RE: ACTION OF THE BOARD CONCERNING PETITION TO ANNEX PORTIONS OF CHERRY
AVENUE AND EAST 20TH STREET TO THE CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Petition to the City of Greeley for
Annexation of certain portions of Cherry Avenue and East 20th Street, being more particularly
described in said petition, to the City of Greeley, Colorado, and
WHEREAS, after review,the Board deems it advisable to deny the request to sign a petition
to the City of Greeley for the annexation of portions of Cherry Avenue and East 20th Street, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Petition to the City of Greeley for Annexation of certain portions of
Cherry Avenue and East 20th Street, being more particularly described in said petition, to the City
of Greeley, Colorado, be, and hereby is, denied.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said petition.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 13th day of October, A.D., 1999.

PETITION FOR ANNEXATION
ANNEXATION
TO THE HONORABLE MAYOR AND CITY COUNCIL OF THE CITY OF
GREELEY, COLORADO:
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. seq.,
Colorado Revised Statutes, 1973, as amended, hereby petition the City Council of the
City of Greeley :For annexation to the City of Greeley of the territory described herein
and described and shown on the map designated, "
Annexation." Four (4) copies of said map are submitted herewith and by this reference
are incorporated herein. The description of the territory hereby petitioned for annexation
to the City of Greeley is set forth in Exhibit A attached hereto and incorporated herein
by reference.
In support of this petition, the Petitioner(s) allege(s) that:
1. It is desirable and necessary that the above-described territory be annexed to the
City of Greeley.
2. The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised
Statutes exist or have been met in that:
A. Not less than one-sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the City of Greeley.
B. A community of interest exists between the territory proposed to be annexed
and the City of Greeley. `
C. The territory sought to be annexed is urban or will be urbanized in the near
future.
D. The territory sought to be annexed is integrated or is capable of being
integrated with the City of Greeley.
3. In establishing the boundaries of the territory proposed to be annexed, no land
held in identical ownership, whether consisting of one tract or parcel of real estate
or two or more contiguous tracts or parcels of real estate, has/have been divided
into separate parts or parcels of real estate without the written consent of the land
owner or land owners thereof, except and unless where such tracts or parcels are
already separated by a dedicated street, road, or other public way.
4. In establishing the boundaries of the territory proposed to be annexed, no land
held in identical ownership, whether consisting of one tract or parcel of real estate
or two or more contiguous tracts or parcels of real estate comprising twenty (20)
acres or more which, together with the buildings and improvements situated thereon
have an assessed valuation in excess of $200,000 for ad valorem tax purposes for
the year next preceding the filing of the written petition for annexation,
has/have been included within the territory proposed to be annexed without the
written consent of the land owner or land owners.
5. The territory proposed to be annexed does not include any area which is the same
or substantially the same area in which an election for an annexation to the City of
Greeley was, held within the twelve months preceding the filing of this petition.
6. The territory proposed to be annexed does not include any area included in another
annexation proceeding involving a city other than the City of Greeley.
7. The territory proposed to be annexed is not presently a part of any incorporated
city, city and county, or town.
8 The property owned by each petitioner is described on each separate signature
sheet and, when needed, described more fully in the exhibits attached hereto and
incorporated herein by reference.
9. The signer(s) of this petition comprise(s) more than fifty percent (50%) of the land
owners and owning more than fifty percent(50%)of the property, excluding public
streets and alleys, and any land owned by the annexing municipality, and are, in
fact, owners of one hundred percent (100%) of the property set forth in Exhibit A
•
attached hereto and incorporated herein by reference.
Accompanying this petition are the original and four copies of an annexation plat
map containing the following information:
A. A written legal description of the boundaries of the area proposed to be
annexed.
B. A map showing the boundary of the area proposed to be annexed.
C. Within the annexation boundary map, an identification of the location of each
ownership tract in unplatted land and, if part or all of the area is platted, the
boundaries and the plat numbers of plots or of
districts and bltho area proposedks. Also within

10. Except as otherwise provided, no part of the territory sought to be annexed is more
than three miles from a point on the municipal boundary, as such was established
more than one year before this annexation will become effective.
11. As an expressed condition of annexation, land owner(s) consent(s) to inclusion into
the Northern Colorado Water Conservancy District and the municipal subdistrict
pursuant to Section 37-45-136 (3.6) C.R.S. Land owner(s) acknowledge(s) that,
upon inclusion into the district and subdistrict, land owner's(s') property will be
subject to the same mill levies and special assessments as are levied or will be
levied on other similarly situated property in the district and subdistrict at the time
of inclusion of land owner's(s') lands. Land owner(s) agree(s) to waive any right
to an election which may exist to require an election pursuant to Article X, Section
20, of the Colorado Constitution before the district and subdistrict can •imp such
mill levies and special assessments as it has the authority to impose. Land owner(s)
also agree(s) to waive, upon inclusion, any right which may exist to a refund
pursuant to Article X, Section 20, of the Colorado Constitution.

