HomeMy WebLinkAbout981380.tiff HEARING CERTIFICATION DOCKET NO. 98-44 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1189 FOR A RECREATIONAL FACILITY (RODEO ARENA) IN THE A (AGRICULTURAL) ZONE DISTRICT - DAVE AND SHERRY WAREHIME A public hearing was conducted on August 5, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Scott Ballstadt Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 26, 1998, and duly published July 22, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of Dave and Sherry Warehime for a Recreational Facility (rodeo arena) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt gave a brief description of the location of the proposed arena and stated this proposal will not take prime agricultural farm ground out of production. He added the application is consistent with the A (Agricultural) Zone District and surrounding uses and recommended approval. Joe Harris represented the applicant and stated the purpose of this facility is stated in the letter Dave and Sherry Warehime, applicants, submitted, marked Exhibit E. Mr. Harris explained the applicants wish to provide wholesome and productive activities for the youth in the area while training for rodeo events. He stated the cost of events, programs, and awards are paid for through entrance fees and contributions, In response to Commissioner Kirkmeyer, Sheble McConnellogue, Health Department representative, reviewed Exhibit E and explained the reason the Health Department is requiring a permanent septic or vault system is to remain consistent with other Special Review Permits in the County. She stated a Port-o-Pot is not allowed at this type of facility and added that the expense of a vault system is cheaper over a long period of time than annually renting a Port-o-Pot. Ms. McConnellogue spoke with the applicant regarding this matter who stated they have sponsorships which should be able to cover the cost a installing a vault system. In response to Chair Harbert, Ms. McConnellogue stated unlike other cases in the County, this facility could be considered temporary because it is only open for 15 Saturdays from 2:00 p.m. to 5:00 p.m.; however, they open annually. Responding to Commissioner Kirkmeyer, Ms. McConnellogue stated there is not a health concern 981380 PL1261 HEARING CERTIFICATION -WAREHIME (USR #1189) PAGE 2 with a Port-o-Pot on a temporary basis, but reiterated they will open annually and added one stall would be sufficient for the proposed number of people. In response to Chair Harbert, Ms. McConnellogue stated the cost of a vault is based on how big it is and how often it would need to be pumped. Responding to Commissioner Hall, Mr. Harris stated there is no guarantee this facility will be permanent because funding is based on sponsorships and the applicant is not required to continue. Mr, Harris expressed opposition to Development Standard#14 concerning the limit of 75 persons per event. He stated there are currently 70 riders and this amount could easily increase. Ms. McConnellogue clarified this restriction was based solely on what was submitted in the application materials. Mr. Ballstadt stated if more than 75 people are admitted, the Special Review Permit will need to be amended. Chair Harbert suggested allowing a Port-o-Pot if the number of users is limited to 75; however, if the attendance increases a vault system would be required. Ms. Warehime explained this facility began with their grandchildren and grew with the addition of friends and family becoming interested. In response to Commissioner Kirkmeyer, Ms. Warehime stated there could be 85-90 people present if all of the participants come at once. Commissioner Baxter gave a brief explanation of the need for a Special Review Permit and clarified they are required when people not related attend and fees are charged. Marvin Bay, surrounding property owner, stated he lives east of the proposed site and intends to take his grandchildren to ride. He stated the applicants do a good job of coordinating programs. In response to Mr. Bay, Commissioner Kirkmeyer stated these rules were not established to take away the property owner's rights and added they also protect the rights of surrounding property owners. Commissioner Kirkmeyer moved to approve the request of Dave and Sherry Warehime for a Site Specific Development Plan and Special Review Permit #1189 for a Recreational Facility (rodeo arena) in the A(Agricultural)Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record with the deletion of Conditions of Approval #2.A.2 and #3.A and renumbering of all subsequent paragraphs, and changing the first sentence of Development Standard #10 to read as follows: "The rodeo arena shall provide restroom facilities and a Port-a-Pot shall be acceptable."
