RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on July 13, 1999, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chair
Commissioner Barbara J. Kirkmeyer, Pro-Tem

The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the County
Attorney to proceed with legal action against the individuals named for violations of the Weld
County Zoning Ordinance. Cases were heard as follows:
VI#9800033-FORCHETTE:Sharyn Frazer, Department of Planning Services, presented the case
report for the record and stated this case is continued from the April, 1999, Violation Hearing. Ms.
Frazer explained the Department of Planning Services continues to work with the Forchette's and
requested a continuance until the September 14, 1999, Violation Hearing, to allow additional time
for the property owners to bring the property into compliance.
Commissioner Kirkmeyer moved to continue VI #9800033 against Donald and Jacque Forchette
to the September 14, 1999, Violation Hearing. The motion was seconded by Commissioner Vaad,
and it carried unanimously.
VI #9800184 - PYLE: Ms. Frazer presented the case report for the record and stated the property
is no longer in violation of the Weld County Zoning Ordinance.
Ms. Pyle, property owner, was present. Ms. Pyle stated all violations have been corrected at this
time. In response to Chair Hall, Ms. Frazer stated upon inspection of the property on July 12, 1999,
all violations have been corrected.
Commissioner Kirkmeyer moved to close VI#9800184 against David and Wilma Pyle. The motion
was seconded by Commissioner Vaad, and it carried unanimously.

VI #9900084 - NORDEN/GIDEA: Ms. Frazer presented the case report for the record and stated
the property is in violation of the Weld County Zoning Ordinance.
Mr. Norden, Jennifer Gidea (property owners) or a representative were not present at the hearing.
Commissioner Geile moved to refer VI #9800084 against Keith Norden and Jennifer Gidea to the
County Attorney for legal action. The motion was seconded by Commissioner Vaad, and it carried
unanimously.
VI #9900089 - MITCHELL: Ms. Frazer presented the case report for the record and stated the
property is in violation of the Weld County Zoning and Building Code Ordinances.
Mr. Mitchell, property owner, was present at the hearing. Mr. Mitchell stated he has been working
on bringing the property into compliance, but has been experiencing financial difficulties, as well
as health problems. Ms. Frazer, as well as several Commissioners, detailed to Mr. Mitchell exactly
what is required from him to bring the property into compliance and explained he is not permitted
to live in the mobile home on the property until all violations have been corrected and proper
permits are obtained. Mr. Mitchell indicated he understood the requirements and would like
additional time to bring the property into compliance.
Commissioner Kirkmeyer moved to refer VI#9800089 against Ray Mitchell to the County Attorney
for legal action, with the instruction to delay action upon such referral until September 13, 1999,
to allow adequate time for the property to be brought into compliance. The motion was seconded
by Commissioner Vaad, and it carried unanimously.
VI#9900165-SOTO: Dave Sprague, Department of Planning Services, presented the case report
for the record and stated the property is in violation of the Weld County Building Code Ordinance.
Mr. Soto was present at the hearing. Mr. Soto stated he has been unable to complete construction
on the manufactured home by purchasing a water tap, due to financial difficulties. Mr. Sprague
explained to Mr. Soto several of the inspections needed do not require any payment. Mr. Soto
agreed to schedule the inspections. Mr. Soto stated he would need more time to complete
construction and bring the property into compliance.
Commissioner Vaad moved to refer VI #9900165 against Eleazar Soto to the County Attorney for
legal action, with the instruction to delay action upon such referral until November 13, 1999, to
allow adequate time for the property to be brought into compliance. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.

VI#9900116-MILLER(GOMEZ): Mr. Sprague presented the case report for the record and stated
the property is in violation of the Weld County Building Code Ordinance.
Ms. Miller(Gomez)was present at the hearing and stated she has been having financial and health
difficulties and would need additional time to complete construction and bring the property into
compliance.
Commissioner Kirkmeyer moved to refer VI #9900116 against Gail Miller (Gomez) to the County
Attorney for legal action, with the instruction to delay action upon such referral until September 13,
1999, to allow adequate time for the property to be brought into compliance. The motion was
seconded by Commissioner Geile, and it carried unanimously.
VI #99000118 - STRONG: Mr. Sprague presented the case report for the record and stated the
property is in violation of the Weld County Building Code Ordinance. Mr. Sprague added as of
July 12, 1999, all inspections have been completed with the exception of the final electrical
inspection.
Mr. Strong, property owner, nor a representative were present at the hearing.
Commissioner Kirkmeyer moved to continue VI #9900118 against Christopher Strong to the
August 10, 1999, Violation Hearing. The motion was seconded by Commissioner Geile, and it
carried unanimously.
VI #9900052 - MONTOYA: Mr. Sprague presented the case report for the record and stated the
property is in violation of the Weld County Building Code Ordinance. Mr. Sprague added the house
which was in violation has now been flattened, therefore, no violation currently exists on the
property.
Commissioner Kirkmeyer moved to close VI#9900052 against Manuel Montoya. The motion was
seconded by Commissioner Vaad, and it carried unanimously.
