RESOLUTION NO. 96-2
RE: FINDING SUBSTANTIAL COMPLIANCE FOR INITIATING ANNEXATION
PROCEEDINGS FOR THE SAFFELL FIRST AND SECOND ANNEXATIONS
WHEREAS, a written petition, together with four prints of an
annexation map, was heretofore filed with the Town Clerk requesting
the annexation of certain property to be known as the Saffell First
and Second, more particularly described as Situate in the County of
Weld, State of Colorado, to wit :
See attched Exhibit A
Whereas, the Town Board desires to initiate annexation
proceedings in accordance with the law.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF JOHNSTOWN, COLORADO;
Section 1 . That the Town board hereby accepts said annexation
petition, finds and determines that the annexation petition and
accompanying map are in substantial compliance with CRS 31-12-107,
and desire to initiate annextion proceedings in accordance with
law.
Section 2 . The Town Board shall hold a hearing to determine
if the proposed annexation complies with CRS 31-12-104 and 31-12-
105, or such parts thereof as may be required to establish
eligibility for annexation under the terms of part 1, Article 12 ,
Title 31, CRS . A hearing shall be held on the 5th day of February
1996 in the Board meeting room of the Town of Johnstown, 101
Charlotte Street, Johnstown, Colorado, at 7 : 00 P.M.
Section 3 . The Town Clerk shall publish notice of such
hearing once per week for four successive weeks in the Johnstown
Breeze, with the first publication at least thirty (30) days
prior to the date of the hearing. The Town Clerk shall also send a
copy of this resolution and the petition for annexation to the
clerk to the Board of County Commissioners, the County Attorney and
to any special district or school district within the area proposed
to be annexed.

ANNEXATION OF SAFFELL PROPERTY NO . 1 AND NO. 2
Be hereby notified that a petition for annexation has been
filed with the Town Clerk and the Board of Trustees of the Town of
Johnstown, and a public hearing to review this annexation request
will be held on Monday, February 5, 1996 at 7 : 00 p .m. in the Town
Hall . The following is a portion of the legal description:
A tract of land located in the NW4 of the NW4 of Section 11,
the NE4 of the NE4 of Section 10, the SE4 of Section 3 , and the SW4
of the SW4 of Section 2 all in Township 4 North, Range 68 west of
the 6th Principal Meridian, Weld County, Colorado.

PETITION FOR ANNEXATION
The undersigned hereby petition the Town of Johnstown,
Colorado, for the annexation of an area, to be referred to as
Podtburg Annexation to the Town of Johnstown. Said area,
consisting of approximately 35. 81 acres, is more particularly
described as a portion of the Southeast Quarter of the
Southwest Quarter of Section 6, Township 4 North, Range 68
West of the Sixth Principal Meridian, Weld County, Colorado,
more particularly described as follows;
Considering the South line of said Southwest Quarter as
bearing North 80°57 ' 09" West with all bearings contained
herein relative thereto;
Commencing at the South Quarter corner of said Section 6;
Thence North 03°24 ' 57" East along the East line of said
Southwest Quarter a distance of 41 .71 feet to a point on the
North right-of-way line of Colorado State Highway No. 60, said
point being the True Point of Beginning;
Thence North 80°49' 25" West along said North right-of-way line
a distance of 1204 . 88 feet to a point on the West line of the
Southeast Quarter of the Southwest Quarter of said Section 6;
Thence North 01°42 ' 31" East along said West Line a distance of
1283. 66 feet to the Northwest corner of said Southeast Quarter
of the Southwest Quarter;
Thence South 81°05' 00" East along the North line of said
Southeast Quarter of the Southwest Quarter a distance of
1241 . 61 feet to the East line of said Southwest Quarter;

The above described parcel of land contains 1, 560, 018 square
feet or 35. 81 acres more or less .
The petitioners allege:
1 . That it is desirable and necessary that such
area be annexed to the Town of Johnstown.
2 . That the requirements of Section 31-12-104 and
31-12-105, C.R.S. 1973, exist or have been met .
3 . That not less than one-sixth of the perimeter
of the area proposed to be annexed is contiguous
with the boundaries of the Town of Johnstown.
4 . That a community of interest exists between
the proposed to be annexed and the Town of
Johnstown.
5. That the area to be annexed is urban or will
be urbanized in the near future .
6. That the area to be annexed is integrated with
or capable of being integrated with the Town of
Johnstown.
7 . That the petitioners herein comprise more than
fifty percent (50%) of the landowners in the area
and own more than fifty percent (500) of the area
to be annexed, excluding public streets, alleys and
lands owned by the Town of Johnstown.
WHEREFORE, said petitioners request that the Board of
Trustees of the Town of Johnstown approve the annexation of
said area. Furthermore, the petitioners request that said
area be placed in the Developing Low Density Residential
Zoning District (E-1) pursuant to the Zoning Code of the Town
of Johnstown.