A public meeting will be held in the Chambers of the Board of County Commissioners of
Weld County, Colorado, Weld County Centennial Center, 915 10th Street, First Floor, Greeley,
Colorado, during its regular Board meeting to consider whether or not the Board of County
Commissioners of Weld County, Colorado should petition the City of Greeley for the annexation
of certain Weld County Roads to the City of Greeley, in accordance with Section 31-12-107,
C.R.S. The Board has been requested to consider such a petition in order to provide contiguity
so that a property known as the Vetting property may be proposed for annexation to and
development within the City of Greeley.

Brief description of the problem/issue:
Sundance Development Annexation
James Rawson of Sun Dance Development, along with the owners, the Vettings, have a piece of property
described as Lots 1-8 of the Northeast quarter of the Northwest quarter of Section 15,Township 5 North,Range
65 West, of the 6,h P.M., Weld County, Colorado, are proposing to annex to the City of Greeley for residential
and commercial purposes along the Highway 34 and East 20`h Street Frontage. The property is somewhat
removed from the city limits of the City of Greeley and a flag pole annexation will be required to annex the
property. The pole would have to include Cherry and East 20' Street as generally shown on the attached map
and materials submitted by the developer.
The City of Greeley has taken a position that they will not entertain an annexation which relies on the county road
right-of-way as part of the flag pole without the county being a party to the annexation petition. This ruling is
limited to the circumstances where the requirements of contiguity cause the surveyor to have to create multiple
segments in the road righ-of-way which are annexed serially to achieve contiguity using the flag pole method.
This holding would not affect a case where each segment contains both a portion of the road and a portion of the
target property. (See graphic representation- Appendix A)
It is not clear whether some creative surveying would enable the developers to avoid asking the County to sign
an annexation petition. They have asked the Board to be a petitioner,given the possibility that contiguity cannot
be achieved or will be excessively expensive. They specifically ask that the Board consider taking a formal
action preliminary to actually signing the petition in order that the developer not expand the cost of engineering
and surveying without knowing if the Board will sign a petition.
Public Works has general knowledge regarding this but has not given a specific opinion on this issue. It would
probably be most appropriate to have a Work Session on this so that various departments can prepare and present
their views on this issue.

Lee;
I appreciate the opportunity to work with the Weld County Public Works and
Planning Departments and you to successfully annex the Vetting Property by
means of annexing Cherry Avenue between 20th and 24th Streets and 20th Street
between Cherry Avenue and U.S. Highway 34. I have enclosed an area map for
your reference.
As outlined in the Deputy City Attorney's letter dated June 24, 1999, (copy
attached) the annexation of Cherry Avenue and 20th Street will require a series of
sequential annexations to comply with contiguity requirements. Further, "the
County has legal title to these roadways and, as such, the County must petition
the City of Greeley in consecutive petitions in order to obtain the ultimate
necessary contiguity for the Vetting property. This process will require the
County to sign annexation petitions for each segment of the roadway which have
one-sixth contiguity to the City of Greeley." The preparation of the annexation
maps and petitions for the roadways (highlighted in blue) will require that the
Owner/Developer retain a Professional Engineer to calculate and complete these
necessary documents, which may be a fairly expensive endeavor. Concurrent
with the annexation of the roadways, we are prepared to petition the City of
Greeley for the annexation of the Vetting property, (highlighted in green)
consisting of approximately one hundred (100) acres, also at our expense.
Therefor, in the interest of determining the County's level of willingness to annex
the roadways to enable the annexation of the Vetting property prior to the
expenditure of substantial engineering fees, we are requesting that this issue be
placed upon the County Commissioners meeting agenda at the earliest

