HomeMy WebLinkAbout990270.tiff HEARING CERTIFICATION RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE A public hearing was conducted on February 9, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tern Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Jean Gillingham County Attorney, Bruce Barker Planning Department representative, Sharyn Frazer Planning Department representative, Sherri Lockman Health Department representative, Sheble McConnellogue The following business was transacted: I hereby certify that a public hearing was conducted to consider whether to authorize the County Attorney to proceed with legal action against the individuals named for violations of the Weld County Zoning Ordinance. Cases were heard as follows: VI #9700185 -WINTER: Sharyn Frazer, Department of Planning Services, presented the case report for the record and stated the property is no longer in violation of the Weld County Zoning Ordinance. Ms. Frazer added, the original violation (981464) was heard on August 11, 1998, resulting in the violation being turned over to the County Attorney with instructions to delay action until February 11, 1999, to allow adequate time for the property to be brought into compliance. Monty and Connie Winter, property owners, were present at the hearing. Mr. Winter stated he applied for and obtained a Building Permit which does not expire until June 8, 1999. In response to Chair Hall, Ms. Frazer stated an extension of the Building Permit could be granted by Planning Services. Mr. Winter added, since he is not in violation now, he would like the case dismissed. Commissioner Baxter moved to dismiss VI #9700185 against Monty and Connie Winter. The motion was seconded by Commissioner Geile. Commissioner Kirkmeyer stated she is willing to dismiss this case today, but does not want to see this property continually in and out of compliance. PL0824 HEARING CERTIFICATION - ZONING VIOLATIONS February 9, 1999 PAGE 2 VI #9700197 - NOVOTNY: Ms. Frazer presented the case report for the record and stated the property is in violation of the Weld County Zoning Ordinance. Ms. Frazer stated on September 23, 1998, the Board of County Commissioners conducted a hearing and approved Use By Special Review#1193 with Conditions of Approval and Development Standards. As of the date of this hearing, Ms. Frazer said some of the conditions had not been met. She presented a copy of BC #9800702 and pictures of said property, marked as Exhibit A, for the record. Gary and Mary Novotny, property owners, were present at the hearing. Mr. Novotny stated, he has been unable to meet all of the conditions of approval due to weather conditions and financial responsibilities, and would like an extension of time. Commissioner Kirkmeyer moved to grant an extension until April 12, 1999, to allow adequate time for Gary and Mary Novotny, property owners, to meet all Conditions of the Special Review Permit (USR #1193) and, if conditions are not met, a Probable Cause Hearing will be set by the Department of Planning Services. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 17th day of February, 1999.
