Denver Assistant Secretary Reference is made to your letter of September 12, posing several questions that your Board would like to have answered and I will try and answer them as they are numbered. "(1)'Can the osteopathic doctors be excluded from the Weld County General Hospital by the Medical Doctors or the Weld County Hospital Board of Directors (from the use of the facilities such as operating rooms,etc.)?" According to the Supreme Court, in Newton vs Com- missioners, 86 Colo 446, the answer is yes. "(2) May the osteopathic doctors treat welfare cases under the provisions of General Assistance, as provided by Welfare Regulations?" My understanding is, that osteopathic physicians have been qualified under the State Department of Public Welfare's program. "(3) When the County contracts with the Doctors of the American Medical Association to care for the welfare patients out of the County's General Assistance fund, what alternative does the county have when the doctors refuse to sign the contract as they demand more money than the County can afford?" 660266 Mr. Richardson Page 2 9/22/66 This is a difficult question . If the demands made by the doctors of your community exceeds that set up in your budget, you can't pay them and they'll have to collect from the patients themselves. "(4) May the County hire their own doctors such as hospital interns to care for welfare patients?" This poses the question, is the intern a doctor? He may have an MD degree, but does he have a license to practice medicine in Colorado? My understanding is that there are certain sciences for which he has to have a license -then he has to have a license issued by the medical board in order to practice medicine. "(5) Is there a limitation on the Welfare mill levy? The answer is yes - 3 mills. I would have answered this letter sooner, but I've been tied up with the Public Land Law Review Commission for the past few days. J.
