The Board of County Commissioners of Weld County, Colorado, met in regular
session in full conformity with the laws of the State of Colorado at the regular
place of meeting in the Weld County Centennial Center, Greeley, Colorado,
February 3, 1999, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Dale K. Hall, Chair

MINUTES: Commissioner Geile moved to approve the minutes of the Board of County
Commissioners meeting of February 1, 1999, as printed. Commissioner
Kirkmeyer seconded the motion, and it carried unanimously.
ADDITIONS TO
AGENDA: There were no additions to the agenda.
CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the consent agenda as printed.
Commissioner Baxter seconded the motion, and it carried unanimously.

REPORTS: Chair Hall reported he spoke to the Town of Berthoud who previously spoke to
the Town of Mead, both of which are working on an IGA Coordinated Planning
Agreement to come before this Board.
PUBLIC INPUT: There was no public input.

WARRANTS: Donald Warden, Director of Finance and Administration,presented the following
warrants for approval by the Board:
All Funds $ 218,714.05
Commissioner Baxter moved to approve the warrants as presented by
Mr. Warden. Commissioner Kirkmeyer seconded the motion, which carried
unanimously.
BIDS: PRESENT AND APPROVE REMODEL DOS RIOS HEAD START BID -
HUMAN SERVICES DEPARTMENT: Pat Persichino, Director of General
Services stated emergency approval is requested due to the availability of the
contractors and the classroom. Three vendors submitted bids; Emy
Construction was low bid. Commissioner Kirkmeyer moved to approve, on an
emergency basis, the low bid from Emy Construction in the amount of
$7,850.00. The motion, which was seconded by Commissioner Geile, carried
unanimously.
PRESENT CATTLE GUARDS - PUBLIC WORKS DEPARTMENT: Mr.
Persichino presented the bid received from the sole vendor, Big R
Manufacturing. Said bid will be considered for approval on February 17, 1999.
APPROVE SHELVES FOR WALTON BUILDING BID - SOCIAL SERVICES
DEPARTMENT: Mr. Persichino stated Social Services recommends approval
of the bid from Snyder Equipment, Inc., which is the low bid at$279.00 per unit.
Responding to Chair Hall, Mr. Persichino stated some of the vendors measured
differently;therefore, various prices were quoted. Commissioner Baxter moved
to approve staff's recommendation. The motion, which was seconded by
Commissioner Geile, carried unanimously.
APPROVE 4-DOOR FOUR WHEEL DRIVE VEHICLE BID (1) - PUBLIC
WORKS DEPARTMENT: Mr. Persichino stated Public Works recommends
approval of the low bid from Heritage Ford; however, the local vendor, Weld
County Garage, is within $4.00. Commissioner Kirkmeyer moved to accept the
second low bid from Weld County Garage, because of the Home Rule Charter
requirement to give preference to local bidders, in the total amount of
$22,287.00 The motion, which was seconded by Commissioner Geile, carried
unanimously.
APPROVE % TON FOUR WHEEL DRIVE WITH EXTENDED CAB BID (1) -
PUBLIC WORKS DEPARTMENT: Mr. Persichino stated Public Works
recommends approval of the low bid from Greeley Dodge. Commissioner Geile
moved to accept said low bid, in the total amount of$21,588.00. Seconded by
Commissioner Baxter, the motion carried unanimously.
APPROVE 1 TON CREW CAB DUAL WHEEL UTILITY BOX BID(1)-PUBLIC
WORKS DEPARTMENT: Mr. Persichino stated Public Works recommends
approval of the low bid from Weld County Garage. Commissioner Baxter
moved to accept said low bid, in the total amount of$33,860.00. The motion,
which was seconded by Commissioner Kirkmeyer, carried unanimously.

