Moved by Arthur Partridge that the following resolution be introduced for passage by the Weld County Board
of Adjustment:
Be it resolved by the Weld County Board of Adjustment that the appeal of Robert & Shauna Dillon, for a
variance of seven feet from the 20 foot minimum setback (13 foot setback) in the A(Agricultural) zone district,
on property described as Lot A of RE-1754, located in part of the NW4 SW4 of Section 30, T2N, R68W of the
6th P.M., Weld County, Colorado.
be granted for the following reasons:
Based upon the submitted application materials and other relevant information regarding this request, the
Department of Planning Services' staff recommends approval of the request. It is staffs opinion that this
requested relief is not detrimental to the public good or contrary to the purpose and intent of the Weld County
Zoning Ordinance.
The applicant constructed a pole barn on the property and was not aware of the north setback until the barn
was complete. The initial construction of the pole barn did not require a building permit since it is considered
agricultural exempt. The applicant assumed that being 12 to 13 feet from the property line that the structure
would meet all setbacks. It wasn't until an inspector visited the site to inspect the electrical connection that the
setback problem was discovered. A letter was received from the nearest neighbor to the west, approximately
'h mile, stated that they have no objections to the location of the pole barn or with the variance request.
Numerous referral agencies also reviewed this request and all indicated that they had no conflict with this
request.
1. The submitted materials are in compliance with the application requirements of Section 62.3.1 of the
Weld County Zoning Ordinance.
2. No special conditions or circumstances exist which are peculiar to the lot and structure involved and
are not applicable to other lots or structures in the same zoning district. The applicant did construct
the pole barn not knowing the correct setback requirements from Weld County Road 16%. It is staffs
opinion that the placement of the structure will not place an undue hardship upon the surrounding
neighborhood.
3. Literal interpretation of the provisions of the Weld County Zoning Ordinance would deprive the
appellant of rights commonly enjoyed by other properties in the same zoning district under the terms
of the Zoning Ordinance. Literal interpretation would require that applicant to remove the barn and
place it 20 feet from the roadway. Staff believes that the granting of the variance will be in harmony
with the purpose and intent of the Weld County Zoning Ordinance, and will not be injurious to the
public health, safety or welfare of the surrounding land uses.
4. Special conditions or circumstances result solely from the actions of the appellant, however the
applicant was not required to obtain a building permit for the initial construction of the pole barn and
was unaware of the setback requirements. It wasn't until the applicant requested electrical hook-up
that the setback problem was discovered.

5. The variance requested is the minimum variance that will make possible the reasonable use of the
structures on the lot. The pole barn was already constructed and in place prior to the discovery of the
setback problem. The present location of the pole barn does not appear to deviate from the character
and appearance of the area nor does it appear to present any safety hazards.

APPROVED WITH CONDITIONS
The Department of Planning Services has determined through the review that the standards of Sections 11.5.1 through
11.5.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the
Weld County Individual Sewage Disposal System (ISDS) regulations.
Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require
an I.S.D.S. evaluation prior to the issuance of the required septic permit(s). In the event the sysem(s) is found to be
inadequate,the system(s) must be brought into copliance with current I.S.D.S. regulations.
Prior to recording the plat, the applicant shall amend the special use permit plat, USR-797,for a Home Business in the
A(Agricultural)Zone District,to show Lot A of RE-1754 being excluded from the special use permit area. The amended
plat shall be recorded in the Weld County Clerk and Recorders Office and a copy provided to the Department of Planning
Services Department.
The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld
County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the
Department of Planning Services. The applicant shall be responsible for paying the recording fees.

Enclosed please find all items requested by your department for our recorded
exemption application, including our check for $990.00.
I have also included, for the department's benefit, a copy of a blueprint
done in 1992 showing the total Baur property and details of the buildings
including the proposed recorded exemption site/dwelling. Tom Baur has
owned this property since November 1976, the proposed exemption was a
house without indoor plumbing at that time. In 1983 he applied and received
permits to renovate the house. It was moved back from the road and totally
renovated. We assume the house was there for 30-40 years, but it could
have been older. I believe before Tom bought the property it was separated
from the 17 acreas to the south of us. We do not have a date, but think it was
in the early 1970' s.

Dear Mr. Baur:
Our office has completed our review of your request as stated above
and will issue a building permit, providing you comply with the
applicable regulations found in the Weld County Zoning Resolution
and the Weld County Building Code.
The decision to issue the building permit was based, in part, on the
staff ' s opinion that the proposed renovation is similar to ordinary
repairs and maintenance permitted on non-conforming structures due
to the nature of the improvements you are proposing to make on the
tenant house. Secondly, it was the Staff ' s opinion that the
residential impacts of the structure will not change.
I hope this information is sufficient in answering your questions at
this time. Any future improvements to the tenant house other than
those presented by you at this this time will require a similar review
by this office. I would suggest you include a copy of this letter
with your application for the building permit.
