RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST RICHARD AND SHARI RAFFAELI FOR VIOLATION OF
THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Richard and Shari Raffaeli, VI #9700027, are allegedly in violation of the
Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 13th day of May, 1997, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Shari Raffaeli, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until August 1, 1997, to allow adequate time for the property owners
to bring the subject property into compliance and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Richard and Shari Raffaeli to remedy the violation of
the Weld County Zoning Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until August 1, 1997,
to allow adequate time for the property owners to bring the subject property into compliance.

April 17, 1997 Progress inspection of the property. Property is still in violation.
April 24, 1997 Letter sent to the property owners indicating that the violation case
was scheduled before the Board of County Commissioners.
The mobile home and commercial business without the appropriate permits are still located on the
property, therefore is a violation of Sections 33.4.2, 33.4.3.3, 33.4.5 and 23 of the Weld County
Zoning Ordinance. To bring the property into compliance all appropriate permits must be obtained
for the mobile home and the commercial business.
The Department of Planning Services also recommends that the County Attorney authorize legal
action against any other persons occupying the properties, any persons claiming an interest in the
properties, and any persons acting in active concert with the identified parties.

To Whom It May Concern:
In December of 1992 we arranged to buy this property and move our
25 - year business to Greeley. We chose this area because it was
commercially zoned. Last year we divided our business area with
our son, so I needed to start a business to make up for our lost
income .
It ' s been hard, and we really need this added storage. We've had
estimates done for building on, and right now the cost is too
staggering for us to handle. Hopefully, in a few years, we will be
able to re-evaluate .
The only way we can get going and get our income moving is to have
the added kitchen area for my cakes, and storage area for the
dresses . Right now, I have things hung and stacked everywhere . My
work tables are set up in a cramped area, and in order to be
effective, I can' t be moving them and stepping all over my
supplies . I 've arranged for two mobile units to be moved onto our
property. One of them is already stored here. I needed to act
fast in order to acquire it .
We have had our property. landscaped and installed underground
sprinklers, we've had siding put on our house, and we've painted
and roofed our buildings, thus improving the sight tremendously in
the last three years . We will do the same for anything brought
onto this site. Our goal is to have a well maintained and
attractive business when we are done . We have had many compliments
on how we have improved this area, and we intend to do the same
with any kind of additions we make, now and in the future.
We will need two separate hook-ups to the city sewer system, also
water and electrical adjustments . We are very anxious to go
through the proper channels with this project . We will conform to
any laws, permits, etc . we will not be able to use the large
structure stored in the back for quite some time, but we will need
it to be set and hooked up. It needs extensive inner and outer
reconstruction that will need to be done more slowly, as we can
afford to do it . The smaller structure will address my immediate
needs . I have an open-house planned for April and I need this
smaller structure, at least, moved in as soon as possible . Please
be assured that these two structures will be sided and improved to

The uses on the above described property are being considered as a zoning violation of Section 33.4.2,
33.4.3.3 and 33.4.5 of the Weld County Zoning Ordinance. This is not a use allowed by right in the C-3
zone district.
The violation can be corrected by obtaining a Site Plan Review for the property and obtaining all