PETITION FOR ANNEXATION
SAFFELL ANNEXATION NO. 1
WHEREAS, Robert C. Saffell is owner of certain real property located in an
unincorporated area of Weld County, Colorado, more particularly described in Exhibit "A"
attached hereto and incorporated herein by reference; and
WHEREAS, Owner desires to annex said real property to the Town of Johnstown; and
WHEREAS, the Owners have requested annexation of real property owned by the
Department of Transportation, State of Colorado, comprising a portion of Interstate 25 adjoining
the Town of Johnstown, Weld County, Colorado, more particularly described in Exhibit "B"
attached hereto and incorporated herein by reference, to the Town of Johnstown; and
WHEREAS, the Owners, in accordance with the Department of Transportation's
Procedural Directive No. 1303.1, dated January 1, 1990, entitled "Annexation of Department
Land to City and Town", has submitted to the Regional Transportation Director, Region Four,
Department of Transportation, State of Colorado, a petition package in conformance with the
Municipal Annexation Act of 1965, including the within Petition for Annexation; and
WHEREAS, the Regional Transportation Director, Region Four, Department of
Transportation, State of Colorado, has checked the accuracy of the maps accompanying this
petition and the legal descriptions of the real property proposed to be annexed; and
WHEREAS, the Staff Right-of-Way Manager of the Department of Transportation, State
of Colorado, has reviewed the Petition for Annexation and has determined that annexation of the
proposed real property would not adversely affect any rights of the State of Colorado relative to
the availability of water or sewer services; and
WHEREAS, the Staff Right-of-Way Manager of the Department of Transportation, State
of Colorado, has determined that the proposed area to be annexed includes the full width of the
right-of-way, that the Town of Johnstown has agreed to assume responsibility for traffic law
enforcement within the annexed area, and that there is no special improvement district for which
taxes or special assessments would apply; and
WHEREAS, the Chief Engineer of the Department of Transportation, State of Colorado,
has reviewed the petition package, the recommendations of the Regional Transportation Director
and the Staff Right-of-Way Manager, and being fully advised in the premises has determined that
it is in the best interests of the Department of Transportation, State of Colorado, and the people
of the State of Colorado to execute this Petition for Annexation.
NOW, THEREFORE, the undersigned on behalf of the Owners and the Department of
Transportation, State of Colorado, and in accordance with Article 12, Chapter 31, C.R.S. as

amended, hereby petition the Town Board of the Town of Johnstown, Colorado, for annexation
to the Town of Johnstown the unincorporated real property more particularly described in Exhibit
"C", and in support of said Petition, your petitioners allege that:
1. It is desirable and necessary that the territory described in Exhibit "C" attached
hereto and incorporated herein by reference be annexed to the Town of
Johnstown, Colorado.
2. Not less than one-sixth (1/6) of the perimeter of the area proposed to be annexed
is contiguous with the Town of Johnstown, Colorado.
3. A community of interest exists between the territory proposed to be annexed and
the Town of Johnstown, Colorado.
4. The territory proposed to be annexed is urban or will be urbanized in the near
future.
5. The territory proposed to be annexed is integrated or is capable of being
integrated with the Town of Johnstown.
6. The signatures on the Petition comprise one hundred percent (100%) of the
landowners of the territory to be included in the area proposed to be annexed and
said landowners attesting to the facts and agreeing to the conditions herein
contained will negate the necessity of annexation election.
7. No part of the territory to be annexed is more than three (3) miles from a point on
the municipal boundary, as such was established less than one year from the date
of this Petition.
8. The proposed annexation will not result in the detachment of area from any school
district.
9. The mailing address of each signer, the legal description of the land owned by the
signer as legal representative of the owner, and the date of signing of each
signature are all shown on this Petition.
10. Attached to this Petition as Exhibit "D" and by this reference incorporated herein
is an annexation map containing the information required by Section 31-12-
107(1)(d), C.R.S.
11. The territory to be annexed is not presently a part of any incorporated city, city
and county, or town.
