As we discussed on the telephone today, our Division is of the opinion that supplemental materials are necessary in order to fully describe the proposed operation at Rescar. The submitted materials indicate that the proposed use is a site for "railcar inspections, maintenance, repair, cleaning, dismantling and surface coating, including the storage of railcars..." However, during our site visit of July 25, 1996, the site manager, Jerry Charaska, indicated that hazardous materials will be removed from railcars and temporarily stored during maintenance activities, etc. The original application materials does not describe the kinds of materials which may be brought to the site, or the manner in which the materials will be transferred, processed, or stored. Nor does it describe the facilities will be used for these processes, such as material construction, containment features, etc. In addition, Mr. Charaska indicated that a recirculating or recovery system for remaining products left in railcars, may be installed at the site. The submitted materials do not describe this use. The handling of hazardous materials or wastes on site are important environmental health issues. It is important that the applicant describe these uses and that we are familiar with them before this use is heard in a public setting. If you have any questions, please call me at extension 2232. I spoke with the Assistant Operator and the neighboring property owner at a meeting on the site. The neighboring property owner has a license to utilize Weld County's right-of-way south from the facility to State Highway 52. Site Plan: This facility has existed at this location for many years. The site is totally enclosed by railroad tracks all the way around. Access: The existing access is from the I-76 frontage road, which falls under the jurisdiction of CDOT. Please contact Tess Jones, Greeley office, to verify the access point. The property owner of the adjacent 80 acres has obtained a resolution and a license to utilize Weld County right-of-way where WCR 47 extends north from WCR 52 to the facility. At this particular time the Rescar facility does not have permission or access to utilize this right-of-way south out of their facility. Main Line Railroad Tracks: The applicant has indicated that the tracks that run east and north off the main line are incorporated with the USR section. Please verify if these are main line tracks that are used as an off-loading facility to the adjacent operation to the east. If these are main line tracks, they should be identified on the mylar as such. Storm Water Drainage: The existing storm water detention ponds now exist on the site. These ponds will be utilized for any new construction. The railroad tracks around the facility hold all of the storm water on the site. The storm water is channeled to each detention pond. An increase of traffic volumes as a result of this proposal has not been addressed. If traffic to this access is to increase by more than 20%, the Department would have the warrant to re-evaluate access. Re-evaluation could include the construction of auxiliary lanes if warranted. The County will need to determine if a 20% increase of traffic is to occur. • Our comments are based upon the submittal as received July 1, 1996. Based on our review, we have the following concerns : SOIL EROSION ************ A NRCS representative visited the site on July 23 and found large areas of annual weeds„ some of which had been controlled by tillage operations . While tillage is an effective means of weed control, it leaves the soil susceptible to wind erosion. We recommend that areas not covered by railroad tracks be revegetated using the enclosed grass mix. These grasses are adapted to local conditions, will protect the soil from erosion, and inhibit weed growth once established. New seedings should be protected by a mulch of 4000 lbs . per acre weed-free native grass hay crimped into the soil surface . Weeds will need to be controlled with mowing or herbicides until the grasses are established, usually the first four years after planting. WEED CONTROL ************ There are also patches of Diffuse Knapweed (Centaurea diffusa) located predominantly on the railroad tracks . Diffuse Knapweed is a noxious weed because of its invasive nature and must be controlled in accordance with the Weld County Weed Management Plan. We are including information and photographs of Diffuse Knapweed to aid in identification. In reviewing this application I do not find that this facility intends to file reports with the Weld County Office of Emergency Management(OEM) as required by the Superfund Amendment and Reauthorization Act of 1986 (SARA), Title III. If hazardous materials, above the threshold planning quantity, are stored on site for any period of time,this includes less than 90 days, then an immediate report, per Section 311 is required. A subsequent report is required per Section 312. This application does not indicate in EXHIBIT "B" #20 that the Weld County OEM or Weld County Local Emergency Planning Committee (LEPC) will be allowed to perform hazardous materials inspections as allowed by Federal Regulations. I would request that this facility be required to comply with the appropriate sections of SARA, Title III to include, but not limited too, filing of emergency plans (Section 303), emergency notifications letters and MSDS's on file (Section 311), Spill report procedure (Section 304) and the timely filing of Tier II reports (Section 312). As not all parts could be complied with prior to opening I would only request that each part be complied with on a timely basis as required by Federal Regulations.
