RE: APPROVE INTRA-GOVERNMENTAL AGREEMENT AND AUTHORIZE CHAIR TO
SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intra-Governmental Agreement
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Social Services, and Human
Services Family Educational Network of Weld County, commencing August 1, 1996, and ending
July 31, 1997, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, ex-officio Board of Social Services, that the Intra-Governmental
Agreement between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Social Services, and
Human Services Family Educational Network of Weld County, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 7th day of August, A.D., 1996.

INTRA-GOVERNMENTAL AGREEMENT
BETWEEN THE WELD COUNTY DEPARTMENT OF SOCIAL SERVICES AND
WELD COUNTY DIVISION OF HUMAN SERVICES

This Agreement, made and entered into this WA day ofJ 1996, by and between the Weld
County Department of Social Services, hereinafter referred to as "Social Services," and the Weld
County Division of Human Services, on behalf of the Family Educational Network of Weld
County, hereinafter referred to as "FENWC."
WHEREAS, the State of Colorado created the Family Issues Cash Fund to fund staff and
programs for adherence to the Child Welfare Settlement Agreement; and
WHEREAS,the State of Colorado received a Family Preservation/Family Support Grant
to assist families through a Family Advocate Program; and
WHEREAS, Social Services received funding and authority from the State of Colorado
to provide services under the Family Issues Cash Fund and the Family Preservation/Family
Support Program; and
WHEREAS, FENWC owns the modular known as FENWC Dos Rios Center located at
2201 34 Street, Greeley, Colorado, and the modular known as the FENWC Frederick Center at
340 Maple, Frederick, Colorado; and
WHEREAS, Social Services desires to lease one room at the FENWC Dios Rios Center
and to lease one room at the FENWC Frederick Center,
NOW THEREFORE, in consideration of the premises and of the covenants and
agreements contained herein, the parties hereto covenant and agree as follows:
1. This Agreement shall remain in effect indefinitely and is subject to the availability of
funding as determined by Social Services. The Agreement will be reviewed annually or
as otherwise needed by either party and is subject to the provisions of paragraph 15
herein.
The term for funding by Social Services to FENWC shall be for a period beginning
August 1, 1996, and ending July 31, 1997.
2. Social Services shall have access to a leased room and playground at FENWC Dos Rios
and Frederick centers as described above and agree to by FENWC as follows:
a. For the period beginning August 1, 1996 through July 31, 1997, between the
hours of 7:30 a.m. to 6:00 p.m., during the week from Monday through Sunday,
as scheduled with FENWC.

Social Services agrees to rent the Dos Rios and Frederick building space from FENWC in
the amount of$600.00 per month for full access of the space, payable the 1st of each
month for each building. The amount covers the prorated cost of rent, utilities, and
custodial services, a or $300.00 per month for each facility.
4. FENWC agrees to submit a bill for the rental of the one room at each facility, the
FENWC Dos Rios and Frederick centers, to the Weld County Department of Social
Services, P.O. Box A, Greeley, Colorado, 80631, by the 10th of the month for services
provided during the preceding month.
5. FENWC shall provide janitorial services for the leased space.
6. Social Services agrees that FENWC administrative staff at the Dos Rios and Frederick
buildings may maintain an office area in each room for file storage and parent interaction.
7. Social Services agrees to provide its own equipment, resource library, and furniture for
Social Services programs and for the use of Head Start parents who are supervised by
FENWC and as arranged with Social Services. This equipment, resource, library, and
furniture shall remain the property of Social Services.
8. Social Services agrees to pay for all damages by Social Services that is not considered
normal wear and tear.
9. FENWC shall be responsible for all repairs to the exterior and interior of the building,
including, but not limited to, any repairs to sewers, heating units, appliances, wiring,
plumbing, facilities, doors, windows, door locks, etc., unless caused by negligence on the
part of Social Services.
10. FENWC shall provide reasonable security of Social Services' equipment, resource
library, and furniture to avoid theft at the FENWC Dos Rios and Frederick School.
FENWC shall not be held liable for any loss of or damage of Social Services' equipment,
furniture, or resource library placed on the premises.
11. FENWC shall provide trash removal services at the FENWC Dos Rios and Frederick
School.
12. FENWC and Social Services understand that the parties are covered by Weld County
liability insurance.
13. If any section, subsection, paragraph, sentence, clause, or phrase of this Agreement is for
any reason held or decided to be unconstitutional, such decision shall not affect the
validity of the remaining portions. The parties hereto declare that they would have
entered into this Agreement and each and every section, subsections, paragraph, sentence,
clause, and thereof irrespective of the fact that any one or more sections,paragraphs,
sentences, clauses, or phrases might be declared to be unconstitutional or invalid.

14. This Agreement constitutes the entire understanding between the parties hereto with
respect to the subject matter hereof, and may not be changed or modified except as stated
in Paragraph 15 herein.
15. This Agreement may be amended or terminated upon thirty days written notice given to
either party. This Agreement shall be terminated immediately upon the loss of funding to
the FENWC or Social Services.
IN WITNESS WHEREOF, the parties hereto have executed this Intra-Agency
Agreement on the day, month, and year first above written.

DATE: July 31, 1996
SUBJECT: Intra-Governmental Agreement between the Weld County Department of
Social Services and the Weld County Division of Human Services.
Enclosed for Board approval is an intra-governmental agreement between the Weld County
Department of Social Services and the Weld County Division of Human Services.
The major provisions of the Agreement are as follows:
1. The term of the Agreement is August 1, 1996 through July 31, 1997.
2. The purpose of the Agreement is to lease space at the Family Educational Network of Weld
County (FENWC) Dos Rios Center and the FENWC Frederick Center. The space will be
used for Family Advocate Program, foster parents, and families obtaining services through
the Child Protection Division of Social Services.
3. Sources of funds are the Family Issues Cash Fund and the Family Preservation/Family
Support Program, which are 100%Federal funds.
