Box 129 Frederick, CO 80530 Subject: Chlorine Storage and Injection Well Station Legal: Part NE4 of Section 32, Township 2 North, Range 67 West, of the 6th P.M., Weld County Dear Fire Marshal Puccetti: The Department of Planning Services has re-reviewed the request of Central Weld County Water District to place a concrete and masonry block building for the chlorine storage and injection station facility located at 6547 County Road 17 and permitted through a special use permit, USR-1116. Staff reviewed the facility for compliance with the requirements for the Community Right-to-Know Reporting Requirements as outlined in the Emergency Planning and Community Right-to-Know Act of 1986; (SARA Title III). Staff determined that the facility is in compliance with this statue as the amount of materials to be stored on site is less than 500 pounds of regulated material. Representatives with the Division of Building Inspection visited the site on Friday January 15, 2010 and visually observed and confirmed by discussion with the contractor that the concrete block building is not yet functional and that a single tank will be utilized for the storage of chlorine for the treatment of water in the existing on-site five (5) Million Gallon Water Storage Tank. Given the research for compliance, and the site inspection by departmental staff, it is the position of this office that Central Weld County Water District is in substantial compliance with the existing land use permit (USR-1116). �� 12/7 pL- v8? LEGAL DESCRIPTION: Part of the NE4 of Section 32, T2N, R67W of the 6th P.M., Weld County, Colorado. LOCATION: West of and adjacent to Weld County Road 17, approximately 1/4 mile south of Weld County Road 16. PARCEL NUMBER: 131132000020 The Planning Commission approved with request for the following reasons: The submitted materials are in compliance with the application requirements of Section 25.7.2 of the Weld County Zoning Ordinance, as amended. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 25 and Section 25.8 of the Weld County Zoning Ordinance, as amended, as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies section. This land use proposal lies in the Urban Growth Boundary Area of the Tri-Area Planning Commission. b. This proposal is consistent with the intent of the A (Agricultural) Zone District and is provided for as a Use by Special Review as a Major Facility of Public Utility. C. No overlay districts affect this site. d. Special Review Permit Development Standards will provide adequate protection of the health, safety and welfare of the neighborhood and County. e. The Planning Commission's approval is conditional upon the following: The following items shall be addressed prior to recording the plat as requested in a memorandum from Don Carroll, Project Coordinator, Weld County Public Works Department, dated March 26, 1996: a. The applicant shall utilize the existing access point to the property. This access point shall be shown on the plat. b. The applicant shall show on the plat the typical cross section of the access road into the facility identifying adequate depth and width of gravel to accommodate the facility. C. The existing oil and gas well heads located directly west of the proposed site shall be shown on the plat. Access to these well heads shall also be shown on the plat. d. The existing access and the gravel road on the property need to be upgraded and widened with adequate turning radiuses onto Weld County Road 17 to match the proposed access to the tank. e. Any additional work done within the Weld County right-of-way will require an underground utility permit. 2. The five million gallon water storage tank shall be painted earth tone in color. 3. The plat shall be amended to show the legal description of the subject property as identified in subdivision exemption 586. Description of Facility. Central Weld County Water District is proposing the construction of a ground -level, steel water storage tank to be located next to the District's existing tank site northeast of Dacono. The site contains two existing tanks on the site, one 750,000 gallon and one 150,000 gallon. In addition, the Town of Frederrick has a 300,000 gallon tank located adjacent to the District's site. The proposed tank will be 134-feet in diameter and 48-feet tall with a capacity of 5,000,000 gallons. The tank site is located in the NE'/a of Section 32, Township 2N, Range 67W of the 6�' P.M. approximately '/2 mile north of the intersection of WCR 17 and Colorado Highway 52. B. Alternative Sites. No alternative sites were considered. In order to work with the District's system, the tank must be located at an elevation that can provide adequate pressure to the customers. There are no other sites available in the area. Furthermore, even if there were, a new site would require the constriction of additional transmission lines. C. Mitigation Measures. Since the tank will be constructed next to a site that is already occupied by three existing water tanks, the tank will not have any significant adverse impacts other than those that have already been created by the existing tank. In fact, the tank will have a significant positive impact on the health, safety, and welfare of the District's customers and the citizens of Weld County by improving the reliability of the area water supply. D. Anticipated Work Force. During construction, it is anticipated the work force will include approximately ten people. Once the tank is completed, the only work force associated with the tank will be the periodic inspection trips to the site E. Water Requirements. None, the tank is an integral part of the public water supply of the area. F. Fuel Requirements. None. G. Waste Disposal. There will be no debris, junk, or other wastes associated with the proposed use. Any trash associated with the construction activity will be disposed of prior to final acceptance by the District. 