HEARING CERTIFICATION DOCKET NO. 96-30 RE: CHANGE OF ZONE FROM A (AGRICULTURAL) TO PUD (PLANNED UNIT DEVELOPMENT) C-1, C-2, C-3, I-1, AND 1-2 - ROCKY MOUNTAIN TRUST, C/O RUSTY GREEN A public hearing was conducted on June 24, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller County Attorney, Bruce Barker Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated May 29, 1996, and duly published June 6, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of Rocky Mountain Trust, do Rusty Green, for a Change of Zone from A (Agricultural) to PUD (Planned Unit Development) C-1, C-2, C-3, I-1, and 1-2. Bruce Barker, County Attorney, made this a matter of record. Shani Eastin, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She also suggested Condition of Approval #8 be added based upon receipt of the referral from the Colorado Geological Survey on June 21, 1996. Ms. Eastin referenced her memorandum dated June 24, 1996, and stated said Condition would require a note on the plat. She then responded to questions from the Board concerning access on Weld County Road 22 and referenced Condition of Approval#3 allowing no lots to access onto said road. Barb Brunk, Rocky Mountain Consultants, represented the applicant and submitted three maps, Exhibit B for the record, for the Board's review. She reiterated all lots access off internal roads, and the applicant agrees to pay its fare share of paving, based on the impacts created. Ms. Brunk concurred with staff and all eight Conditions of Approval. No public testimony was offered concerning this matter. Commissioner Hall moved to approve the request of Rocky Mountain Trust, do Rusty Green, for a Change of Zone from A(Agricultural)to PUD (Planned Unit Development) C-1, C-2, C-3, I-1, and 1-2, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, including the addition of Condition of Approval #8. The motion was seconded by Commissioner Baxter, and it carried unanimously. 961143 PL PL1034 .--.
