COLORADO MAY 2 3 1g97 The Environmental Protection Division has reviewed this application. We lLIVe n4 ft ' numerous recommended conditions and standards for this application. We have attempted to simplify our referral by separating the proposed conditions of approval and development standards. The following are recommended to be conditions of approval: 1. Prior to recording the plat: A) The facility shall demonstrate compliance with the Confined Animal Feeding Operations Control (CAFO) Regulation. This shall be demonstrated by submitting a comprehensive manure and waste water handling plan, for a 6 ,000 head dairy, to the Weld County Health Department for review and approval. This plan shall include, but not be limited to the following: (1) Demonstration that all manure stockpile areas and waste water collection, conveyance (including the pump), and retention facilities are adequately constructed and sized to handle a twenty-five year, twenty-four hour storm event. This shall be conducted by a Registered Professional Engineer . (2) Demonstration that any waste water retention structure constructed after August 30, 1992, has been constructed with a lining material which does not exceed a seepage rate of 1/32"/day (1x10-6 cm/sec). This shall be conducted by a Registered Professional engineer. (3) A site map demonstrating the layout of the site. This should include the locations of all pens, structures, feed storage areas, any water courses through the property, manure storage areas, lagoons, etc. (4) A surface contour map which demonstrates all surface water control features on the site. This should include surveyed surface elevations, indicate flow direction, run-on control features, etc. (5) Demonstration that the facility has the ability to manage and/or land apply manure and waste water at agronomic rates in accordance with the CAFO 971835 Gregerson, Francis USR-1151 Page 2 regulations. (6) Demonstration that adequate measures are in place to prevent any discharges except those which are allowed by the CAFO Regulations. (7) Other necessary measures which are required in order to comply with the CAFO Regulations. B) A dust abatement plan shall be submitted to the Weld County Health Department for review and approval. The facility shall have sufficient equipment available to implement dust control as required by the Weld County Health Department. C) A fly control plan shall be submitted to the Weld County Health Department for review and approval. D) An odor abatement plan shall be submitted to the Weld County Health Department for review and approval. E) The facility shall demonstrate compliance with Section 47 of the Weld County Zoning Ordinance. F) In accordance with CAFO, the applicant shall submit the facility's manure and waste water management plan to the Colorado Department of Public Health and Environment for review and comment. The following are recommended to be development standards: 1. Fugitive dust shall be controlled on this site. The facility shall be operated in accordance, at all times, with the approved dust abatement plan. 2. All liquid and solid waste shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. There shall be no permanent disposal of solid wastes, as defined in the Regulations Pertaining to Solid Waste Disposal Sites and Facilities (6 CCR 1007-2), at this site. 4. The facility shall maintain compliance with confined Animal Feeding Operations Control Regulations (5 CCR 1002-19) and, Section 47 of the Weld County Zoning Ordinance, as amended. 971835 Gregerson, Francis USR-1151 Page 3 5. The maximum permissible noise level shall not exceed the industrial limit of 80 db(A), measured according to Section 25-12-102, C.R.S. 6. Any required NPDES Permit shall be maintained in compliance with the Water Quality Control Division of the Colorado Department of Public Health& Environment. 7. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance, as amended. 8. The facility shall not discharge run-off or other waste waters to surface or groundwater with exception to what is allowed by the Confined Animal Feeding Operations Control Regulations. 9. Wastes materials, not specifically addressed by other development standards, shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 10. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. The surface beneath the manure storage areas shall be of materials which are protective of State waters. These areas shall be constructed to minimize seepage or percolation of manure contaminated water. In no event shall the facility impact or degrade waters of the State in violation of the Confined Animal Feeding Operations Control Regulation(5 CCR 1002-19). 11. The facility shall be operated in a manner which controls odor. Odors detected off site shall not equal or exceed the level of fifteen-to-one dilution threshold, as measured pursuant to Regulation 2 of the Colorado Air Pollution Control Regulations. The odor abatement plan shall be implemented at the request of the Weld County Health Department in the event odor levels detected off site of the facility meet or exceed the level of fifteen-to-one dilution threshold, or in the judgement of the Weld County Health Officer,there exists an odor condition requiring abatement. 12. The facility shall maintain records on-site, available for inspection during business hours, at all times, which demonstrates the following: A. That the waste water collection and storage facilities are adequately constructed, and sized to handle a 25 year 24 hour storm event. B. The manner in which manure and waste water will be removed and applied to 971835 Gregerson, Francis USR-1151 Page 4 land. This should also include any agreements between the facility and other parties concerning the off-site removal of manure or waste water for land application, treatment or disposal. C. The method in which waste water and/or manure will be applied to land, including the procedure which will be used to insure that agronomic rates are not exceeded. 13. In accordance with the Confined Animal Feeding Operations Control Regulations (CAF )), cattle shall not be allowed to directly access any waters of the state (as defined by CAFO). 14. The facility shall be operated in a manner to control flies. The fly control plan shall be implemented at the request of the Weld County Health Department in the event that flies (which can be determined to be associated with the facility) are in such a number to be considered a nuisance condition. The plan shall also be implemented in the event the Weld County Health Department receives a significant number of fly (associated with facility) complaints, and in the judgement of the Weld County Health Officer, there exists a fly condition requiring abatement. 