3. Additional Information A. Description of Facility. See Item A of Summary above. B. Alternative Sites. See Item B of Summary above. C. Reasons for Consideration. The District is proposing the construction of this water storage tank to improve service reliability to its customers in the southern portion of the system in the event of equipment or power failure. The tank site provides storage for approximately half of the District's 1 customers, as well as the towns of Firestone, and Frederick. The need for additional storage at this site was identified in the District's Master Plan prepared in 1994. That plan was developed in accordance with the projections contained in the Weld County Comprehensive Plan. The need for additional emergency storage in the District was dramatically illustrated in the spring of 1995 when the transmission line to the south portion of the system was damaged at the St. Vrain river crossing. That problem nearly resulted in an interruption of water service to the customers in the Tri-Town area. In addition, the recent fire at the Carter Lake pumping station will make it impossible for the Northern Colorado Conservancy District to fill that reservoir during the next year. Although the District has emergency connections to the City of Greeley's system and to other District's, those connections cannot supply the total demand of the District during the peak season. However, with the additional storage, the District will have a better chance of supplying the needs of its customers through the peak periods. In view of the potentially serious consequences of an interruption of water service, the District has declared this project an emergency priority. D. Types of Land Use Affected. The proposed tank site is currently used for dry -land farming. The construction of the proposed tank will remove approximately 1.38 acres from agricultural use, and the construction of the tank will not affect the use of the adjacent property. E. Construction Cost of Facility. The estimated construction cost is $650,000 F. Impact on Mineral Resources. Since the tank only occupies 1.38 acres on a site adjacent to three existing tanks, the impact on the mineral resources should be minimal. G. Impact on Wildlife Habitat. Minimal, since the site is already used for other tanks and the adjacent property is currently used for dry -land farming. H. Impacts on Historical, Archaeological, and Scenic Resources. The tank site is not on a known historical or archaeological site nor is it located near a designated scenic resource. I. Visual Impact. The only known impact will be a visual one, however, since an existing tank has occupied this site for over thirty years, the addition of a second tank at this remote site will be minimal. The proposed tank will be about five -feet higher than the existing tank, while the diameter of the proposed tank is 114-feet compared to the existing tanks which are 52 to 58-feet in diameter. There is an existing mobile home located to the south of the Frederick tank and west of the District's existing tanks. The proposed tank will be north of the Frederick tank and will not interfere with the western view of the existing home site. J. Geologic or Flood Hazard. The site is not on a known geologic hazard nor is it located in a flood plain. K. Advantages and Disadvantages of Alternatives. As indicated above, no other alternatives were considered with the possible exception of not constructing the facility. The advantage of the facility is the increased reliability of the water system. L. Description of Preferred Site. See items A. and C. above. M. Mitigation Procedures. Since the only adverse impact identified is visual, the tank will be painted a color to blend with the surrounding area. It is the intention of the District to leave the site in as close to natural condition, after construction, as is possible. No landscaping is proposed other than dry -land grasses. N. Construction & Operation Schedule. The proposed construction schedule allows three (3) months to construct and fill the tank. Assuming a starting time of April, 1996, the tank should be completed by July, 1996. Upon completion, the tank will be in service 24 hrs./day - 365 days/yr. O. Public Meeting Information. None conducted. P. Hazards. The only known hazards are those involving employees during the construction of the tank. They include welding operations, assembly of the tank shell and roof (at heights reaching 48-feet above grade), and painting of the tank. No known hazards to the general public have been identified by the construction of the tank. Q. Emergency Procedure. In the event of a reported failure of the tank, the District should be contacted at 352-1284. The district employees are on -call and can be reached during non -business hours through the answering service at the above number. R. Irrigated Agricultural Land. The site is not located on irrigated agricultural land. S. Conformance With Comprehensive Plan. As indicated above, the need for the tank was identified in the District's Master Plan that was developed in accordance with the growth projections contained in the Comprehensive Plan. The access to the tank from an established county road does not create any additional infrastructure to be maintained by the County. Additional police protection, at a cost to the County taxpayers, would not be necessary as the tank would not attract activities associated with crime. The tank does not, in any way, interfere with air or water quality or create an impact on noise pollution. T. Prevention of Dust, Erosion, and Noxious Weeds. The District conducts spraying operations on its property to control weeds. The condition of the existing site indicates the success of the District's efforts. Erosion is controlled on the site by providing a gravel surface for access of vehicles next to the tank. U. Drainage. The tank site will not require any development of the property, to speak of, and will leave the site in the essentially the same condition after construction. Therefore, no stormwater retention facilities will be proposed. With the exception of the tank itself, the natural imperviousness of the property will not be changed significantly and, therefore, will not generate any noticeable difference in runoff. Access: The existing access and the gravel road need to be upgraded and widened with adequate turning radiuses on to WCR 17 to match the proposed access to the tank. Utility Permit Required: Any additional work done within the Weld County right-of-way will require an underground utility permit.
