RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST BRADFORD AND DONNA CARRILLO FOR VIOLATION
OF THE WELD COUNTY BUILDING CODE ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Bradford and Donna Carrillo, VI #9900117, are allegedly in violation of the
Weld County Building Code Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 9th day of November, 1999, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Bradford Carrillo, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until February 15, 2000, to allow adequate time for the property
owners to bring the subject property into compliance and for an inspection of the property by
the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County
Attorney's Office for legal action against Bradford and Donna Carrillo to remedy the violation of
the Weld County Building Code Ordinance, and any other persons occupying the properties,
any persons claiming an interest in the properties, and any persons acting in active concert with
the identified parties, with an instruction for delay of action upon such referral until February 15,
2000, to allow adequate time for the property owners to bring the subject property into
compliance.

November 08, 1996 Permit Number BC-9600930, was issued for an 896sf detached garage on slab. C
November 24, 1998 A 10 day letter was faxed by George Carroll to Bradford Carrillo.
December 14, 1998 A 10 day letter from George Carroll was mailed out to Bradford & Donna.
January 12, 1999 A site inspection was conducted by George Carroll and a notice was lets on the door
stating that the permit describes the garage as being 14' high; not with a 2nd story.
January 27, 1999 A 10 day certified letter was sent out by George Carroll.
March 24, 1999 A 30 day Building Code Violation Notice was sent by Dave Sprague.
June 15, 1999 Contact was made by Joe Mendez with Donna regarding the violation; she didn't know
much about what was going on, but she was gonna have Brad return my call.
June 21, 1999 I left a message on the machine for either Brad or Donna to give me a call.
June 22, 1999 I received a call from Brad. He had mentioned that he needed some more time to
complete the inspections. I granted him a three month extension (until September 30)
to get all final inspections completed. He also stated that he would be calling in for
some of the inspections completed within the next couple of weeks.
October 18, 1999 Follow-up after 3 month extension. No contact has been made with ether Brad or
Donna since the last conversation, and no inspections have been requested as stated.
October 19, 1999 A site inspection was conducted by Joe Mendez. No one was available. I left a
hand-written letter on the door for either Brad or Donna to give me a call. Photos were
taken of the garage and the letter that was left on the door.
October 27, 1999 There was no response from that I had left on the door from either Brad or Donna.
October 28, 1999 Scheduled Hearing Certified Letter was sent out by Joe Mendez.

November 01, 1999 Received a phone call from Mr. Carrillo requesting an extension with the Board of
County Commissioners. He did not leave a number to return his call. I had called hack
and spoke with his wife. She had Brad return my call. I had mentioned to him that
everything was already scheduled with the Board of County Commissioners and that
he would be able to request an extension. He stated that everything would he
completed, with the weather permitting, prior to the hearing with the exception or the
garage door, which is required per Dave Sprague.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorney's Office.

The property referenced above (1508 WCR 21) remains in violation of the Weld County Building Code
Ordinance. I have scheduled a meeting with the Board of County Commissioners for
November 09, 1999 , at 10:00 a.m. to consider the violation occurring on the property. This meeting
will take place in the County Commissioners' Hearing Room, first floor, Weld County Centennial
Center, 915 Tenth Street, Greeley, Colorado. It is recommended that you and/or a representative be
in attendance to answer any questions the Board of County Commissioners might have about the
violation. This would be a prime opportunity for you explain all issues regarding this violation. If you
can contact me prior to the hearing and take care of this matter, we will not proceed with the hearing.
If no contact is made, all plans will continue with the hearing.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the violation if
you and/or a representative are not available. Our records indicate that you were made aware of the
- nature of the violation, the action necessary to correct the violation, and that you were given sufficient
time to remedy the violation. If you have any questions concerning this matter, please call me.

I spoke with Donna regarding the violation. She doesn't know much about what is going on
with the permit, but she will be getting a hold of her husband to take care of this issue as
soon as possible.

inspections completed within the next couple of weeks. I granted him a three month extension
