#1204 FOR AN ACCESSORY STRUCTURE WITH GROSS FLOOR AREA OF 2,400
SQUARE FEET IN THE A (AGRICULTURAL) ZONE DISTRICT - DAVID MILLER
A public hearing was conducted on January 25, 1999, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 8, 1999, and duly published January 13,
1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of David
Miller for an Accessory Structure with Gross Floor Area of 2,400 square feet in the A (Agricultural)
Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott
Ballstadt, Department of Planning Services representative, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the record
as written with Conditions of Approval and Development Standards. Mr. Ballstadt clarified the
gross floor area is 2,400 rather than 1,800 as indicated on the notice, and five referrals responded
with comments of approval. Mr. Ballstadt stated the application is consistent with the
Comprehensive Plans of Weld County and the City of Greeley and gave a brief description of the
surrounding land uses. He explained the applicant intends to use the structure for personal
storage, and there will be no commercial or industrial activities taking place. He stated the
application will not take agricultural land out of production and the applicant was unable to attend
today's hearing. In response to Commissioner Baxter, Mr. Ballstadt stated the applicant will store
his excavation equipment and have an office in the structure. Responding to Commissioner Geile,
Mr. Ballstadt stated the storage and office area are related to the applicant's business; however,
this does not qualify the structure as a commercial use. In response to Commissioner Kirkmeyer,
Mr. Ballstadt stated notice was sent and the applicant did have surrounding property owners sign
a petition in favor of the structure, although it was not required.
No public testimony was offered concerning this matter.
Commissioner Geile moved to approve the request of David Miller for a Site Specific Development
Plan and Special Review Permit#1204 for an Accessory Structure with Gross Floor Area of 2,400
square feet in the A (Agricultural) Zone District, based on the recommendations of the Planning

staff and the Planning Commission, with the Conditions of Approval and Development Standards
as entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously.
This Certification was approved on the 27th day of January, 1999.