APPROVE 1 TON TRUCK CAB CHASSIS EXTENDED FRAME BID (1) -
PUBLIC WORKS DEPARTMENT: Mr. Persichino stated Public Works
recommends approval of the low bid from Transwest Trucks, Inc.; however, he
indicated a local vendor, Weld County Garage, is within$120.00 of said low bid.
Commissioner Kirkmeyer moved to accept the bid from Weld County Garage,
in the total amount of$22,529.00, due to the Home Rule Charter requirement
regarding local vendors. The motion, which was seconded by Commissioner
Geile, carried unanimously.
APPROVE 1 TON DUAL WHEEL UTILITY BOX BID (2) - PUBLIC WORKS
DEPARTMENT: Mr. Persichino stated Public Works recommends approval of
the bid from Transwest Trucks, Inc., since it becomes the low bidder when all
options are included. Mr. Persichino also stated the second low bid from
Formby Ford, Inc., is within $19.00 of the low bid. Commissioner Geile moved
to accept the bid from Formby Ford, Inc., in the total amount of_$58,546.00.
The motion, which was seconded by Commissioner Kirkmeyer, carried
unanimously.
APPROVE 3 TON FLAT BED BID(1) -PUBLIC WORKS DEPARTMENT: Mr.
Persichino stated Public Works recommends the low bid from Ellis and Capp
Equipment. Commissioner Kirkmeyer moved to accept said low bid, in the total
about of$44,578.20. The motion, which was seconded by Commissioner Geile,
carried unanimously.
APPROVE TANDEM DUMP TRUCKS WITH SNOW PLOWS SLIP V BID (2) -
PUBLIC WORKS DEPARTMENT: Mr. Persichino stated Public Works
indicated the low bid was received from Ellis and Capp Equipment; however,
when options are properly included, Mountain States Truck becomes low bidder.
Commissioner Baxter moved to accept the bid from Mountain States Truck, in
the total amount of $174,839.00. The motion, which was seconded by
Commissioner Vaad, carried unanimously.
APPROVE BACK HOE FRONT WHEEL DRIVE EXTENDED BID(1)-PUBLIC
WORKS DEPARTMENT: Mr. Persichino stated Public Works recommended
approval of the low bid from Colorado Machinery. Commissioner Geile moved
to accept said bid, in the total amount of$63,567.00. The motion, which was
seconded by Commissioner Kirkmeyer, carried unanimously.
APPROVE SELF PROPELLED BROOM BID (1) - PUBLIC WORKS
DEPARTMENT: Mr. Persichino stated Public Works recommended approval
of the low bid received from Faris Machinery Company, in the total amount of
$24,915.00. Commissioner Vaad moved to accept said bid. The motion, which
was seconded by Commissioner Kirkmeyer, carried unanimously.
APPROVE MOTORGRADERS BID(3)-PUBLIC WORKS DEPARTMENT: Mr.
Persichino stated public Public Works recommends approval of the bid received
from Colorado Machinery, based on the five-year, full-cost analysis, at a price
of$126,313.00 for each grader. Commissioner Geile moved to accept said bid,
in the total amount of $378,939.00. The motion, which was seconded by
Commissioner Baxter, carried unanimously.

