RE: APPROVE SECTION 8 ADMINISTRATIVE CHANGES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Changes to the Weld County Housing
Authority's Administrative Plan, for the Section 8 Program, by the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Housing Authority, as required by U. S. Department of Housing and Urban Development, modifying
certain policies and addressing certain issues as stated in the attached Exhibit A, and
WHEREAS, after review, the Board deems it advisable to approve said changes, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board, that the Changes to the Weld County Housing
Authority's Administrative Plan, for the Section 8 Program, by the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Housing Authority, as required by U. S. Department of Housing and Urban Development, modifying
certain policies and addressing certain issues as stated in the attached Exhibit A, be, and hereby
are, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 25th day of March, A.D., 1996.

SUBJECT: Section 8 Administrative Changes '
DATE: March 19, 1996
As discussed at the Housing Authority Work Session of March 18, 1996, HUD requires that
Weld County Housing Authority's Admnistrative Plan, for the Section 8 Program, must be
modified to include policies to address issues concerning absentee tenants, family break-ups,
and owner suspensions or debarment. Staff recommends the following policies:
1. Absentee Tenants
A tenant may be absent from a unit for a two month period of time, for the following reasons,
in order for housing assistance payment to be continued:
1) Death of a family member
2) Illness or hospitalization
3) Employment in another location
2. Family Break-up
The following factors will be considered in the decision as to which household members
continue to receive housing assistance:
1) The interest of minor children
2) The needs of elderly, disabled, or ill family members
3) Whether the family members are forced to leave as a result of actual or threatened
violence.
The decision made by the housing authority is final.
3. Owner Suspension or Disbarment
The housing authority may not approve a unit if the owner is debarred, suspended or subject
to limited denial by HUD under 24 CFR. The Weld County Housing Authority may deny

approval to lease a unit from an owner for any of the following reasons:
1) The owner has violated obligations under a housing assistance payments contract
under Section 8 of the 1937 Act (42 U.S.C. 1437f);
2) The owner has committed fraud, bribery or any other corrupt or criminal act in
connection with any federal housing program;
3) The owner has engaged in drug trafficking;
4) The owner has a history or practice of renting units that fail to meet State or local
housing codes; or
5) The owner has not paid State or local real estates taxes, fines or assessments.
Staff is recommending your approval of the above administrative changes to the Section 8
Administrative Plan.
