HomeMy WebLinkAbout950074.tiff RESOLUTION RE: DELEGATION OF AUTHORITY TO CHAIRMAN TO APPROVE AND SIGN ALL OIL AND GAS DIVISION ORDERS AND AUTHORIZATIONS TO RECEIVE OIL OR GAS PAYMENT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County, Colorado, by and through the Board of County Commissioners, leases various mineral interests owned by the County to private companies for the purpose of oil and/or gas production, and WHEREAS, pursuant to said leases, the Board periodically receives Oil and Gas Division Orders and Authorizations to Receive Oil or Gas Payment from the lessees for the purposes of deriving royalty interest confirmation and authorization to receive payment, and WHEREAS,to date, the Board has considered all such Division Orders and Authorizations at regular meetings of the Board, and, if approved, the Chairman has been directed to sign the same, and WHEREAS, all such Division Orders and Authorizations are reviewed by the County Attorney's Office for correctness of ownership interest, form, and legal description before being considered by the Board, and the Board's approval is solely dependent upon such review, and WHEREAS,the Board's authority to approve such Division Orders and Authorizations may, therefore, be delegated by resolution to the Chairman, because it is a ministerial act performed in the normal course of the Board's business, and WHEREAS,the Board now desires to delegate the authority to approve and sign all Oil and Gas Division Orders and Authorizations to Receive Oil or Gas Payment to the Chairman in order to expedite the processing of said forms. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the authority to approve and sign all Oil and Gas Division Orders and Authorizations to Receive Oil or Gas Payment is hereby delegated to the Chairman, upon the condition that prior to said approval and signature by the Chairman , said forms shall have been reviewed for correctness as to ownership interest, form, and legal description by the County Attorney's Office.
