1. The Department of Planning Services has determined through the review,that the standards of Section 11.4.2.1

with the following conditions in accordance with information submitted in the application and the policies of the
County.
2. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (ISDS) regulations.
3. Prior to recording the plat,the applicant shall:
A. The Environmental Protection Services Division of the Weld County Health Department was unable to locate
septic permits for the septic systems serving the two homes involved in this application. Any existing septic
system(s) which is not currently permitted through the Weld County Health Department will require an
I.S.D.S.Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found
to be inadequate,the system(s) must be brought into compliance with current I.S.D.S. regulations.
B. The following note shall be placed on the plat: All proposed or existing structures will or do meet the
minimum setback and offset requirements for the zone district in which the property is located.
C. The applicant shall submit evidence to the Department of Planning Services regarding the garage business
located on Lot B. The Department of Planning Services shall determine if a non-conforming use or a use
by special review permit is necessary.

D. The plat shall show a 75 foot reservation for future right-of-way from the centerline of State Highway 263
fora total of 150 feet.
E. The following note shall be placed on the plat: All construction or improvements on the subject property
shall comply with the Flood Hazard Overlay District Requirements as stated in Section 26 of the Weld
County Zoning Ordinance.
5. The subject property lies in the Weld County Airport Overlay District. The applicant shall submit to the Department
of Planning Services a reviewed FAA form prior to any construction on either parcel.
6. All access shall be clearly shown on the plat.
7. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of

This letter is in regards to our re/se application and one of the stipulations that we were to
follow. We enlisted the services of MCcrae and Short to survey our property and
complete the plat that was required, however we were notified on Tuesday February 25th
By Jerry MCcrae that their office would not be able to supply the information of the plat
by the deadline due date.
At this time we are requesting an extension for the plat information.
We have obtained the completed information from the Federal Aviation Administration
that was required.

Dear Mr. Mitani:
On January 20, 1997, an evaluation of the existing individual septic disposal
system at 24016 Highway 263, Greeley, Colorado; Section 01, Township 05 North,
Range 64 West, was conducted by Pam Smith.
The existing individual septic disposal system is of sufficient size and capacity
to adequately handle the proposed load. This evaluation is based on a final
treatment capacity for a 2 bedroom residence.
Each lot should include the property's septic system as a result of the recorded
exemption.
Be advised, neither the County of Weld nor any of its agents or employees
undertake or assume any liability to the owner of the above property, to any
purchaser of the above property or to any lending agency making a loan on the
above property or in the report.
This inspection was conducted for the purpose of determining compliance with
current regulations and for detecting health hazards observable at the time of
inspection. This does not constitute a warranty that the system is without flaw
or that it will continue to function in the future. Inspections requested during
periods of snow cover and high soil saturation may be of questionable value to
potential buyers due to adverse conditions. Evaluations based on Statements of
Existing (S.O.E. ) relies on information the property owner provides, under oath,
indicating current status of the system and representing to the best of his/her
knowledge the system is not failing to function properly.

The Environmental Protection Division of the Weld County Health Department has reviewed
SE-623 and RE-1968, submitted by Robert and Betty Tokuyasu. Two of the proposed lots are
only one (1) acre each. The Department recommends that these applications be denied, for the
following reasons:
1) The ratio of houses per acre on these two lots exceeds the ratio which we recommend for
development. Development of this density can adversely impact shallow groundwater.
Increasing lot size allows for adequate dilution and attenuation of wastes discharges through
a subsurface septic system. We currently recommend a minimum of two (2) acres per home
for this type of development.
2) Developments of this density (1 home per 1 acre) constrict area available for a replacement
septic system in the event of system failure. A septic system should operate for
approximately 20 years before it will need replaced. After 20 years the lots would likely be
developed. It has been our experience that after development there is not adequate area for
replacement systems.
In the event this application is approved, we recommend the following condition to be part of
any approval:
1) The Environmental Protection Division of the Weld County Health Department was unable
to locate septic permits for either of the septic systems currently serving the two (2) homes
involved in these applications. Any existing septic system(s)which is not currently
permitted through the Weld County Health Department will require an I.S.D.S. evaluation
prior to the issuance of the required septic permit(s). In the event the system(s) is found to

SUBJECT: Robert and Betty Mitani Tokuyasu Recorded Exemption
Shani, I have reviewed the above proposal and offer the following comments:
RIGHT-OF-WAY Right-of-way (ROW) has not been addressed by the submittal. Projected traffic
along this portion of State Highway (SH) 263 indicates the need for a 150 foot total ROW, 75
feet each side of the highway centerline. Additional width to meet the projected need should
be protected by reservation or preferably, dedication as permitted by County regulations.
ACCESS It appears that access to both lots will come by way of the existing access. It is unlikely
that the proposed residence will cause significant impact to the state highway to warrant access
improvements. The Department offers no comment regarding access.
UTILITIES If new utility lines or connections are necessary in the state highway ROW, a utility
permit will be required. Prior to such work, Mr. Henry Rangel of the Department should be
contacted at (970) 350-2111.
Our comments are based upon the submittal as received November 20, 1996. Thank you for the
opportunity to review the Tokuyasu proposal.

