E. The applicant shall submit to the Department of Planning Services the signed form indicating that the applicant
has been informed by the Department of Planning Services that the minimum lot size in the A (Agricultural)

4. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld
County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the
Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by

AMENDED RECORDED EXEMPTION QUESTIONNAIRE:
1 . A WATER SUPPLY STATEMENT.
Please find enclosed , a letter from Little Thompson Water
District regarding domestic water availability.
2. STATEMENT EXPLAINING THAT PROPOSED LOTS WILL HAVE ADEQUATE
MEANS FOR DISPOSAL OF SEWAGE.
Amended Lot A presently has an existing single family
dwelling with an on-lot septic system. Amended Lot B will
utilize an on-lot septic system if needed in the future.
3 . A DESCRIPTION OF HOW THE PROPERTY IS BEING USED.
Currently, the proposed site is located in the agricultural
Zone District . Lot A, as mentioned above , contains an
existing residence which disturbs no prime farm ground .
Lot B is primarily prime farm ground with an existing metal
shed which sits adjacent to Lot A.
4. REASON FOR PROPOSED RECORDED EXEMPTION AND HOW EACH LOT
WILL BE USED.
The purpose of this amended recorded exemption is to amend
Lot B to follow the approximate high water line on the
Easterly side of the Maintnomah Reservoir. Thru Planning
Staff ' s time and research , they found that the reservoir
does in fact legally split Lot B from it ' s previous
configuration, thus creating a legal buildable site on the
portion to the West ( 4 . 79± Ac. ) of the reservoir ( see
attached letter from Planning Department dated July 13 ,
1996 ) . Lot B, as proposed , will continue to be farmed as
in the past . It is also the purpose of this amendment to
amend Lot A from its original configuration to allow for
a "farm yard" for Lot B, and to utilize as much prime farm
ground as possible . Lot A will continue to be an existing
single family dwelling site .
5. A DESCRIPTION OF THE LOCATION, SIZE AND PRESENT USE OF THE
AREA WHERE THE PROPOSED NEW LOT WILL BE CREATED.
No new lots will be created thru this proposed amendment .
The configuration of the existing lots will change slightly
but the present uses will remain as agriculture and a single
family residence .

6. STATEMENT EXPLAINING THE PROPOSAL IS CONSISTENT WITH ANY
ADOPTED MUNICIPAL PLAN/INTERGOVERNMENTAL AGREEMENTS.
This property does not fall within any adopted municipal
plans or intergovernmental agreements .
7. STATEMENT EXPLAINING HOW THE PROPOSED USES WILL BE COMPATABLE
WITH EXISTING SURROUNDING LAND USES.
All adjacent land uses are made up of farming and large
single family parcels . This ensures that the existing uses
with this proposal are compatable with existing adjacent
land uses in the area due to the fact that they are the
same.
8. STATEMENT EXPLAINING HOW THE PROPOSAL IS CONSISTENT WITH
THE INTENT OF THE DISTRICT IS LOCATED WITHIN.
This prposal is located within the Agricultural Zone
District. The WCZO allows for agricultural activities along
with single family residential sites , which is consistent
with this site.
9. A STATEMENT EXPLAINING HOW THE PROPOSAL 1S CONSISTENT WITH
EFFICIENT AND ORDERLY DEVELOPMENT.
This proposal is consistent with efficient and orderly
development in that nothing will change as far as health,
safety and welfare of the residents of the County. Access
points will remain the same as well as all public services
such as utilities and public protection agencies.

sometime in the future, Lot A is sold, this would still grant access to Lot B from WCR 38.
If the intent is not to use the existing access through Lot A, a new access information sheet
is required. It needs to identify an existing or proposed access to Lot B from WCR 38.

This letter is in response to your request that the Little
Thompson Water District provide a water commitment for the
proposed B , described as follows:

Little Thompson Water District currently serves the residence
at 6638 WCR 38 through taps /380 and will continue to serve the
existing residence. The request is for 1 additional 5/8" X 3/4"
residential water tap. We will commit to provide service to this
new lot "B" via one standard residential water tap with the
following conditions:
1. The District has implemented a "system impact" fee for
all lots to be added to our system. The fee is $1, 000 . 00
per lot and is due and payable upon application for the
tap.
2 . All improvements to District facilities required to
provide service will be the financial responsibility of
the developer in accordance with District Rules and
Regulations. All improvements must conform to District
Specifications .
3 . We currently have an 4" Dia . line along the North side of
WCR 38 with additional capacity available service can only be
provided along NCR 38 .
4 . Little Thompson Water District would likw to have a
dedicated 20 foot water ulility easement along the North and
East sides of the Lots for future water line upgrades along
WCR 38 and WCR 15 .

letter if the tap has not been purchased and installed by that
