The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 3. All existing or proposed accesses shall be shown on the plat: b.; The applicant shall comply with the requirements as stated in the referral letter received from the Assistant Greeley-Weld County Airport Manager, Dennis Moss dated July 11, 1996, by submitting the required FAA report (FAA Form 7460-1"Notice of Proposed Construction or Alteration), and submit evidence to the, Department of Planning Services that the required approval has been received from Federal Aviation Administration. c. Water Supply Statement: The included North Weld County Water District letter states the existing house and mobile home have service. The letter also states that water service is available for proposed Lot A. There is also a non- registered domestic well used to irrigate the lawns and garden for the existing buildings . The irrigation water historically used to irrigate proposed Lot B will remain with Lot B. The foregoing water supply is of sufficient quality, quantity and dependability based upon historic use. 2 . Sewage Disposal : The existing house and mobile home have operating septic systems . The proposed Lot A will be an approved ISDS . 3. Property Use: Proposed Lot A will be a rural residence and a little over 1 acre of land will be removed from agriculture plus roads and ditches. Proposed Lot B will remain a rural residence and (agriculture) irrigated farmland. 4 . Reason for Application: The applicant desires to build a new house for their daughter to live in. The applicant' s family is involved in this farm, plus substantial dryland farming activity near Sterling, Colorado, along with numerous business ventures in Eaton. Their daughter handles all of the record keeping for all of the ventures and handles the livestock and farming of the subject land when the rest of the family is at the Sterling operation. This activity is why it is important for her and her family to be physically located at the subject property. The son and his family live in the mobile home. Although there would be three families on the 40 acre partial, each are separated either by space or other buildings . 5. Location, Size and Use: See map and road access sheet to show relative location and 'size . As to use, see paragraph 3 above. Lot A will be approximately two acres including roads and ditches, and Lot B will be approximately 38 acres . Existing north access from NCR 49 will be used for proposed Lots A and B. Lot B will use the existing south access from WCR 49. 6. Municipal Plan Consistency: The land in this proposal is not within the 3 mile radius of the towns of Eaton, Greeley, Gill and Galton. It is ninlle miles northeast of Greeley, four miles west of Gill, five miles southwest of Galton, nine miles southeast of Eaton. This application does not add any additional impact to any of these towns . The school of Eaton shall not be impaclIted until the daughters children, if any, begin attending. 1 7 7 . Surrounding Land Use: The land to the north, south, east and west is irrigated farmland with rural residences and related farm buildings . This application does not intend to change the use of the land included in the application to be different from the neighboring land nor different than the historic use of the land of this application. 8 . District Intent: This application removes approximately 1 .2 acres of irrigated farmland from production. Lot A proposed residence will impact the farm and Lot B will remain irrigated farmland and the existing buildings . At this time, there is no intent or desire to build additional buildings for Lot B to impact the farmland. 9. Subdivision Ordinance Section 1 .3: a. The recorded exemption process is orderly and is integrated into the planning process . It accomplishes one' s private rights to retain one ' s farmland and existing residence and allow needed houses for family members necessary for the operation of the farm business . b. This application preserves 96% of the farmland while fostering economic health and continuance of the agricultural family unit. Existing water supplies, accesses and land uses do not change and will continue at the highest level available and practicable today. The mental health, management efficiency and financial stability will be maximized by the approval of this application. c. This application ensures one' s rights to retain farmland, residences for family members without going through an extensive subdivision. A subdivision is NOT desirable. All of the rural residences are needed because of this families need for proximity for the efficiencies of modern agriculture. d. It is the intent of the applicant to cooperate with any county process to involve effected towns. However, they do not see how this application effects the nearest municipality. e. This is NOT a subdivision. This application by its design maximizes existing residences, and proposed family residence while maintaining its farmland to enhance the agricultural district and family farm. f. The big safeguards are retaining existing residences, buildings, existing accesses and existing utilities to protect the public and applicants . A subdivider is NOT involved nor desired by the applicant. g. It is the intent of the recorded exemption process to provide uniform procedures and standards and by the parameters of this application secures equitable handling of an additional residence for family members . h. There is no wooded terrain in this neighborhood other than residential landscaping normal for the area. i . This application preserves the maximum amount of agricultural land in its present form which promotes its most productive agrarian use . The farm remains a farm, the buildings are fully utilized and minimal amount of land is used for a family member residence. j . Irrigation water flow and availability are not impacted. They will remain as in the past. k. Natural vegetation was changed over a 100 years ago, ',,, when irrigation began; however, irrigated farmland will continue and the rural residence and their related landscapes will remain intact . This retains the existing residential landscapes and irrigated crops . 1 . This application does not impact erosion, sedimentation or other pollution of surface and subsurface water. Nothing will change from the highly successful historical plan. m. Flood control has not historically been a factor for either Lot A or Lot B. This is because of the development of waste water flow from irrigation and the natural lay (terrain) of the land. n. There is NOT a flood hazard for any of the building areas and the soil is conductive to moderate absorption and low to moderate erosion. A creek area is a half mile east" of the east end of Lot B and the buildings are nearly three fourth mile west of the creek. o. Landslides, mud flows and other geologic hazards are not applicable at this site due to flat terrain and clay loam soil types . p. Future development of schools and parks are not impacted by the application because it does not materially impact the need for additional schools nor restrict the future use of this land under proper annexation, subdivision or change of use procedures .
