RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST JIM AND ROSIE OSTER FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Jim and Rosie Oster, VI #9800048, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of December, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Jim and Rosie Oster, property owners, were present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorneys Office for legal action, with an instruction for delay of action upon such referral until March 8, 1999, to allow adequate time for the property owners to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's Office for legal action against Jim and Rosie Oster to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until March 8, 1999, to allow adequate time for the property owners to bring the subject property into compliance. March 24, 1998 Telephone call from Mr. Jim Oster. Items discussed included the definition of a noncommercial junkyard and specifically the items located on the property that fit the definition. March 25, 1998 Thirty day letter sent to Mr. and Mrs. Oster, including excerpts from the Zoning Ordinance addressing noncommercial junkyards. April 15, 1998 Progress inspection conducted. Conversation between Sharyn Frazer and Mrs. Oster. I reiterated that the Department of Planning Services would work with them and allow an adequate time frame to achieve compliance. July 24, 1998 Progress inspection conducted. There are still derelict vehicles and miscellaneous debris that needs to be addressed. July 24, 1998 Letter sent to Mr. and Mrs. Oster from Sharyn Frazer stating that another progress inspection had been conducted and a further extension Of 30 days had been granted. The letter also stated that I would be willing to conduct a "walk-through" inspection with the property owners to address the items on the property still in violation. August 28, 1998 Telephone call from Mr. Oster to Sharyn Frazer, requesting a further extension due to harvest. It was agreed that we would extend the time frame until October 30, 1998. October 26, 1998 Letter sent to Mr. and Mrs. Oster explaining that another progress inspection was conducted from the road right-of-way. It was explained in the letter that another inspection would occur on November 25, 1998. If at that time the property did not meet compliance, I would schedule them to appear before the Board of County Commissioners at violation hearings on December 8, 1998, at 10:00 a.m. November 25, 1998 Progress inspection conducted and pictures were taken with the digital camera. The property is not in compliance. November 25, 1998 Letter sent to Mr. and Mrs. Oster, scheduling them to appear before the Board of County Commissioners at the violation hearings on December 8, 1998, at 10:00 a.m. The Department of Planning also recommends that the County Attorney be authorized to proceed with legal action against any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. ALLEGED FINDINGS OF FACT This letter constitutes a formal "Warning Letter" as a follow-up to the inspection of the property located at 20270 WCR 42, LaSalle, Colorado in Weld County, conducted by Troy Swain, a duly delegated representative of the Colorado Department of Health, Air Pollution Control Division. During the Division's March 3, 1998 inspection, The Division determined that illegal open burning of wood was conducted at the above noted location. Smoke was observed from Interstate 25 in Adams County approximately %2 mile south of the Weld County Line. The fire was unattended and out of control. At the time of the inspection the LaSalle Fire Department was on scene putting out the fire. PROVISION OF LAW ALLEGED TO HAVE BEEN VIOLATED The open burning was conducted at 20270 Weld County Road 42, near La Salle in Weld County, Colorado in violation of Section 25-7-123(2)(a), C.R.S., and Air Quality Control Commission Regulation No. 1, Section II.C.1., which provides in part: "...No person shall burn or allow the burning of rubbish, wastepaper, wood or other flammable material on any open premises or on any public street, alley, or other land adjacent to • such premises, unless an open burning permit is first obtained from the Division." III. STANDARD PENALTY PROVISION FOR THE VIOLATION AS ALLEGED Section 25-7-123(3)(b) provides that any person failing to comply with Section 25-7-123(2)(a), for commercial purposes, shall be subject to a penalty of not more than $10,000.00 per day for each day of violation. Section 25-7-123(3)(a), C.R.S., provides that any person failing to comply with Section 25-7-123(2)(a), for noncommercial purposes, shall be subject to a penalty of not more than $100.00 per day for each day of violation. In addition, Section 25-7-115(5) requires the Division to determine whether a noncompliance penalty is applicable. If a noncompliance penalty is found to be applicable, such penalty generally must be assessed for any period of violation from the date of issuance of this notice until the date on which the emission source is brought into compliance. The amount of noncompliance penalty is calculated in accordance with the provision of Section 25-7-115(5)(b), C.R.S. IV. EFFECTIVE DATE OF NOTICE This Warning Letter shall become effective upon receipt. Troy E.
