A public hearing was conducted on January 22, 1997, at 10:00 a.m., with the following present:
Commissioner George E. Baxter, Chair

Commissioner W. H. Webster

The following business was transacted:
I hereby certify that pursuant to a notice dated January 6, 1997, and duly published January 9,
1997, in the South Weld Sun, a public hearing was conducted to consider the request of ARC
Development, do Doug Coleman,for a Site Specific Development Plan and Minor Subdivision Final
Plat, S #410, for a two-lot subdivision in the 1-3 Zone District. Lee Morrison, Assistant County
Attorney, made this a matter of record. Todd Hodges, Planning Department representative,
presented a brief summary of the proposal and explained, due to the time frame concerning
recorded exemptions, the applicants cannot apply for another for over a year; therefore, they opted
to proceed with this Minor Subdivision Final Plat. He submitted a plat map to the Board for review
and noted the two lots would be 4 and 13.5 acres and addressed the City of Greeley's concerns.
Mr. Hodges then entered the favorable recommendation of the Planning Commission into the
record as written and responded to questions from the Board by indicating a storage structure and
manufacturing structure exist on site. He noted any new uses or structures will require a new Site
Plan Review and the subdivision process will be required for any further splits. Mr. Hodges then
submitted a new proposed drawing, Exhibit B, prepared by the applicant to meet certain Conditions
of Approval, including the realigned access. After further discussion concerning the accesses, Mr.
Hodges confirmed the accesses will be clearly defined on the plat and suggested the following
language for additional Condition of Approval#2.f.: "All reviewed and approved accesses shall be
delineated on the plat." Douglas Coleman represented the applicant and stated the plat was
changed to allow access within the lot, based on the Planning Commission's review. He confirmed
all Conditions of Approval will be met and indicated the City of Greeley authorized hookup of the
second lot to the sewer, with the minor issue being resolved concerning the charge for only one
tap. Mr. Coleman also confirmed his agreement with the addition of Condition of Approval #2.f.
No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to
approve the request of ARC Development, do Doug Coleman, for a Site Specific Development
Plan and Minor Subdivision Final Plat, S #410, for a two-lot subdivision in the 1-3 Zone District,
based on the recommendations of the Planning staff and the Planning Commission, with the
Conditions of Approval as entered into the record, including the addition of Condition of
Approval#2.f. The motion was seconded by Commissioner Webster, and it carried unanimously.
