Subject: USR-1080 - Morgan and Mahoney Boarding Kennel
Dear Ms. Eastin:
Earlier today at a regularly scheduled meeting, the City of Greeley Planning Commission
recommended approval for USR-1080 with the condition that the permit be approved for
no more than 5 years. The R-1 (Single-Family Residential) area within city limits
immediately to the north of the site is likely to develop within 5 years according to the
MRESA (Mid-Range Expected Service Area). A 75 animal kennel and grooming facility
may very well not be compatible with a developed subdivision. By reviewing the
proposal after 5 years, the City would be assured compatible land uses would be adjacent
to developing areas of the City.
Planning Commission and staff appreciate the opportunity to review proposals outside
the city limits which would impact our community.

Environmental Protection Services has reviewed this proposal; the following
conditions are recommended to be part of any approval:
1. All liquid and solid wastes shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, blowing debris, and other potential nuisance
conditions.
4. Fugitive dust shall be controlled on this site.
5. The facility shall receive a permit from and comply with the United States
Department of Agriculture Rules and Regulations Pertaining to the
Administration and Enforcement of the Pet Animal Care and Facilities Act.
6. The maximum permissible noise level shall not exceed the commercial limit
of 60 db(A) , as measured according to 25-12-102, Colorado Revised
Statutes.
7. Any existing septic system(s) which is not currently permitted through the
Weld County Health Department will require an I.S.D.S. Evaluation prior to
the issuance of the required septic permit(s) . In the event the system(s)
is found to be inadequate, the system(s) must be brought into compliance
with current I.S.D.S. regulations.
8. The prosed septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
9. The applicant shall remove and handle, feces and other waste material from
the facility area in a manner that will prevent nuisance conditions.
10. The Division requires that this facility utilize existing public water
supply.

This letter is in response to your letter addressed 3/24/95 concerning-the Mahoney property -
dog/cat kennel proposal (case # USR-1080).
The property in question is adjacent to the City of Evans (the 47th Avenue right-of-way) and falls
within the City's urban growth area. Our proposed Comprehensive Plan map shows this area as a
low density residential zone district, which is the same designation as the City of Greeley's zone
district immediately north.
The concern that we have is for the future. If this area is to evolve as single family residential,
there might be problems with the new neighbors because kennels are not permitted uses in R-1
zone districts. The City of Evans recognizes only our M-3 zone district as allowing "animals,
confined."
To decrease the chances of future conflict, we would recommend buffering the kennel from the
surrounding land at this time. In reviewing the site plan, it appears that there is very little setback
to the South and even less to the East of the proposed kennel. The Evans Planning staff would
recommend a setback of at least fifty (50) feet on all sides to serve as a buffer. This buffer should
be vegetated with trees and shrubs as soon as possible to ensure plant maturity when and if
neighboring development occurs.
The small-scale appearance of this endeavor is an important factor. If this kennel is to be
developed, the City of Evans would not support any additions or on-site expansions. We would also
request that any signs placed on the site have a relatively low-impact appearance. This would help
to preserve the residential/agricultural character of the area.
The planning staff at the City of Evans feels that the kennel would not adversely affect the
surrounding area at this time. To ensure harmonious development in this area, we would strongly
request that Weld County accepts our suggestions as stipulations to the approval of this proposal.

RE : 1995 PET ANIMAL CARE AND FACILITIES ACT
Last month, the State of Colorado passed a series of
new animal regulations into law ( i .e . , Senate Bill 95-023 ) .
The law pertains to daily operations, physical design and
new construction of pet stores, boarding kennels, animal
shelters and other animal care facilities .
Plans for new construction must be submitted to the State
for approval . The new regulations ( including licensing and
enforcement ) fall under the jurisdiction of the Department of
Agriculture, State of Colorado .
Since the new regulations have already been passed into law, all
animal care facilities must obtain and renew their new Pet Animal
Care & Facilities Act License annually, beginning in 1995 .

Dear Shani:
In recent conversations I had with Mr. Lee Morrison and yourself, I became aware of
Weld County's position on limiting the Use by Special Review permit for Morgan and
Mahoney-to 5 years. The County interpretation has been that a 5 year limitation, which
would be a similar limitation placed on shooting ranges, is not possible for kennels.
The proposed kennel is within 1/4 mile of the City of Greeley Mid-Range Expected
Service Area (MRESA) designated -for residential development. The MRESA is
established to determine where Greeley growth will occur in the next 5 years. A kennel,
located in very close proximity to an area already zoned R-1, which will develop within
5 years, is not compatible, unless the use is permitted for a limited amount of time. The
Greeley Planning Commission's intent was to allow the use now, and have the ability •
to review the use in 5 years and determine if a kennel is still compatible at this location.
The Planning Commission took into account the amount of capital investment for a _
kennel in determining the 5 year timeframe.
To summarize,-the only way the City of Greeley can support a boarding kennel at this
location is if the use is limited to a specific timeframe which corresponds to expected
residential development. Under no circumstances should this use be permitted in
perpetuity at this location. I hope this correspondence serves to clarify the City of
Greeley position on 7JSR-1080.

Dear Todd:
We have reviewed the proposal for development of -a boarding
kennel south of State Highway (SH) 34 . The intersection of 47th
Ave with the 34 -bypass is proposed to someday be improved with a
'diamond interchange. The construction of those improvements are
in the very distant future . The City of Greeley and Weld County
have been aware of the possibility of this interchange. a
-provide to you a copy of the aerial photograph to which have been
applied the right-of-way (ROW) limits which would be needed for
that improvement . This is conceptual only. adequate ROW should
-be reserved, or preferably dedicated, to accommodate this change.
It is difficult to determine, from the information you provided,
the impact to this site (lot A of RE # 435) . If the drawing is
current and accurate, it appears that the intersection
improvement may impact this property. 1 have provided a copy of
-this correspondence and of the aerial photograph to the County
and the City as a reminder of the possibility of changes to the
intersection and the need to preserve the ROW.
Our comments are based upon your letter and your provision of the
notice of public hearing received June 8 , 1995 . I apologize for
not connecting prior to that hearing and hope that the County has
not overlooked the potential for additional ROW need in their
review of this proposal .

Dear Mrs. Eastin:
We are writing in regard to the special use permit that Clifford D. Morgan
and Patricia A. Mahoney have applied for.
We have the property that immediately adjoins their property, and the
kennel will be right next to our RV parking lot. In reviewing the plans
for their kennel, and the way they intend to operate it, we see no reason
to object.
We are not concerned about the noise factor, as we are sure that every
precaution will be taken to control the animals. This is a rural area,
and any noise connected with this kennel will blend in with the other
animals, farm equipment, etc.
The kennel should not have a major effect on property values. Clifford
and Patricia have done extensive remodeling and landscaping since moving
in. We don't believe they would operate their kennel in a manner that
would lower their own property value.
We are sure that they are aware that the guidelines of the permit must be
followed or it will be revoked.
