RE: APPROVE AGREEMENT TO PARTICIPATE IN CONAHRO SECTION 8
OWNER/PARTICIPANT DATA BASE PROGRAM WITH COLORADO NATIONAL
ASSOCIATION OF HOUSING AND REDEVELOPMENT OFFICIALS (CONAHRO) AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has been presented with an Agreement to Participate in CONAHRO
Section 8 Owner/Participant Data Base Program between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Housing Authority, and Colorado National Association of Housing and Redevelopment Officials
(CONAHRO), with terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board, that the Agreement to Participate in
CONAHRO Section 8 Owner/Participant Data Base Program between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld
County Housing Authority, and Colorado National Association of Housing and Redevelopment
Officials (CONAHRO) be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 27th day of December, A.D., 1995.

AGREEMENT TO PARTICIPATE IN CONAHRO SECTION 8 OWNER/PARTICIPANT
DATA BASE PROGRAM
THIS AGREEMENT made and entered into this 15thday of January
199 6 , by and between Colorado National Association of Housing and
Redevelopment Officials (hereinafter referred to as "CONAHRO") and
Weld County Housing Authority (hereinafter referred to as 'participating agency");
WITNESSETH, THAT WHEREAS participating agency desires to retain a portion
of certain Section 8 fraud recoveries from tenants and owners for use in Section 8
programs in accordance with Section 129 of the Housing and Community
Development Act of 1992;
WHEREAS participating agency desires to recover money owed by previous
participants in the Section 8 program or Certificate Program;
WHEREAS participating agency desires to participate in CONAHRO's Section 8
Owner/Participant Data Base Program as a means to trigger Section 8 fraud and
delinquent payment recoveries;
NOW THEREFORE, in consideration of the mutual covenants and obligations
hereinafter set forth, the parties agree as follows:
1. Term. This agreement shall commence on January 15 , 199 6 , and
continue in force until participating agency terminates its membership with
CONAHRO. Additionally, either party may terminate this Agreement by giving the other
ten (10) days written notice.
2. Definitions.
(a) 'debtor" means a Section 8 tenant or owner who has been terminated from
program assistance or has left a program and who has a delinquency with the
participating agency.
(b) "program° means the Section 8 rental certificate, rental voucher and
moderate rehabilitation programs, private owner/housing authority new construction
and substantial rehabilitation projects subject to an Annual Contributions Contract
and public housing programs.
(c) "CONAHRO Data Base" means the CONAHRO Section 8 Owner/Participant
Data Base Program.
3. Duties. (a) Participating agency:
1) Participating agencies may place some or all of the names of their debtors
into this system but to do so they must mail or fax to CONAHRO the following
information: Name of debtor, SSN of debtor, date debt incurred,
date of debtor termination from program, amount of debt and name of CONAHRO

participating agency. Participating agency shall ensure that the debtor has signed a
Privacy Act statement allowing for the release of the above information.
2) Participating agency shall notify CONAHRO of any changes in the amount of
debt owing from a debtor listed in the CONAHRO Data Base via mail or fax within thirty
(30) calendar days of any payments received.
3) Upon being contacted by a debtor who owes money to another participating
agency, participating agency must verify information contained in the CONAHRO Data
Base with the other participating agency.
4) Within thirty (30) calendar days of recovery of any debt owing from a debtor
entered into the CONAHRO Data Base, participating agency shall forward ten percent
(10%) of the amount received by the participating agency to CONAHRO as an
administrative fee.
5) If the participating agency desires to remove a debtor from the CONAHRO
Data Base as the result of a new repayment agreement or other compromise of the
debt, the participating agency shall forward ten percent (10%) of the amount the
participating agency would have received had the debtor paid the entire debt owing.
(b) CONAHRO:
1) CONAHRO shall provide the participating agency an in-state 800 telephone
number and a code number for access to the CONAHRO Data Base.
2) Within five (5) calendar days of receipt of a debtor listing from the
participating agency, CONAHRO will endeavor to enter the listing into the CONAHRO
Data Base.
3) CONAHRO shall maintain a file of all records, documents,
communications and other materials which pertain to the operation, accuracy and
delivery of services under this Agreement.
4) In the event the participating agency fails to pay the ten percent (10%)
administrative fee described above, CONAHRO may bill the participating agency for
this delinquent fee. If the fee is not received within 90 calendar days of recovery of any
debt or a settlement of the debt, the participating agency may be revoked access to
the CONAHRO Data Base until full payment is received.
4. Governing Law. This Agreement shall be interpreted, construed, and governed
according to the laws of the State of Colorado.
5. Integration. This Agreement contains the complete understanding of the parties
and shall be binding upon their respective successors and assigns.
6. Disclosure of Information. The confidential data received pursuant to this
Agreement shall only be used by CONAHRO participating agency employees in the
performance of their housing authority duties regarding the eligibility of, or continued
assistance to, the debtor,

IN WITNESS WHEREOF, participating agency has caused this Agreement to be
signed by its duly authorized agent and CONAHRO has executed this Agreement in
the State of Colorado on the day and year first above written.

SUBJECT: COLORADO NAHRO DATABASE AGREEMEN
DATE: December 4, 1995
As discused at the Housing Authority Work Session of December 4, 1995, Colorado NAHRO has
_developed a database tracking system for Section 8 tenants or landlords who owe money to a
housing authority. Based on HUD regulations, housing authorities may refuse assistance to
applicants who owe money to another housing authority or the housing authority may require that
the applicant pay the claim prior to admittance. Prior to this program,there was no tracking system
in place, so it was very difficult to determine if an applicant owed money to an other housing
authority, unless the applicant told us.
Under terms of the Agreement, should recoveries be collected,the housing authority is required to
share ten per cent of the recovery with Colorado NAHRO. An issue to keep in mind is that this is
money that probably would not have been collected, without the CONAHRO database system.
An 800 telephone number is provided to access the system.
This project is viewed as a model by HUD and other regions throughout the country.
Staff recommendation is to accept the agreement and evaluate the effectiveness after one year.