GENERAL POWER OF ATTORNEY
I, TAYEKO MITANI, the principal, of Greeley, Colorado,
designate KIYOSHI BOB MITANI, of Greeley, Colorado my attorney, in
fact and agent (subsequently called agent) in my name and for my
benefit:
1. GENERAL GRANT OF POWER. Except as expressly provided to
the contrary in Paragraphs 5 and 6, to exercise or perform any
act, power, duty, right or obligation whatsoever that I now have
or may hereafter acquire, relating to any person, matter,
transaction or property, real or personal, tangible or intangible,
now owned or hereafter acquired by me, including, without
limitation, the following specifically enumerated powers. I grant

annuities, pension, profit sharing, retirement, social security,

(b) Power to Acquire and Sell. To acquire, purchase,
exchange, grant options to sell, and sell and convey real or
personal property, tangible or intangible, or interests therein, on
such terms and conditions as my agent shall deem proper;
(c) Management Powers. To maintain, repair, improve,
invest, manage, insure, rent, lease, encumber, and in any manner
deal with any real or personal property, tangible or intangible, or
any interest therein, that I now own or may hereafter acquire, in
my name and for my benefit, upon such terms and conditions as my
agent shall deem proper;

�. (d) Banking Powers. To make, receive and endorse checks

(e) Motor Vehicles. To apply for a Certificate of Title
upon, and endorse and transfer title thereto, for any automobile,
truck, pickup, van, motorcycle or other motor vehicle, and to
represent in such transfer assignment that the title to said motor
vehicle is free and clear of all liens and encumbrances except
those specifically set forth in such transfer assignment;
(f) Business Interests. To conduct or participate in any
lawful business of whatever nature for me and in my name; execute
partnership agreements and amendments thereto; incorporate,
reorganize, merge, consolidate, recapitalize, sell, liquidate or
dissolve any business; elect or employ officers, directors, and
agents; carry out the provisions of any agreement for the sale of
any business interest or the stock therein; and exercise voting
rights with respect to stock, either in person or by proxy, and
exercise stock options;
(g) Tax Powers. To prepare, sign and file joint or
separate income tax returns or declarations of estimated tax for
any year or years; to prepare, sign and file gift tax return with
respect to gifts made by me for any year or years; to consent to
any gift and to utilize any gift-splitting provision or other tax
election; and to prepare, sign and file any claims for refund of
any tax;
(h) Safe Deposit Boxes. To have access at any time or
times to any safe deposit box rented by me, wheresoever located,
and to remove all or any part of the contents thereof, and to
surrender and relinquish said safe deposit box, and any
institution in which any such safe deposit box may be located
shall not incur any liability to me or my estate as a result of
permitting my agent to exercise this power;
(i) Health Care. To consent to or approve on my behalf
any medical or other professional care, counsel, treatment or
service of or to me by a licensed or certified professional person
or institution engaged in the practice of, or providing a healing
art.
2. INTERPRETATION. This instrument is to be construed and
interpreted as a general power of attorney. The enumeration of
specific powers herein is not intended to, nor does it, limit or
restrict the general powers herein granted to my agent.

3 . THIRD-PARTY RELIANCE. Third parties may rely upon the
representations of my agent as to all matters relating to any power
granted to my agent, and no person who may act in reliance upon the
representations of my agent or the authority granted to
my agent shall incur any liability to me or my estate as a result
of permitting my agent to exercise any power.
4 . DISABILITY OF PRINCIPAL. This General Power of Attorney
shall not be affected by my disability.
5. LIFE INSURANCE ON LIFE OF AGENT. Notwithstanding any
other provision of the General Power of Attorney, my agent shall
have no rights or powers hereunder with respect to any policy of
insurance, owned by me, insuring the life of my agent.
6. FIDUCIARY POWERS. Notwithstanding any other provision of
this General Power of Attorney, my agent shall have no rights or
powers hereunder with respect to any act, power, duty, right or
obligation, relating to any person, matter, transaction or
property, owned by me or in my custody as a trustee, custodian,
personal representative or other fiduciary capacity.

The following is in response to the Weld County referral for a recorded exemption and a subdivision
exemption;both for the applicants Robert N.And Betty Matani Tokuyasu. The case number for the subdivision
exemption being SE-623 and parcel numbers for the recorded exemption being 096101000064 and
096306000011.
The Greeley Planning Staff has decided against a favorable recommendation for both of these proposals
because of the following:
The City of Greeley's Comprehensive Plan Section 5 states "When developing in the vicinity of the
Weld County Airport, all development is encouraged to comply with the following compatibility
standards: 5.1 (III B-32)Noise Contour>65 Ldn--the average day/night decibel level 5.1.1 (III B-
32) Only land uses directly related to the airport should be permitted."
According to the Greeley-Weld County Airport Land Use Plan Map,this site appears to be located well within
the Traffic Pattern Airspace/65 Ldn zone. In fact,much of the Tokuyasu's land lies within the Runway Critical
Zone. Because the proposal in question is residential in nature and not related to the airport, staff is
recommending against this proposal.
Presently,this site is beyond the City's Long Range Expected Growth Area(LREGA). The resulting density
associated with this project falls within the parameters as approved by the Greeley Planning Commission for
proposals outside the LREGA.
Should the County Commissioners decide to approve these proposals,the Greeley Planning Staff recommends
that, as part of the approval, land be dedicated as right-of-way along Highway 263 that would ensure an overall
width of 100' (50'from property line to r-o-w centerline).This request assumes that the existing r-o-w is less
than 100'.
