The Board of Trustees of the Town of Milliken is considering annexation of property identified in
the enclosed documents:
1. Notice of Public Hearing - January 14, 1998 - 7:00 p.m. Milliken Community
Complex, 1101 Broad Street, Milliken, Colorado.
2. Petition for Annexation.
3. A resolution enacted by the Board of Trustees of the Town of Milliken regarding the
findings for annexation procedure.

NOTICE OF PUBLIC HEARING
ANNEXATION
Notice is hereby given of a public hearing to be held before the Milliken Town Board of
Trustees at 7:00 p.m. on Wednesday, January 14, 1998, at the Milliken Community
Complex, Board Room, 1101 Broad Street, Milliken, Colorado. The purpose of the
public hearing will be to determine whether certain properties for which annexation
petitions have been filed meet the applicable requirements of the statues of the State of
Colorado and are eligible for annexation to the Town of Milliken. The legal desciptions
for the petitions is: A tract of land located in a portion of Section 2, Township 4 North,
Range 67 West of the 6th PM, County of Weld, State of Colorado being more
particularly described as follows; Considering the west line of the Northeast Quarter of
said Section 2 as bearing South 01°08'06" West and with all bearings contained herein,
relative, thereto:Beginning at the Northeast corner of said Section 2; thence along the
North line of the Northeast Quarter of said Section 2 North 88° 59' 39" West 2720.10
feet to the Northwest corner of the Northeast Quarter of said Section 2; thence along the
West line the Northeast Quarter of said Section 2 South 01° 44' 21 " West 2855.14 to the
Southwest corner of the Northeast Quarter of said Section 2 and the 'I'RUE POINT OF
BEGINNING: thence South 00° 40' 48" East 800.00 feet; thence South 87° 36' 12" East
;1372.55 feet, more or less, to a point line of the East line of the Northwest Q Iarter of

PETITION FOR ANNEXATION
TO THE BOARD OF TRUSTEES OF THE TOWN OF MILLIKEN, COLORADO:
The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended, hereby
petition the Board of Trustees of the Town of Milliken, Colorado, for annexation to the
Town of Milliken the unincorporated territiory more particularly described below
(Annexation Property), and in support of this Petition, petitioner(s) agree that:
(1) It is desireable and necessary that the Annexation Property be annexed to the Town of
Milliken, Colorado;
(2) Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed is
contiguous with the Town of Milliken, Colorado;
(3) A community of interest exists between the Annexation Property and the Town of
Milliken, Colorado;
(4) The Annexation Property is urban or will be urbanized in the near future;
(5) The Annexation Property is integrated or is capable of being integrated with‘the Town
of Milliken, Colorado;
(6) The signatures of the Petition comprise one hundred percent (100%) of the
landowners of the territory to be included in the area proposed to be annexed and said
landowners attesting to the facts and agreeing to the conditions herein contained will
negate the necessity of any annexation election;
(7) No land held in identical ownership, whether consisting of one tract or parcel of real
estate or two or more contiguous tracts or parcels of real estate:
(a)Is divided into serarate parts or parcels without the written consent of the
landowner or landowners thereof, unless such tracts or parcels are
separated by a dedicated street, road or other public way;
(b) Comprising twenty (20) acres or more and which, together with the buildings
and improvements situated thereon has an assessed value in excess of
Two Hundred Thousand Dollars ($200,000) for ad valorem tax purposes
for the year prece ing the annexation, is included within the territory proposed
to be annex ' out the written consent of the landowner or landowners.
(8)Nopart of the area proposed to be annexed is more than three (3) miles from a point
L o he municipal boundary, as such was established more than one (1) year before this
�`//annexation will take place;
(9) The area proposed to be annexed comprises more than ten (10) acres and an impact
report as provided for in Section 31-12-105.5, CRS, as amended, is required;
(10) The area proposed to be annexed is located within the Johnstown School District
RE5-J:
(11) The mailing address of each signer, the legal description of the land owned by each
signer and the date of signing of each signature are all shown on this Petition;
(12) Accompanying this Petition are four (4) prints of the annexation map containing the
following information:
(a) A written legal description of the boundaries of the area proposed to be
annexed;
(b) A map showing the boundary of the area proposed to be annexed, such map
prepared and containing the seal of a registered engineer or land surveyor;
(c)Within the annexation boundary map there is shown the location of each
ownership tract in unplatted land, and if part or all of the area is to be
platted, then the boundaries and the plat number of plots or of lots and
blocks are shown;
(d)Next to the boundary of the area proposed to be annexed is drawn the
contiguous boundary of the Town of Milliken, and the contiguous
boundary of any other municipality abutting the area proposed to be
annexed;
(e) The dimensions of the contiguous boundaries are shown on the map.
(13) The territiory to be annexed is not presently a part of any incorporated City, City and
County, or Town;
(14) The territory to be annexed is to be zoned Commercial/Recreational (C/R);
(15) The requirements of C.R.S. Sections 31-12-104 and 31-12-105 exist or have been
met;
(16) The signers of this Petition hereby reserve the right to withdraw this Petition or their
signatures therefrom at any point until the Board of Trustees of the Town of Milliken,
Colorado pass a final ordinance approving the annexation of the Annexation Property.
THEREFORE, Petitioner(s) request that the Board of Trustees of the Town of
Milliken, Colorado complete and approve the annexation of the Annexation Property,
pursuant to the provisions of the Municipal Annexation Act of 1965, as amended.

RESOLUTION NO. 97-19
BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE TOWN OF MILLIKEN,
WELD COUNTY, COLORADO THAT:
1. At the regular meeting of the Board of Trustees on December 9, 1997, the
Petition for Annexation for Lucky 13 Sports Park Annexation was submitted to the
board of Trustees by the Clerk as a communication pursuant to Section 31-12-
107(1)(f), C.R.S. The location of the property described in the petition is set forth on
Exhibit "A" attached hereto and incorporated herein by reference.
2. The Board of Trustees has reviewed the petition and finds that the
requirements set forth in Section 31-12-107(1)(f), C.R.S. have been substantially
complied with.
3. Pursuant to Section 31-12-108(1), C.R.S, the Board of Trustees hereby sets
the date for the hearing on the annexation petition for January 14, 1998 at 7:00 P.M. in
the Town of Milliken board Room Located at 1101 Broad Street, Milliken, Colorado.
Notice of this hearing is to be published in accordance with Section 31-12-108(2),
• C.R.S.
4. The purpose of this hearing shall be to determine whether the area proposed
to be annexed meets the applicable requirements of Sections 31-12-104 and 31-12-
105, C.R.S. and is eligible for annexation.
5. At this hearing if the Board of Trustees finds that the statutory prerequisites
for annexation have been bet, the Board will hold a public hearing on the ordinance
annexing this property.
This resolution was passed by a vote of t\ in favor and 3 opposed at the
meeting of the Board of Trustees on the 9th day of December, 1997.
