RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST STANLEY HILLER FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE -VI #9900004
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Stanley Hiller, VI #9900004, is allegedly in violation of the Weld County
Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of April, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Stanley Hiller, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until May 13, 1999, to allow adequate time for the property owners to
bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office fcr legal action against Stanley Hiller to remedy the violation of the Weld
County Zoning Ordinance, and any other persons occupying the properties, any persons
claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until May 13, 1999,
to allow adequate time for the property owner to bring the subject property into compliance.

CASE SUMMARY
January 7, 1999 Initial compliant received for a noncommercial junkyard consisting of miscellaneous
debris and derelict vehicles.
January 7, 1999 Site inspection conducted.
January 7, 1999 Five day letter sent.
January 12, 1999 Telephone conversation between Sharyn Frazer and Mr. Hiller. Mr. Hiller stated that
he had worked with Code Compliance in the past and was instructed to complete
screening on the property to hid the derelict vehicles and miscellaneous debris. He
said that the existing fencing has fallen down and the debris is again within view or
surrounding properties and road rights-of-way.
January 12, 1999 Letter sent to Mr. Hiller thanking him for calling the department and granting him sixty
(60) days to bring the property into compliance.
March 12, 1999 Progress inspection conducted. The property is still in violation of the Weld County
Zoning Ordinance. It doesn't appear that any clean up or repair to fencing has
occurred.
March 22, 1999 Letter addressed to Emma Lou Hiller and Stanley Hiller scheduling them to appear
before the Board of County Commissioners at violation hearings on April 13, 1999, at
10:00 a.m.
March 25, 1999 Letter from Mr. Hiller to Sharyn Frazer. Mr. Hiller stated that he feels this violation
constitutes undue hardship, his mother passed away due to the stress caused during this
situation, and included a water bill that is forcing him to pay more money, which is
financial murder.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any othe-persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I conducted a
progress inspection o the property on March 18, 1999, and it doesn't appear that any progress is occurring. I
have scheduled a meeting with the Board of County Commissioners on April 13, 1999, at 10:00 a.m., to consider
the violations occurring on the property. This meeting will take place in the County Commissioners' Hearing
Room, First Floor,Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that
you or a representative be in attendance to answer any questions the Board of County Commissioners might have
about the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you

Dear Mr. Hiller:
The uses on the above described property are being considered as a zoning violation of Sections 31.2 and 31.3.9
of the Weld County Coning Ordinance. The noncommercial junkyard located on the property consisting of
miscellaneous debris and derelict vehicles will need to be completely screened from view of surrounding property
owners and road rights-of-way. As we discussed the fencing will need to be repaired to address this violation.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
have no discretion in this matter if you fail to correct this violation. You have 60 (sixty) days from January 12,
1999, to correct this zoning violation. Failure to do so will result in this office scheduling the violation before
the Board of County Commissioners to consider whether to refer the violation to the County Attorney's Office
for legal action.
