road company. All of these locations are between the stations of Hudson

County Commissioners in Application 3o. 266 should be allowed. It is along

ISTITICN FOR MODIFICATION OF URDBR.
Comes now Chicago , Burlington and Mina, Railroad Com-
pany and reepeotfully shows;
1. That on the 13th any of June. 1919, sits Commission
made and entarud an order in the above entitled matter in words
and figuras =a8 full wig to-wit:
"IT IS T LJORII ORD' RID, That, in accordance
with Section 29 of the Public Utilities Let of Cot .-
rade as amended April 16. 1911, a public highway
crossing at grads be, and the saws is hereby, per-
mitted to be opened and established on the section
line between Sections 20 and 21, tewaship 1 North,
Range 66 West, Weld County, Colorado, where such
section line intersects the main line of the Chicago,
Burlington and .:ninny Pilroad.
IT IS PUR1'I )RD RED, That the crossing at the
point above described be constructed in accordance
with plans and specifications prescribed in the Corr
mission's order in Re Improvement of Orate Crossings
in Colorado, 2 Cola. P.U.C. 120,
IT IS FL'RTria MIDSBED, That the Ohioan, Burlington,
and tiny railroad shall open and establish said
Crossing and shall bear tho expense necessary thereto,
MXept that the County of Wild, Colorado, shall have
performed the work of grading including Rush drainage
as is necessary to the establishment of proper approach-

E. Jh&t said Railroad Company duly complied with all
the terms and provisions of said order and established crossings
Over its railroa,,l as therein directed.
3. That notwithstanding said order of the commission,
and the attempts made in _;ood faith by said Railroad Company to
comply therewith, the general public has since persisted and still
persists in the fregnest and and oontinnous use of the private cross-
ing near the section line between said 3eotions c0 and 29, to suoh
an extent as to virtually make said crossing a public crossing;
that it is practically impossible to confine said orossin6. to
mere private use by the adjoining lanai owners; and that experience
since the entry of said order strongly indicates that there is a
public desire and need for a public crossing on the section line
between said 3eotions 20 and 29, which said point is indicated by
the letter C in red on the blue print hereto attached, marked
Exhibit 1, and made a part hereof; that the other crossing pro-
vide' for in said order on the line between said sections 20 and
61 is designated by the letter B in red on said blue print
Ixhibi t 1.
4. That on the 1st day of June, 1986, there was filed
with said Commission an application, appearing on the dockets and
records of said commission as "Application No. 866". and entitled:
"In the matter of Application of the Board
of County Commissioners of Weld County, Colorado,
for the Opening of a Public Highway Over- the Right-
of-Way and Track of the Chicago, Burlington & Quincy
Railroad Company at a point on the Line running east
and west along the- sections 16 and El. in Township (1)
North Range 66 across the Burlington Railway in Weld
County, Colorado."
In said Application loo. 256, the applioants therein pray
for the establishment of a public arossin6 at grade over the main
line of this Petitioner's railroad where the same intersects the
section line between 3eotions 16 and 20 in said Township 1, North
and Range 6b West, (said last mentioned point being designated by

the letter A in red on said blue print, exhibit 1; that if a
�j grossing is established at the point prayed in said 4pplicsation
No. 266, such orosein , together with the crossings provided for
in the order hereinbefore set forth, will constitute three grade
orossince over said railroad within a distance of little more
than a mile. all used by the general public.
b. That such orossinga located so nearly together are
unnecessary and unreasonable; that the same are a source of danger
to the public traveling on the highways leading thereto and also
itto the passengers, employees and property on said Railroad Com-
pany's trains; that the maintenance of so many crossings in the
same vicinity impose an unnecessary and unreasonable expense on
said Railroad Company4 that in the event a public oroesin4 ie es-
tablished at said point A in said Application 2b6 and a public
grossing established also on the line between said Sections 20 and
E9 at said point 0, such oroasingswill well and sufficiently serve
ell public travel and necessity in the vicinity ; and , under such
circumstances, it will beet subserve the interests of all con-

••rri•d that the public crossing at the point B -n, the private cross-
ing near the point C be abolished.

its main lino at the point where said main line intersects section
line between Sections 20 and 21, in Township 1 north, of Rang
66 West in said `told County; that the location of said crossing •
is designated on the blue print hereto attached marked Inhibit 1,
and mate a part hereof by the letter B in red; and that in accords.

6. That if the Application in this matter asking for
the establishment of a public crossing at grade at the point where
the main line of said Railroad ::ompany intersects the section
line betweelk Sections 16 and 21 in said Township and Range (said
last mentioned point being: designated by the letter A on said
blue print Exhibit 1) there will exist three crossings at grade
ever the main line of said Railroad Company, and all

general public, within the distance of slightly more than one
mile; that public crossings so close together are unnecessary and
are a source of danger to the public traveling on the highways
and to the passengers, employeee and property carried on the trainf

on said Railroad, and the maintenance of said three crossin

close together entails an unnecessary expense upon said Railroad
Company; that a public crossing at the point marked A and a publics
crossing on the section line at the point marked on said blue
print will be entirely sufficient for the use of the public and
will best subserve the interests of all concerned in this matter.
7. That said Railroad 'Ampany has filed a petition for
li the modification of said order in said Application No. 38, re-
�; questing that said order be so modified as to abolish both of the
fl orossinge therein provided for and that in lieu thereof a public
crossing be established on the section line between Sections 20
and 29 (at the point C) .

cation in this matter be considered in connection with its peti-
tion for a modification of the commission's order in said Applica-
tion No. 88, and that in the event a public crossing is ordered
as prayed for in this Applioation No. 256, the same be grunted
ippon the condition that said public crossing at the point B, on
or near the section line between said Sections 20 and 21,and that
' the private crossing, near the section line between said sections
20 and 29, be both abolished and a public oroseing established on
' said last mentioned section line at the point C; and upon the

requiring said County to bear the expense of the grading and drain-

Dear Sir:
With reference to your inquiry of September 1, and also to our
telephone conversation of this date, I am inclosing herewith Application
No. 271, which was sent by error to Mr. D. C. Converse, Hudson, Colorado.
The blue print attached to this application shows the location
of the crossing asked for in Application No. 256, marked "A". As you will
understand after reading the application, it is the desire of The Chicago,
Burlington`and Quincy Railroad Company, that the present crossing at the
point marked "B" be closed and that the point marked "C" be opened. This
seems to conform to the desire of the people living in that community.
The Railroad Company is desirous of not having more than two
crossings within a mile of each other and feel that the public will be
served by the opening of crossings at points marked "A" and "C". If this
meets with the approval of the Board of County Commissioners of Weld. County,
kindly notify the Commission in writing and an order will be entered open-
ing crossings at "A", closing the crossing at point "B" and opening a
public crossing at point "C".
Early action on this matter will be gru9atly appreciated.

the receipt of which is hereby acknowledged, and of the laying out and opening of said road, hereby agree to give
the right of way through our lands as shown by the plat accompanying this petition, and relinquish all claims for
