RESOLUTION RE: APPROVE MINOR RESUBDIVISION, S #465 -TOWN OF BRIGGSDALE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 2ntl day of September, 1998, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of the Town of Briggsdale, for a Minor Resubdivision for the vacation of the following described rights-of-way : Forty (40) feet of right-of-way (being twenty (20) feet on each side of the street) from the width of the entire length of each of the following streets located in the Town of Briggsdale, Weld County, Colorado: Main Street, Milton Street, Leslie Street, Second Avenue, Third Avenue, Fourth Avenue, and Fifth Avenue. Said vacated rights-of-way are immediately adjacent to Lots 1-10 of Blocks 1-4, and Lots 1-20 of Blocks 5-16. Also, twenty (20) feet of right-of-way on the north side of Lee Street, and the alleys in Blocks 12 and 13 (no other alleys being vacated). Said vacated rights-of-way are shown on the attached minor resubdivision map. WHEREAS, Section 8.2 of the Weld County Subdivision Ordinance provides standards for review of said Minor Resubdivision for the vacation of road rights-of-way, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Utilities Advisory Committee and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.2.5 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.2 of the Weld County Subdivision Ordinance including specifically: A. Section 8.2.1. There is right-of-way shown on an approved plat or map that has not been used for its intended purpose for the last 21 years or since the recording of the approved plat. B. Section 8.2.2. Seventy (70) percent of the landowners adjacent to the proposed rights-of-way vacation waived any objection to the vacation by signing a petition. Section 8.2.3. The vacation shall only be permitted when it is compatible with the surrounding area and uses, is consistent with efficient and orderly development, is consistent with the Weld County Comprehensive Plan, and does not deprive any parcel of adequate access to a public road or street right-of-way. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of the Town of Briggsdale for a Minor Resubdivision, S #465, for the vacation of certain road rights-of-way on the hereinabove described parcels of land be, and hereby is, granted subject to the following conditions: 1. A utility easement shall be reserved for the benefit of existing and future placement of utilities in the vacated road and alley rights-of-way. 2. Future development shall not be allowed within the utility easement. 3. Existing structures located within the utility easement shall not be affected by the reservation of the utility easement. BE IT FURTHER RESOLVED by the Board that the Clerk to the Board of County Commissioners be, and hereby is, directed to record this Resolution and the attached minor resubdivision map in the Office of the Weld County Clerk and Recorder. Due to the extremely large right-of-way, over the years property owners have unknowingly developed their lots within the setbacks and offsets established in the Weld County Zoning Ordinance for the Agricultural zone district. In some cases structures have been placed nearly on the lot line and plantings are in the street right-of-way. The reason for the proposed right-of-way vacation is to correct this situation and to prevent future violations of setback and offset. I have scheduled a meeting with the Weld County Board of County Commissioners for Wednesday, July 29, 1998, at 10:00 a.m. This meeting will take place in the Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. Scott Ballstadt stated he did have some proposed verbiage from Bruce Barker, County Attorney, stating the following could be added to the plat: A utility easement shall be reserved for the benefit of existing and future placement of utilities in the vacated road right-of-way, including alleys. It was discussed among the members that existing structures be added to the verbiage. Scott stated this could be-added to the verbiage.
