The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the
County Attorney to proceed with legal action against the individuals named for violations of the
Weld County Zoning Ordinance. Cases were heard as follows:
VI #9700185 -WINTER: Sharyn Frazer, Department of Planning Services, presented the case
report for the record and stated the property is no longer in violation of the Weld County Zoning
Ordinance. Ms. Frazer added, the original violation (981464) was heard on August 11, 1998,
resulting in the violation being turned over to the County Attorney with instructions to delay
action until February 11, 1999, to allow adequate time for the property to be brought into
compliance.
Monty and Connie Winter, property owners, were present at the hearing. Mr. Winter stated he
applied for and obtained a Building Permit which does not expire until June 8, 1999. In
response to Chair Hall, Ms. Frazer stated an extension of the Building Permit could be granted
by Planning Services. Mr. Winter added, since he is not in violation now, he would like the case
dismissed.
Commissioner Baxter moved to dismiss VI #9700185 against Monty and Connie Winter. The
motion was seconded by Commissioner Geile. Commissioner Kirkmeyer stated she is willing to
dismiss this case today, but does not want to see this property continually in and out of
compliance. The motion carried unanimously.
