HomeMy WebLinkAbout990833.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST STANLEY HILLER FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE -VI #9900004 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Stanley Hiller, VI #9900004, is allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of April, 1999, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Stanley Hiller, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until May 13, 1999, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. PARCEL NUMBER: 1471 29 000024 CASE SUMMARY January 7, 1999 Initial compliant received for a noncommercial junkyard consisting of miscellaneous debris and derelict vehicles. January 7, 1999 Site inspection conducted. January 7, 1999 Five day letter sent. January 12, 1999 Telephone conversation between Sharyn Frazer and Mr. Hiller. Mr. Hiller stated that he had worked with Code Compliance in the past and was instructed to complete screening on the property to hid the derelict vehicles and miscellaneous debris. He said that the existing fencing has fallen down and the debris is again within view or surrounding properties and road rights-of-way. January 12, 1999 Letter sent to Mr. Hiller thanking him for calling the department and granting him sixty (60) days to bring the property into compliance. March 12, 1999 Progress inspection conducted. The property is still in violation of the Weld County Zoning Ordinance. It doesn't appear that any clean up or repair to fencing has occurred. March 22, 1999 Letter addressed to Emma Lou Hiller and Stanley Hiller scheduling them to appear before the Board of County Commissioners at violation hearings on April 13, 1999, at 10:00 a.m. March 25, 1999 Letter from Mr. Hiller to Sharyn Frazer. Mr. Hiller stated that he feels this violation constitutes undue hardship, his mother passed away due to the stress caused during this situation, and included a water bill that is forcing him to pay more money, which is financial murder. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any othe-persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties.
