Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. The maximum permissible noise level shall not exceed the commercial limit
of 60 db(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
5. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s) . In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations. If the existing septic system(s) is
not permitted it is required to be reviewed by a Colorado Registered
Professional Engineer and a copy of that review submitted to this
Division, before the required I.S.D.S. Evaluation can be performed.

Dear Gloria:
We have reviewed the Agland, Inc . application for Change of Zone,
and offer the following comments :
RIGHT-OF-WAY Right-of-way (ROW) has not been addressed by the
submittal; however, projected traffic along this portion of SH 14
indicates the need for a 150 foot total ROW, with 75 feet each
side of the highway centerline. Additional width to meet the
projected need should be protected by reservation or, preferably,
dedication as permitted by County regulations.
ACCESS The proposal does not address development or expansion of the
existing business . Access design has not been addressed, although
Item 6 of the narrative states that access is provided and
believed to be adequate . The Site Sketch indicates that the
property has two accesses .
This portion of SH 14 is designated as a Category 3 highway which
allows a single private direct access to the state highway when
the property in question has no other reasonable access to the
general street system. Although there may be existing accesses
for the property, any change of use which results in a 20%
increase of traffic to the site provides the Department the
opportunity and obligation to bring access into conformance with
the State Highway Access Code (SHACode) . Only one access should
be allowed. Access should be designed to meet the standards and
specifications of the SHACode.
An access permit must be obtained prior to any change of use of
the property. Our office can assist the applicant with this

Our comments on state highway access are based on the information
presented for this property only. If the property owner has any
interests or ownership in adjacent property along the highway,
this information should be provided since it may affect our
comments .
DRAINAGE Drainage has not been indicated on the plans . If site
changes are proposed, the applicant should be reminded that the
highway drainage system is for the protection of the state highway
ROW, and is not intended to accommodate drainage from abutting
properties beyond that which has historically been accepted.
UTILITIES Should new utility lines or connections be required within
the state highway ROW, a utility permit will be required. Prior
to any such work, Mr. Henry Rangel of the Department should be
contacted at (303) 350-2111 .
Our comments are based upon the submittal as received January 23 ,
1995 .

Re: Briggsdale Station Soils Investigation
Dear Mr. Cochran:
Total Engineering Service, Inc. (TES) conducted a Geotechnical
Investigation on January 9, 1995 at the above referenced site located
in part of the Southwest Quarter (SW 1/4) of Section 21, Township 8
North (T. 8 N.), Range 62 West (R. 62 W.) in Briggsdale, Colorado.
Based on our field findings the soils found on site are not suitable as
a mineable resource. The sand and gravel found is too small in
diameter for use as road base or structural fill. The sand and gravel
was also found beneath twelve feet (12") of overburden soils.
