The Weld County Health Department has reviewed this proposal. We also reviewed the
sketch plan (S-462) for this development. Our comments were submitted in a
memorandum dated June 4, 1998. The application materials for this change of zone
appear to be substantially the same as for the sketch plan. Therefore, are comments will
be very similar to those submitted in the June 4, 1998 memorandum.
The application has not satisfied PUD Ordinance No. 197 in regard to water service.
Private wells are proposed. According to Section 2.20 of the Ordinance, a public water
system is required. It should be noted that according to Section 2.20 of the Ordinance the
applicant has the option to apply for an exception to the public water provisions. The
density of septic systems per acreage meets current Departmental policy. Therefore, our
Department would support an exception to the public water provision if it is determined that
the PUD would preserve and enhance agricultural lands and production.
The application has satisfied PUD Ordinance No. 197 in regard to sewer service.
Individual sewage disposal systems are proposed. The minimum proposed lot size (2.5
acres) and overall density of septic systems per acre (1 septic system per 39 acres) meets
Department policy.
The impact plan required by Section 6.3.1 was not provided in the application materials.
However, after considering the proposed use, at this time, our staff is not aware of any
potential environmental impacts or risks that this proposed development may pose that
may represent an increased environmental impact or risk in excess of other similar
developments.
This proposal appears to be located in an agricultural area. Our staff observed that the
proposed site is generally surrounded by open agricultural fields, some of which may be
used as biosolids application sites. We also observed that a feedlot currently exists
approximately 1/2 mile southeast of the of the proposed residential lots. It is our opinion
that any future property owner should be made aware that common agricultural uses exist
and that they might be exposed to dust, flies, odors, etc. in excess of the common urban
experience. As a result, we recommend that the "Right to Farm" covenant be required to
be placed on any recorded plat.
In the event the applicant does not receive an exception to the public water provision, we

will need to review the proposed public water supply. In the event the applicant receives
an exception to the public water provision and you find that the submitted materials
complete, we recommend that the following conditions be a part of any approval:
1) Individual sewage disposal systems are required for the proposed residential lots and
shall be installed according to the Weld County Individual Sewage Disposal (I.S.D.S.)
Regulations.
2) If during construction, more than five (5) acres of land is disturbed, the applicant shall
obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and the Environment.
Please note: The Weld County Health Department, Environmental Protection Services
recommends alternative strategies regarding water conservation and waste minimization.
Considerations such as xeriscaping, low flow water fixtures, backyard composting and
recycling are a few options available to home owners. We also recommend that
preliminary radon mitigation measures be incorporated in the construction of new homes.
Radon kits are available in our office. Please contact our Department for further
information.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:

COMMENTS:
WCR 43 is designated on the Transportation Plan Map as a Collector Status road requiring 80 feet of right-of-way
at full build out, there is presently 60 feet.
Weld County Public Works Department does not maintain minor subdivisions streets unless they are paved and
built to county standards.
The requirement for a Traffic Impact Analysis for the proposed minor subdivision (PUD) will be waived. The
applicant is responsible for a pull-off area/mail box pickup/school bus stop adjacent to the entrance to the proposed
UD.
REQUIREMENTS:
Section 6.3.2.2.1.7, Storm Water Drainage: All developments within a PUD zoned district shall adhere to the storm
water drainage design and technical criteria regulations in Section 10.13 of the Subdivision Ordinance. The
historical storm water drainage pattern and runoff amounts will be maintained. The developer will be required to
submit a detailed engineering study, from a Colorado licensed engineer, to show both the undeveloped and
developed drainage pattern. The drainage study will track the route of off-site discharge until it reaches a natural
drainage course, such as a creek or a river.
The applicant needs to elevate the approach road adjacent to WCR 43 to provide adequate sight distance in both
directions. A stop sign will be required prior to entering onto WCR 43.
Prior to recording the plat, an Improvements Agreement Regarding Collateral shall be submitted and approved by
Weld County Public Works Department on the transportation portion of the PUD.

Dear Sheri,
I received and reviewed the packet you sent concerning the Avery Farm change of zone
request. I made a site inspection of the parcel on 10/6/98. In this letter you will find the
Division of Wildlife recommendations on this project.
The farm in question is on the east side of Lone Tree Creek The entire parcel is irrigated
ag. Lend. The portion of the property that is being considered is an irrigated parcel,
planted to alfalfa. The stand is of marginal quality with encroachment by weedy species
including Russian Thistle. However,the alfalfa could be easily rehabilitated
rowed
and planted to an alternative irrigated crop. There are north-smith irrigation laterals
running along the east and west boundary of the proposed PUD. I saw skunk and
raccoon tracks in each of the laterals. In winter,after,the crop has been harvested,
Canada Geese feed in the fields on this property and the farm to the east. Goose hunters
regularly hunt surrounding fields bordering this land. I have also seen hunters on the
parcel. Lone Tree Creek has flooded on several occasions during my seventeen years on
this district. I have seen Weld Road 43 in this vicinity barricaded on more than one
occasion because of high water at this site.
The proposed PUD will lie hi the center of the NW 1/4 of section 10 and will be surrounded on all sides by irrigated ag. ground. From an agricultural standpoint as well
as the wildlife resource and recreation,the Division is concerned about the impact of
farmland fragmentation. As planned,this subdivision would have a potential impact on
farming and wildlife values. Despite the Right to Farm statement to be inserted in the
covenants,practices such as aerial spraying may have to be curtailed because of
restrictions on applicators or liability concerns. Despite the developer's intention of
notifying buyers that they may purchase ditch water, subdivision residents may divert or
pump water from ditches illegally. Because of the ditches and Lone Tree Creek
subdivision residents can expect visits from skunks, raccoon,misc_rodents and snakes.

