A RESOLUTION FINDING THAT THE PETITION FOR
ANNEXATION OF THE DOKE ANNEXATION IS IN
SUBSTANTIAL COMPLIANCE WITH C.R. S . 31-12-
107 (1) AND SETTING A DATE FOR A HEARING BEFORE
THE BOARD OF TRUSTEES OF THE TOWN OF SEVERANCE
TO CONSIDER THE ANNEXATION OF THE AREA
PROPOSED TO BE ANNEXED.
WHEREAS, the owner of 1000 of the property known as the Doke
Annexation has filed a petition for annexation of such property to
the Town of Severance and;
WHEREAS, the Board of Trustees has determined that the
petition is in substantial compliance with C.R. S . 31-12-107 (c) and
that a hearing should be set to determine whether the area proposed
to be annexed meets the applicable requirements of Sections 31-12-
104 and 31-12-105 C.R. S.
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF SEVERANCE :
Section 1 . The Board of Trustees finds that the petition for
annexation of certain property known as the Doke Annexation and
more specifically described in the property description attached
hereto as Exhibit "A" is in substantial compliance with C.R. S . 31-
12-107 (c) and Section 30 of Article II of the Colorado
Constitution.
Section 2 . The Board of Trustees hereby sets a public
hearing for the 27th day of November, 1995 at the hour of 7:00 p.m.
at the Town Hall , Town of Severance, 336 1st Street, Severance,
Weld County, Colorado for the purpose of determining and finding
whether the area proposed to be annexed meets the applicable
requirements of C.R. S . 31-12-104 and 105, and to determine whether
the area should be annexed to the Town of Severance .
Section 3 . The Town Clerk is hereby directed to publish
notice of this hearing once each week for four successive weeks in
the Windsor Beacon, the designated newspaper for the Town of
Severance .

PETITION FOR ANNEXATION
The undersigned Petitioner, pursuant to COLO. REV. STAT. § 31-12-107,
hereby petitions the Town of Severance (the "Town"), in the State of
Colorado, to annex the property (the "Property") herein described and to
incorporate the same within the corporate boundaries of the Town, as
follows:
SECTION ONE
ANNEXATION OF PROPERTY
1. The prosperity of the Town and of the Property will be greatly
enhanced by its annexation to the Town. Therefore it is desirable and
necessary that the Property be annexed.
2. The Property is eligible to be annexed, pursuant to COLO. REV.
STAT. § 31-12-104 and all requirements under said statute have been met.
a. Not less than one-sixth of the perimeter of the area to be
annexed is contiguous with the annexing Town.
b. A community of interest exists between the Property and
the Town; the Property will be urbanized in the near future;
the Property is integrated with or is capable of being
integrated with the Town.
3. The limitations, as set forth in COLO. REV. STAT. § 31-12-105,
would not have the effect of invalidating the proposed annexation and all
requirements under said statute have been met.
4. The Petitioner is the landowner of the Property to be annexed. A
certificate of ownership of the Property shall be submitted to the Planning
Commission of the Town within 30 days of the date of this petition.
5. The names and addresses of all property owners within 300 feet of
the Property will be submitted within 30 days of the date of this petition.
6. The legal description of the Property owned by Petitioner and any
water and ditch rights appurtenant to the Property is attached to this
petition.

SECTION TWO
MAP OF PROPERTY TO BE ANNEXED
1. The map attached to this petition is an accurate map of the Property
and contains a written legal description of the Property; the boundary of
the Property; and a drawing of the contiguous boundary of the annexing
Town.
2. A more detailed annexation plat will be submitted at the request of
the Planning Commission.
PETITIONER hereby requests that the governing body of the Town approve
the annexation of the Property proposed to be annexed.
