the subdivision improvements agreement. B. The applicant shall submit evidence to the Department of Planning Services that the proposed PUD Final Plan will meet the Standards of the Windsor-Severance Fire Protection District, as listed in the letter from Dan Graham dated March 3, 1997. C. The PUD Final Plan shall be amended to comply with the Conditions of Approval by the Weld County Utility Advisory Committee in the March 27, 1997, meeting. D. The applicant shall submit evidence to the Department of Planning Services that the PUD Final Plan meets the requirements of the Division of Water Resources as listed in the referral letter from Steve Lautenschlager, dated March 18, 1997. 971201 PL1165 PUD FINAL PLAN, S #423 - MYERS, C/O HILLHOUSE (GANDER VALLEY) PAGE 3 E. The plat shall be amended to include the building envelopes on each lot, including the agricultural lot. 2. The following notes shall be placed on the PUD Final Plan plat prior to recording: A. The uses permitted within the PUD Final Plan shall include a total of five (5) lots (4 PUD Estate lots and 1 PUD Agricultural lot) which comply with the PUD Zone District requirements and as described in the application materials. B. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. C. North Weld County Water District shall provide domestic water service to all residential uses within the PUD Zone District. D. Individual septic systems shall provide sewage disposal to all residential uses within the PUD Zone District. E. Installation of all utilities shall comply with Section 10 (Design Standards) of the Weld County Subdivision Ordinance. F. All uses within the PUD Final Plan shall comply with the requirements of the Windsor-Severance Fire Protection District. G. Access to the development shall be from Weld County Road 19 for the Estate lots and from Weld County Road 72 for the Agricultural uses. H. All uses within the PUD Final Plan shall maintain compliance at all times with the U. S. Army Corps of Engineers' requirements/standards. Street signs and lot identification shall be in place prior to release of building permits. J. Exterior illumination of homes, yards, garages, and driveways shall be restricted as follows: Sources of light shall be shielded so that beams of light will not shine directly onto adjacent properties. ii. Neither the direct or reflected light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. 971201 PL1165 PUD FINAL PLAN, S #423 - MYERS, C/O HILLHOUSE (GANDER VALLEY) PAGE 4 K. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. L. No permanent disposal of wastes shall be permitted at this site. M. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. N. Fugitive dust shall be controlled on this site. O. Landscaping, including but not limited to, trees, shrubs, fencing, and entry signs or walls will not be allowed within the right-of-way of Weld County Road 19. P. Prior to release of building permits for residential structures, foundation plans shall be submitted bearing the stamp of a Colorado Professional Engineer for review and approval by the Weld County Building Inspection Department. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 25th day of June, A.D., 1997.