The Division would therefore argue that from a wise land use standpoint it makes better
sense to locate the PUD on the parcel's north boundary adjacent to Weld Road 72. This
would cluster homes with existing residences in the area and enhance the ability to share
services. Access to and from the subdivision should be directed to Weld road 72 rather
than onto Road 43 as in the plan. By maintaining one shared access point, and a single
school bus pick up point,this would eliminate the need for a second entry onto Road 43.
It would also remove a road entry at a spot where wildlife regularly crosses and high
water from Lone Tree Creek accumulates.
The landscaping portion of the covenants indicates several species of`native grass." The
loamy nature of the soil would be consistent with a classic shortgrass ecosystem prior to
being turned by the plow. Therefore the native grass cover that should be planted would
be Buffalograse,Blne Grams turf The other species would be acceptable alternatives.
The use of Russian Olive and Siberian Elm should not be allowed on this site. Both
species are aggressive plants especially along watercourses like Lone Tree Creek and
associated irrigation ditches. From a wildlife standpoint the Division would recommend,
that in addition to the suggested juniper,cedar and Hackberry,the use of plums,misc.
species of cherry,hawthorn,Buckthorn,and misc. oaks be added to the list of acceptable
deciduous trees. Chokecherry,misc. currant,Serviceberry, Cotoneaster,sumac,wild
rose,wild grape, and Buffaloborry are additional shrub species that provide excellent
cover and food value in suburban wildlife plantings.
Fence design for the property should be types that will allow the free passage of wildlife.
The Division can provide specifications on request. Basically, on post and rail fences the
bottom rail should be at least 16 inches above the ground and the top rail should be no
higher than 40 inches.
These types of developments tend to attract hobbystock(rabbits,lama,alpaca, emu,
ostrich)rather than livestock. It would be good to clearly stipulate whether these species
will be allowed in the PUD. The covenants also state that horses may be kept on site as
long as a wooden corral is constructed. This may be ambiguous. The Division would
recommend that the covenant specifically stipulate and restrict the size of the corral. As
worded,a person could build a wood perimeter fence around the entire lot and let a horse
gram the entire lot. A 2.5 acre lot planted to Buffaiograss-Blue&ama would quickly be
grazed off by a single home left to wander. Therefore the horse should be kept in a
standard stall and fed bay. Light grazing periodically on the rest of the parcel could be
allowed, but it is important to restrict the horse's movements to present overgrazing.
The use of ditch water for turf irrigation would be a wise use of resources. It would be
good for the developer to purchase appropriate ditch rights,which could be sold to the
purchasers of individual lots. This may prevent the purposeful or unintentional theft of
water that often occurs when home sites are butted up to agricultural irrigation ditches.
Buyers should be notified in the covenants,that hunting(like farming)is something that
may occur leg lly on adjacent lands. The Division of Wildlife will respond when unsafe

or illegal hunting occurs- However the Division and the Weld Sheriffs office does not
have time to respond to calls merely because the caller objects to bunting philosophically
or because the sound of guns is inconvenient.
The buyer should also be notified that they will be responsible for the control of nuisance
wildlife problems on their lands, and that any control effort shall be in accord with all
Local, State and Federal regulations. In an effort to minimize the chance of wildlitb
conflict,it would be best if the covenants stipulated that home trash shall be contained in
raccoon proof containers' If dnmpsters are used the lids should be closed and secured.

I recently received a Geotechnical Investigation and Foundation Recommendations prepared by
Smith Geotechnical(October 1998). The borings encountered layers of clays, sands and silts that
are lensing in nature. The geotechnical tests that were performed in the field and the laboratory
show potential problematic soils in borehole locations BH-3,BH-4 and BH-5. The standard
penetration tests showed potentially soft clay in BH-3 between 6-7 ft below ground surface(bgs),
and potentially loose sand in BH-5 at 5-6 ft bgs and 9-10 ft bgs. These appear to be localized
occurrences. Soft clay and organic clay that is found within a building envelope must be
overexcavated, as this material has a tendency to consolidate over time and may cause structural
damage. The loose sands may be densified with vibrating compactors.
The swell-consolidation test performed on two samples from BH-4 indicated low to moderate
swell potential. If these soils are found within the building envelope, they should be
overexcavated and replaced with a structural fill, as stated in the geotechnical report.
Groundwater was encountered between 7 and 20 ft bgs. Subgrade construction should not be
undertaken where the ground level is within 5 ft of the water table. Perimeter drains should be
included as part of the foundation design. If the grade does not allow for natural outfall of
captured water, sump pumps should be used. Capillary breaks are also an effective guard against
subsurface water.
The shallow groundwater will have implications for the siting of leach fields, as a high water
table would cause system inefficiency and eventual failure. State health regulations require a 4-ft
interval between the base of a leach field and groundwater, in addition to acceptable percolation
rates.
This letter is a follow-up to the one written by Monica Pavlik dated June 8, 1998. The potential
problems at the site are problematic soils and shallow groundwater, and these conditions must be
takenk into account as development proceeds. CGS does not need to respond to a change in zone.