15. Prior to enlarging any existing septic system or installation of a new septic system the applicant must meet all requirements of the Site Application Process (5 CCR 1002-12). A Site Application must be submitted to the Water Quality Control Division of the Colorado Department of Public Health and Environment(CDPHE). The applicant must meet all criteria of the CDPHE. A) Any septic system located on the property must comply with all provisions of the Weld County Individual Sewage Disposal System Regulations. B) Any future septic system which will serve any commercial type structure, i.e. offices, etc. shall be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 16. There shall be no burning conducted at the site, with exception to burning defined as "agricultural open burning" as defined by Regulation No. I of the Colorado Air Quality Control Commission Regulations. Note: Development standard#15 is the result of the close proximity of the existing and proposed homes and because the design hydraulic flow from each existing cluster of homes already exceeds 2,000 gallons/day. The Weld County Health Department will review the applicant for drainage facilities or improvements for livestock feeding, fugitive dust control, and the lagoon areas. Access: 2. My major concern are accesses to the proposed expansion to the facility. WCR 24 at this location is designated as a Collector on the Transportation Plan. I would like have the applicant dedicate or reserve an additional 10 foot of right-of-way adjacent to WCR 24 through the property to accommodate future road expansion. The three existing residences and the one office that accesses on to WCR 24 all contain circle drives zcfe.r,ing to our Ordinance ISO. I recommend that one each of the circle drives that access the homes be closed. The owner's dwelling could be accessed through the circle drive to the main office facility comfortably. Sharing one access to the employee's houses directly west may be easily accomplished at that location. This would eliminate multiple accesses on to WCR 24, which currently carries a traffic count of over 2,000 vehicles per day. The last traffic count was taken in 1996. The applicant has indicated that additional employee housing will be placed adjacent to WCR 24. On my site investigation, these existing houses are on I-beams and blocks. They are not set at this particular time. If these houses are permitted, I recommend that the additional employee housing access is incorporated into an internal road system with no additional direct access on to WCR 24. The access point could be accomplished through the existing housing facility and existing access point could be utilized_ The applicant has indicated that future employee housing on to WCR 11 adjacent to the existing housing facility. I would also recommend that an internal road system with the existing access point is utilized for future housing. Further, I've made an on-site inspection of the present facility. The size of the dairy as it currently exists,3,592 head, requires it to adhere to the Confined Animal Feeding Operation (CAFO)Regulations. Continued compliance with these regulations must be observed through all phases of expansion. I understand the sensitive nature of the environment in this area,with Godding Hollow Seep Ditch transversing the property,part of it passing directly through the livestock confinement area. It was my observation that the applicant has taken appropriate steps to design drainage of the confinement areas so that runoff will not be discharged into this ditch,or other waters of the State. (Note: There are a few pens designed to allow animals access to water(for drinking purposes)out of the ditch. It appears that appropriate construction was made to limit the area of access to the ditch.) Present facilities allow for approximately 325 square feet/animal(lactating cows),which is more intense than general recommendations,but not uncommon. Properly managed corrals(i.e. adequate drainage,regular removal of solids) should be adequate to support this density. Primary and secondary lagoons are constructed to handle liquid waste,with facilities to land apply for irrigation or if dewatering is necessary. Space for solid manure storage is provided,with most solids being used by area farmers and a commercial composting facility. It is recommended that a manure management plan be filed,according to CAFO regulations,if one has not previously been submitted. Studies support the need for one full time equivalent(FTE)employee per 50 cow milking herd(Managing 10.00 dollar Milk Prospectives on Dairy Inputs,Bernard J. Conlin,Extension Animal Scientist,Dairy Management,University of Minnesota),not counting farming obligations. Considering the 280 acres of fann ground and the steer program operated by the applicant, it is my opinion that the present and proposed number of employees is justified. It is unclear whether the potential residences as a part of the expansion of the dairy operation would have students. The typical projected student impact upon the St. Vrain Valley School District of 10 single family residences would be 7 students. Any students would attend Mead Elementary School, Mead Middle School, and Skyline High School under the present school boundaries. However, due to potential growth in these schools, this development and other existing developments in this feeder could be placed in another attendance area in the future. While this development will not place the middle school or high school over capacity, it will continue to add to the overcrowding at Mead Elementary. In addition, there are other approved developments in these attendance areas which will, together with this proposal, have a significant cumulative impact on these schools. As the volume of development increases in the Mead Elementary area, with no alleviation of the existing overcrowded conditions, the ability to provide the same quality education for these new students that is provided students in other areas becomes increasingly difficult. Therefore, the District would oppose the additional units because it would contribute to the overcrowding already in this feeder system. The District remains interested in implementing a land dedication/cash in-lieu ordinance either at the County level or separately with all developers. The District has implemented separate cash-in lieu agreements with individual developers that have helped to mitigate the impacts on the schools. If this were to be accomplished, the District would not oppose the project. Although the potential herd size of 6,000 animals was explained as more hypothetical than practical by the applicant , and related to the economics of various filing requirements , serious questions were raised regarding the impacts on the facility and the environment, both contiguous and downstream. The liquid and solid wastes appear to be adequately managed on site, however , the potential of extreme weather impacts might be further reviewed. Any ditch companies in close proximity to this location (Last Chance) , should be contacted regarding any comments on the potential of effluent contamination. In the letter from Keith R. Maxey, Cooperative Extension Agent, CSU, he recommended that a manure management plan be filed. We strongly recommend the preparation of a plan and that it be made a part of the final USR.
