HomeMy WebLinkAbout950476.tiff RESOLUTION RE: APPROVE REPLAT OF LOTS 12 THROUGH 26, HUDSON LAND COMPANY SUBDIVISION (FOX HAVEN ESTATES) - CHARLES AND VICKY WACKER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 21st day of December, 1994, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Charles and Vicky Wacker, 251 Weld County Road 39, Brighton, Colorado 80601, for a Replat of Lots 12 through 26, Hudson Land Company Subdivision (Fox Haven Estates) on the following described real estate, to-wit: Lots 12 through 26, Hudson Land Company Subdivision, located in Section 31, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, Pam Eastin represented said applicant, and WHEREAS, Section 8.3.2.4 of the Weld County Subdivision Ordinance provides standards for review of said replat, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 7.3.3.1 of the Weld County Subdivision Ordinance. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 8.3.2.4 of the Weld County Subdivision Ordinance including specifically: a. That the request complies with the approved final plat. b. That the request complies with all of the rules, regulations, and resolutions adopted by the Board and which currently are in force and affect the subdivision. 950476 SUBD �� ; /)G) li✓iGKer REPLAT -WACKER PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Charles and Vicky Wacker for a Replat on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. Prior to recording the plat: a. The plat shall be amended to include a note limiting the usage of the wells as stated in the letter from the Division of Water Resources, dated November 23, 1994. b. The plat shall have a Colorado Certified Engineer's stamp certifying that the drainage for the site is adequate. BE IT FURTHER RESOLVED by the Board that the applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 7.2.6 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty days from the date of approval by the Board of County Commissioners. The applicant shall be responsible for paying the recording fees. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of March, A.D., 1995.
