RE: APPROVE CONTRACT AMENDMENT #1 TO OEC SOLID WASTE GRANT AND
AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Contract Amendment #1 to the Solid
Waste Grant between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Weld County Health Department, and
the Colorado Office of Energy Conservation, commencing October 15, 1996, and ending
December 15, 1998, with further terms and conditions being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Contract Amendment #1 to the Solid Waste Grant between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Weld County Health Department, and the Colorado Office of
Energy Conservation be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 9th day of November, A.D., 1998, nunc pro tunc October 15, 1996.

CONTRACT AMENDMENT I:I
THIS AMENDMENT, made this 14th day of, 1998, by and between the State of Colorado for the use and benefit
of the Office of Energy Conservation(OEC),a branch of the Office of the Governor,hereinafter referred to as the State,
and Weld County Health Department, 1517 16th Avenue Court, Greeley, Colorado, 80631, hereinafter referred to as
the Contractor,
FACTUAL RECITALS
Authority exists in the Law and Funds have been budgeted, appropriated and otherwise made available and a sufficient
unencumbered balance thereof remains available for payment in Fund Number 180, Organization Account EAEX,
Contract Encumbrance Number C900315,OMB Catalogue Number 81.041;and
Required approval,clearance and coordination has been accomplished from and with appropriate agencies;and
The parties entered into a contract dated August 1, 1996,more fully described below;and
In accordance with the terms of Paragraph 13 of the Original Contract, Contractor has notified the State it requests a
modification of the terms of the Contract,specifically requesting an extension of time;and
The State deems the extension of time is reasonable and will promote a more comprehensive and thorough completion
of the project by the Contractor;and
The extension in time requires no additional monies allocated by the State.
NOW THEREFORE, it is hereby agreed that
1. It is expressly agreed by the parties that this Amendment is supplemental to the Original Contract Routing
Number 01032, dated August 1, 1996, referred to as the "Original Contract,"which is, by this reference, incorporated,
made a part hereof, and identified as Attachment "A," and all terms, conditions and provisions thereof, unless
specifically modified herein,are to apply to this Amendment as though they were expressly rewritten, incorporated,and
included herein.
2. It is agreed the Original Contract is and shall be modified,altered and changed in the following respects only:
A. Paragraph 20, Page 5 of 7 Pages, the first sentence, containing the termination dale of October 14,
1998, is further amended to read: ". . .through the 15th day of December, 1998."
B. Special Provisions, Pages 6 and 7 of 7 Pages,are amended by the addition of the following clause as
Paragraph 9,thereby renumbering the following paragraphs as 10 and 11:
"9. Pursuant to CRS 24-30-202.4 (as amended), the state controller may withhold debts owed to
state agencies under the vendor offset intercept system for: (a) unpaid child support debt or child
support arrearages; (b) unpaid balance of tax, accrued interest, or other charges specified in
Article 22, Title 39, CRS; (c) unpaid loans due to the student loan division of the department of
higher education: (d) owed amounts required to be paid to the unem plovment compensation fund:
and (e) other unpaid debts owing to the state or any agency thereof, the amount of which is found
to be owing as a result of final agency determination or reduced to judgment as certified by the
controller."

3. The effective date of this Amendment is October 14, 1998.
4. -Except for the "Special Provisions," in the event of any conflict, inconsistency, variance., or contradiction
between the provisions of this Amendment and any of the provisions of the Original Contract, the provisions of this
Amendment shall in all respects supersede, govern, and control. The "Special Provisions" shall always be controlling
over other provisions in the contract or amendments. The representations in the Special Provisions concerning the
absence of bribery or corrupt influences and personal interest of State employees are presently reaffirmed.
5. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL YEAR ARE
CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED, BUDGETED, AND
OTHERWISE MADE AVAILABLE.
6. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN APPROVED
BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS HE MAY DESIGNATE.

Amendment#1 to the OEC Solid Waste Grant Contract
Enclosed for Board approval is Amendment#1 to the Solid Waste Grant Contract between Weld
County Health Department and the Office of Energy Conservation (OEC) a branch of the Office
of the Governor.
This amendment extends the ending date of this contract until December 15, 1998. The original
term was from October 15, 1996 through October 14, 1998. This extension will give the Health
Department additional time to complete previously defined obligations. The contract provides
$10,000 in funding for solid waste projects in the region such as the annual Waste Saver awards,
waste-related educational events, and a rural school recycling program.
