RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL AND ACCEPT
REPLACEMENT COLLATERAL -SCOTCH PINES ESTATES MINOR SUBDIVISION,

WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated February 6, 1995, the Board did approve a Site
Specific Development Plan and Minor Subdivision Final Plat in the E (Estate) Zone District for
William H. and Charles W. Jerke, 23003 Weld County Road 39, LaSalle, Colorado 80645,
concerning property described as Part of the SE1/4 NE1/4 of Section 32, Township 5 North,
Range 65 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, pursuant to Condition of Approval #3 of said Resolution and by Resolution
dated April 19, 1995, the Board did approve an Improvements Agreement According to Policy
Regarding Collateral for Improvements (Private Road Maintenance) and accept collateral in the
form of Irrevocable Standby Letter of Credit No. S800599 with the Norwest Bank Colorado, NA,
Letter of Credit Department, 1740 Broadway, One Norwest Center, Denver, Colorado 80274-
8685, in the amount of$47,206.00, and
WHEREAS, on September 10, 1996, Don Carroll, Project Coordinator for the Weld
County Public Works Department, conducted a visual inspection and recommends release of
said collateral, withholding $1,000.00 from the street grading item until all items have been
completed or adequately addressed, and
WHEREAS, upon recommendation of the Department of Planning Services and the
Weld County Public Works Department, the Board deems it advisable to release said letter of
credit and accept replacement collateral in the form of Personal Check No. 6690 from Jerke
Bros., William H. Jerke, Charles W. Jerke, 23003 Weld County Road 39, LaSalle, Colorado
80645-4202, in the amount of$1,000.00.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Irrevocable Standby Letter of Credit No. S800599 with the
Norwest Bank Colorado, NA, Letter of Credit Department, 1740 Broadway, One Norwest
Center, Denver, Colorado 80274-8685, in the amount of$47,206.00, be, and hereby is,
canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby
is, directed to return said letter of credit held as collateral to the appropriate issuing party.
BE IT FURTHER RESOLVED by the Board that the replacement collateral in the form of
Personal Check No. 6690 from Jerke Bros., William H. Jerke, Charles W. Jerke, 23003 Weld
County Road 39, LaSalle, Colorado 80645-4202, in the amount of$1,000.00, be, and hereby is,
accepted.

SUBJECT: AM S-363, Scotch Pines Estates--Request for release of
collateral
Mr. William H. Jerke is requesting a release of collateral for improvements completed in Scotch
Pines Estates, a six lot minor subdivision located in part of the SE4 NE4 of Section 32, T5N,
R65W, Weld County, Colorado. The form and amount of collateral being held by Weld County
is a letter of credit for$47,206.00.
All improvements have been completed within the subdivision. As the street improvements
were completed more than one year ago, Mr. Jerke is requesting that Weld County not retain
ten (10) per cent warranty collateral as required in Section 9.8 of the Improvements Agreement
but, instead, release the entire collateral amount at this time.
The Public Works Department has reinspected the site and is recommending that $1,000.00 be
withheld until several items have been resolved (see memo dated September 20, 1996). Mr.
Jerke is willing to post the $1,000.00 requested, upon release of the letter of credit.
Staff requests that the Board authorize release of the $47,206.00 letter of credit and accept Mr.
Jerke's replacement collateral of 1,000.00 cash to be held by Weld County until such time that
all road work is completed.

To Whom It May Concern;
This letter represents a formal request to release collateral for the entire project
known as "Scotch Pine Estates Minor Subdivision". Please find enclosed,
supporting documentation as required by the County for the release of collateral.
It was found that this project was constructed in substantial compliance with
approved plans and specifications as submitted to the Weld County Planning
Department. I would like to remind you that the interior road as constructed for
this minor subdivision shall be owned and maintained by the Homeowners
Association.

roadway be widened in the area of the fire hydrant in order for our fire trucks
to be able to hook to the hydrant. This letter is to inform you that the
widening of the roadway has been completed in the area of the fire hydrant.

Subject: Notification that the Greeley Gas Company has installed a natural
gas math extenson to the Scotch Pines Subdivision in LaSalle.
County Planners:
A signed main extension contract and a deposit of$3,074.00 from
the Jerke brothers allowed the Greeley Gas Company to provide natural gas
to the six lots of the Scotch Pine Subdivision on January 15, 1996.

Each of the parties agree that the main extension shall belong to Greeley Gas
as the sole and absolute owner thereof, and the expense of maintenance and
operation shall be borne by Greeley Gas.

Subject: Request for Release of Collateral for Scotch Pines Estates Minor
At the request of the Planning Services Department, I reinspected the Scotch Pine Estates
Subdivision on September 10, 1996. The purpose of the reinspection was to verify the items
identified on Exhibit A from the Improvements Agreement.
The items verified were street grading, street base, street name signs, stop signs,and the fire hydrant
unit consisting of 4" standard pipe fire line.
The items that need to be addressed and resolved prior to releasing collateral are as follows:
a. There are four utility crossings that need to be compacted and the gravel brought back to
grade.
b. The entire road needs to be regraded. The weeds have grown in the road and shoulder areas
and need to be cut to a more manageable height.
c. The stop sign and street sign on Scotch Pine and WCR 41 need to be reset. Both have been
pushed over.
d. There is a low area that collects water at the intersection of Scotch Pine and WCR 50.5. It
needs additional gravel material to resolve the problem of standing water.
I would like to withhold$1000 from the street grading item until all items have been completed or
adequately addressed.
