SUMMARY ORDER
IN THE MATTER OF THE CLAIM OF:
ANDRES GARCIA, Claimant,
vs.
WELD COUNTY, Employer,
and
SELF-INSURED, Insurer,
Carrier NoN 830568, Respondents.
HEARING WAS HELD in the above referenced matter on May
10, 1995, at Greeley, Colorado, by Administrative Law Judge H.
Conway Gandy. Claimant appeared in person and by counsel, Kristi
J. Coffin. Respondent employer appeared by counsel, Anne Smith
Myers. The issues heard were: temporary total disability, medical
benefits, penalties and attorney fees.
Based upon a complete review of all the evidence, including
the medical reports and other documents submitted at the time of
hearing, and the contents of the file;
IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT:
1. Claimant's requests regarding offsets taken by respondent
employer with regard to temporary total disability benefits shall
be, and hereby are, denied and dismissed.
2. Respondent employer shall pay all of claimant's reasonable
and necessary medical benefits arising out of the emergency medical
care at North Colorado Medical Center, Kenneth M. Olds, M.D. and
diagnostic tests, arising out of treatment following January 22,
1991, work evaluation testing.
3 . Any and all claims for penalties and attorney fees shall
be, and hereby are, denied and dismissed.

4 . All other issues not the subject of the herein Summary
Order shall be, and hereby are, reserved for future determination.
5. If any party to this matter timely requests entry of
Specific Findings of Fact and Conclusions of Law then, and in that
event, OPPOSING COUNSEL shall prepare the same, consistent with
the herein Summary Order, and forward them to the undersigned
Administrative Law Judge within FIFTEEN (15) days from the date
such request is made.
IN WITNESS WHEREOF, the Division of Administrative
Hearings has caused these presents to by duly executed this 12th
day of May, 1995.

This Summary Order is final and not subject to appeal unless
a Request for Specific Findings of Fact and Conclusions of Law is
made at thg Division of Administrative Hearings, P. 0. BOX 8287,
FORT COLLINS, COLORADO 80526-8003, within FIFTEEN (15) days
from the date upon which copies of this order are mailed.