This correspondence is written on behalf of James Rawson who is attempting development of the
Vetting property Mr Rawson is intending to annex the Vetting property to the City of Greeley
This correspondence is sent to outline the City's position regarding annexation requirements to
the City of Greeley as far as the issues regarding contiguity
Section 31-12-: 04(8)(1)(a) states that any property to be annexed to municipality must have one-
sixth of the perimeter to be contiguous with the annexing municipality Reviewing the plat of the
Vetting property, it is clear that there is no contiguity with the City of Greeley and the Vetting
property at this time
Contiguity may only be obtained by annexation of Cherry Avenue from its intersection with 24'h
Street. The Southwest corner of the intersection of Cherry Avenue and 24th Street is within the
municipal boundaries of Greeley Review of the Vetting property plat shows that annexation of
the Vetting property may only occur upon annexation of Cherry Avenue and east 20"' Street, in
order for the Vetting property to obtain the one-sixth contiguity requirement
Because the or.e-sixth contiguity requirement is mandatory, it is the opinion of this office that
Cherry Avenue must be annexed to the City sequentially, that is, segments of Cherry Avenue must
be sequentially annexed because each annexation must have one-sixth contiguity to the
municipality The only contiguity with the City of Greeley and Cherry Avenue at this time is the
intersection of 24"' and Cherry Therefore, the only contiguity at this time is the width of Cherry
Avenue at 24"' Street. This width is the one-sixth contiguity requirement

RE:Request for Scoping Session
Dear Tom:
I would like to request a scoping session to discuss the future development of a property consisting of
approximately 91 acres located at the southwest corner of East 20th Street and Highway 34. It would
be our intent to annex,zone and develop the parcel,mostly for residential utilization under Rd.,zoning
to produce single family homesites to be marketed to residential builders. We would also like to
discuss zoning 10-20 acres to accommodate service oriented commercial users along the Highway 34
and East 20th Street frontage. The property is legally described as; Lots I-8 of the NE/4 of the
NW/4,Section 1.5,TSN,R65W,County of Weld.
During the scoping session I would like to address the following issues as they pertain to the subject
property:
I. Annexation of the Property.
2. Zoning of the Property.
3. Subdivision of the property.
4. Acceptability of direct access to 20'h Street and Highway 34 from homesites and
commercial parcels facing these roadways.
5. Location and availability of City of Greeley water and sewer.
6. Scorn sewer treatment/retention/detention.
7. Water dedication requirements.

As such, annexations must occur sequentially regarding segments of Cherry Avenue and east 20th
Street, always maintaining that each segment has one-sixth contiguity with the City of Greeley
This office interprets the holding of the Board of County Commissioners, Jefferson County v City
of Lakewood, 813 P 2d 793 (Colo. App. 1991), as requiring the road to be annexed in segments
in order to obtain legal annexation of the Vetting property. The holding in the above case states
that "When a platted street and connecting private parcel of property were contemporary
annexed, perimeter of street was required to be included in determining one-sixth of the area to be
annexed was contiguous with the annexing municipality." Because the perimeter of the road is
required to be taken into account regarding the one-sixth contiguity and because, in this case, only
the road has contiguity at this point; individual segments of the road which have one-sixth
contiguity with the municipality may only be annexed at any one time.
It is this office's inderstanding that the County has legal title to these roadways and, as such, the
County must petition the City of Greeley in consecutive petitions in order to obtain the ultimate
necessary contiguity for the Vetting property. This process will require the County to sign
annexation petitions for each segment of the roadway which have one-sixth contiguity to the City
of Greeley. This may be heard in one annexation hearing; however, each annexation petition must
in and of itself have one-sixth contiguity with the City
Regardless of the ability to obtain one-sixth contiguity for the Vetting property through the
above-stated process, please be advised that the property is outside the City's mid-range
expectancy service area Thus, the legal requirement of one-sixth contiguity does not ensure or
require the City of Greeley to accept annexation of the property The City of Greeley reserves all
of its rights in accordance with state and local law regarding its discretion for annexation of
properties to the City of Greeley

Dear Commissioners;
We the undersigned oppose the annexation of the right of way
of Cherry Avenue between East 20th Street and East 24th
Street and East 20th Street from Cherry Avenue and Highway
34. We are adverse to this because of the affect it will
have on our home life. The roads involved are narrow and
were made to accommodate "country" traffic. Our concerns
involve the questions of what will happen to our irrigation
ditches which we rely on for crops , and who will maintain and
provide snow removal on these roads . We are also concerned
that this annexation will bring extra traffic to the area .
Then we will have the added question of the safety of our
children as they walk these roads to and from their school
bus stops .
Very few of the residents of this area received the
notice regarding the proposed annex. This makes us wonder
as to what else can or will take place that we will not be
made aware of before it happens. If the information we have
is correct , the plan is to petition the city to allow low
priced housing or industry on some land where the county will
not allow it . We object to this type of zoning in our
neighborhood .
We ask that you reconsider this proposal and vote no .