APPROVE CIVILIAN VEHICLES BID(2)-SHERIFF'S OFFICE: Mr. Persichino
stated the Sheriff's Department recommends approval of the second low bid
from Formby Ford, Inc., which has the under the hood light. If the under the
hood light were added to the low bid it would result in Heritage Ford no longer
being low bidder. Commissioner Kirkmeyer moved to accept the bid from
Formby Ford, Inc., in the amount of$15,182.00 per vehicle. The motion, which
was seconded by Commissioner Geile, carried unanimously.
APPROVE PATROL VEHICLES BID(6)-SHERIFF'S OFFICE: Mr. Persichino
stated the Sheriff's Department recommended approval of the low bid received
from Formby Ford. Commissioner Baxter moved to accept said low bid, in the
amount of $20,271.20 per vehicle. The motion, which was seconded by
Commissioner Geile, carried unanimously.
APPROVE ALL WHEEL DRIVE MINI VAN BID (1) -SHERIFF'S OFFICE: Mr.
Persichino stated the Sheriff's Department recommends approval of the low bid
from Dellenbach Motors. Commissioner Geile moved to accept said bid, in the
total amount of$21,701.00. The motion,which was seconded by Commissioner
Baxter, carried unanimously.
APPROVE 1 TON PICKUP TRUCK WITH TOMMY LIFT BID(1)-BUILDINGS
AND GROUNDS DEPARTMENT: Mr. Persichino recommended approval of the
low bid from Weld County Garage. Commissioner Geile moved to accept said
low bid, in the total amount of$26,981.00. The motion,which was seconded by
Commissioner Kirkmeyer, carried unanimously.
APPROVE SMALL PASSENGER VEHICLE BID (1) - PLANNING
DEPARTMENT: Mr. Persichino stated the Planning Department recommends
acceptance of the low bid from Garnsey and Wheeler Ford. Commissioner
Baxter moved to accept said low bid, in the total amount of $12,804.88. The
motion, which was seconded by Commissioner Vaad, carried unanimously.
APPROVE FOUR WHEEL DRIVE VEHICLE BID(2)-BUILDING INSPECTION
DEPARTMENT: Mr. Persichino stated staff recommends the approval of the
low bid from Formby Ford, Inc. Commissioner Vaad moved to accept said low
bid, in the total amount of $17,430.00. The motion, which was seconded by
Commissioner Baxter, carried unanimously.
APPROVE MAXI VANS BID (3) - HUMAN SERVICES DEPARTMENT: Mr.
Persichino stated the Human Services Department recommends approval of the
second low bid from Greeley Dodge, since the low bid does not meet minimum
specifications. Commissioner Baxter moved to accept said bid from Greeley
Dodge, in the amount of $29,129.00 per vehicle. The motion, which was
seconded by Commissioner Vaad, carried unanimously.
PLANNING: ZPMH #2116 -JAMES AND PAMELA ERTHAL: Eric Jerman, Department of
Planning Services, stated this application is for an extension beyond 18 months
for a Zoning Permit for a Mobile Home (ZPMH) for temporary use during the
construction of a residence. It is Lot B of Recorded Exemption #1723, the
surrounding area is agricultural with a few homes within one-quarter mile of the
mobile home, and sheep are pastured on the north side. Along with the Weld

County Department of Planning Services, the Larimer County Planning
Department submitted no comments regarding this application. The Weld
County Departments of Health and Public Works offered recommendations for
Conditions of Approval. Mr. Jerman stated the mobile home has been on-site
for approximately 18 months, and the original ZPMH application contains the
signatures of surrounding property owners, indicating there were no concerns
with the mobile home. Mr. Jerman reviewed the reasons for the favorable
recommendation of staff for this request, as well as the three proposed
Conditions of Approval. Responding to Chair Hall, Mr. Jerman stated the
Zoning Ordinance allows staff to grant a six-month extension to the original
12-month permit. The Board of County Commissioners must decide if it goes
beyond 18 months. -Mr. Jerman further stated the reason the construction was
not completed on time was because of the contractor's illness. After discussion,
Bruce Barker, County Attorney, clarified the Zoning Ordinance is to be
interpreted by the Board, in that it does not specify the specific timeframe to
extend to; however, he interprets it to mean six months from the date of
expiration. James Erthal, applicant, stated he does not foresee any problem
with being completed in six months, since the house is now closed in and the
wiring and plumbing are currently being installed. There was no public
testimony given. Responding to Commissioner Kirkmeyer, Mr. Erthal stated he
has no problems with the Conditions of Approval, since they are currently being
met. Commissioner Kirkmeyer moved to grant the request for a six-month
extension from today's date, with three Conditions of Approval as proposed.
Seconded by Commissioner Baxter, the motion carried unanimously.
RESOLUTIONS AND
ORDINANCES: The resolutions were presented and signed as listed on the consent agenda.
No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to
and respectfully submitted by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 9:45 a.m.
