HomeMy WebLinkAbout962022.tiff RESOLUTION RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND RESUBDIVISION, S #406, FOR PURPOSE OF ADDITION OF NEW LOTS IN BLOCK 2 OF KAHN SUBDIVISION -AL ALEXANDER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 6th day of November, 1996, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Al Alexander, 2653 Waterdale Drive, Loveland, Colorado 80637, for a Site Specific Development Plan and Resubdivision, S#406, for the purpose of the addition of new lots in Block 2 of Kahn Subdivision on the following described real estate, to-wit: Lot 1, Block 2, Kahn Subdivision, located in part of the SW1/4 of Section 2, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, Garry Woodman, Architect, represented said applicant, and WHEREAS, Section 8.4 of the Weld County Subdivision Ordinance provides standards for review of said Resubdivision, S #406, for the purpose of the addition of new lots in Block 2 of Kahn Subdivision, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 8.4 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.4 of the Weld County Subdivision Ordinance including specifically: A. The Resubdivision will not adversely influence the adopted rules, regulations, and ordinance currently enforced upon and affecting this subdivision. 962022 de, PG; Pco; (t_xl'nder'; 6..k)ed,i7acn PL1050 RESUBDIVISION, S #406 -AL ALEXANDER PAGE 2 B. The Resubdivision will not adversely influence surrounding property owners and conforms with the Weld County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Al Alexander for a Site Specific Development Plan and Resubdivision, S#406, for the purpose of the addition of new lots in Block 2 of Kahn Subdivision on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Within 30 days from the date of approval by the Board of County Commissioners, the applicant shall submit a mylar plat prepared in accordance with Section 7.2.6 of the Weld County Subdivision Ordinance. The plat shall be recorded with the Office of the Weld County Clerk and Recorder and the applicant shall be responsible for all recording fees. 2. Prior to recording the plat: A. A fifteen (15)-foot utility easement shall be placed along the south and west property lines of Block 2, as approved by the Weld County Utility Advisory Committee. No large trees shall be placed within the fifteen (15)-foot utility easements. B. A ten (10)-foot utility easement shall be placed along the south and west property lines of Block 2, as approved by the Weld County Utility Advisory Committee. No large trees shall be placed within the ten (10)-foot utility easement. C. All accesses shall be clearly delineated on the plat. D. All easements shall be clearly delineated on the plat. 3. The applicant shall adhere to all regulations and requirements of the Colorado Department of Transportation. 4. The 1-25 Frontage Road right-of-way shown on the submitted plat shall be dedicated to the Colorado Department of Transportation for future expansion of the highway. 962022 PL1050 RESUBDIVISION, S #406 -AL ALEXANDER PAGE 3 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 6th day of November, A.D., 1996.
