We are writing about David and Wilma Pyle's request,for a Special Use Permit. In the past, the Pyles owned property adjacent to ours. He applied for a Special Use Permit to operate a (nicking business in an agriculturally zoned area, which was also designated for a future residential area by the Town of LaSalle. Every neighbor around the Pyles opposed the Special Use Permit request, but Weld County approved the request. This event caused a strained relation between the community and the Pyles, which we feel was unnecessary. If we are going to have zoning laws, we need to abide by them. For example: The City of Greeley does not accommodate feedlots, however, agricultural areas are susceptible to freight business and housing developments. We should either adhere to our zoning laws or completely throw them out. is the agriculture community not important to Weld County? r The Pyles were allowed their request for Special Use Permit once before, which destroyed relationships in a neighborhood. The proposed use of the property for the parking of their trucks is expectable under both the National Fire Protection Pamphlet 30 and the Uniform Fire Code 1994 edition. The Fire Code does not try to regulate trucks and tanks that are administrated by DOT. If these were tanks on the ground instead of on wheels than grater restrictions would apply. The fire code does have the regulations on the parking of tankers. When talking about tankers parked more than one hour the distances are 25 ft to property line or 50 ft to those buildings approved by the chief (1994 Uniform Fire Code 7904.6.5.2.3 )The use of this type of construction does not meet the chiefs approval. 3. The Zone is agriculture however there are several houses within this area. To change the zoning to CA would be wrong for this property and would increase the setback requirements for any building that would be used for repairs. The building that are being used right know would not meet these requirement. According to the Uniform Building Code the buildings would carry a rating for an H occupancy and would have to be further from the property line. Also I believe that the buildings on this sight would not meet the building code requirements as to type of construction. 4. There are no businesses within this area except residential and agricultural. 5. A&B: There is some questions that come to mind. Are the two camper trailers being used OK'd by planning, building, and health departments?Are these trailers hooked up to septic tank and does the hook ups meet health codes? 6129199 CONFIDENTIAL Page 1 Platte Valley Are Protection District Kersey Co 80644 r Weld Phone 970/353-3890 5. D. They are talking about extending the North end of the garage. This is in conflict with having the correct setbacks for construction to property lines and right of way. This would also not meet the requirements of the fire code as to distance of 25 ft to property line. The only reason possible for their request to add onto the garage is that they want to be able to pull the tanks all the way into the shed while making repairs. This is a dangerous habit to get into because they would endanger themselves by letting the fumes from the tanks become entrapped in the building and thus expose the building and employees to explosion and fire. 5. E. With this much heavy weight the roads in the area, the roads will need upgrades. Who will pay for these? 5. G. Is this insurance for commercial or is it residential on all of the property? 5. H. The need for a fire hydrant this close to commercial use is there. 5. I. The Health department needs to make sure the leech field and septic tanks are large enough for this use. 8. Storage of run off from this property should be designed by an engineer. 10. Is their waste taken from property by waste disposal outfit? Is their waste disposed of by a hazardous waste generator? The owners of this property have a long history of not meeting any standards or codes that are made to protect citizens from this kind of operations. The ran a depot for trucking in the La Salle area and had their operations permits revoked on two occasions. As of right know there is a lot of weeds growing in the area where the trucks are being parked. 6r29r99 CONFIDENTIAL Page 2 Hello
