The meeting was called to order by the Chairman, Richard Kimmel. Judy Yamaguchi arrived at 1:35 p.m. CASE NUMBER: USR-1062 APPLICANT: Weld County REQUEST: A Site Specific Development Plan and a Special Review permit for a motor grader and household hazardous waste collection facility in the A (Agricultural) zone district. LEGAL DESCRIPTION: Part of the NE4 of Section 1, T1N, R68W of the 6th P.M., Weld County, Colorado. LOCATION: Adjacent to the Town of Frederick on the south side of State Highway 52; approximately 1/2 mile west of Weld County Road 13. Pat Persichino, gave an overview of the application. He stated his dislike of the term "hazardous" in conjunction with this facility. Discussion followed regarding the type of waste this facility would collect and recycle, eg. used motor oil, paint, etc. Pat explained codes for the type of interior wall that will be used to separate the collection portion of the facility from the motor grader. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Marie Koolstra moved Case Number USR-1062 be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. Judy Yamaguchi was inadvertently omitted from the vote. Motion carried. CASE NUMBER: USR-1074 APPLICANT: Larry, Stacy, and Kerri Ditter REQUEST: A Site Specific Development Plan and a Special Review permit for an excavation business in the A (Agricultural) zone district. LEGAL DESCRIPTION: A portion of the NE4 NE4 of Section 23, T6N, R66W of the 6th P.M., Weld County, Colorado. LOCATION: South of and adjacent to U.S. Highway 392; west of and adjacent to Weld County Road 35. Stacy Ditter, applicant, explained the need for parking of work trucks on their property overnight. Discussion of the type and number of vehicles followed. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. A surrounding property owner who resides in the Subdivision of Pinnacle Peak was concemed that the number of vehicles allowed on the property would increase. Stacy assured him that he need not be concerned. Moved by Bud Clemons that Case Number USR-1074, be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval with changes to Development Standards #1 and 16, as follows: 1. The Site Specific Development Plan and Special Review permit is for an excavation business located in the A (Agricultural) zone district and shall include no more than 9 pieces of excavation equipment. 16. The Special Review permit shall not be transferable, any lease or conveyance of the property shall terminate the Special Review permit. Judy Yamaguchi seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision: Ron Sommer - yes; Judy Yamaguchi - yes; Curt Moore - yes; Jack Epple - yes; Marie Koolstra - yes; Shirley Camenisch - yes; Bud Clemons - yes; Daniel Lere - yes; Richard Kimmel - yes. REQUEST: A Change of Zone from A (Agricultural) to C-3 (Commercial). LEGAL DESCRIPTION: Lot A of RE-1521, in part of the SW4 SE4 of Section 21, T8N, R62W of the 6th P.M., Weld County, Colorado. LOCATION: North of and adjacent to State Highway 14; approximately 1/2 mile east of Weld County Road 77. The Agland, Inc., representative explained they were not changing the use on the property, but the change of zone would create less problems for the type of operation currently taking place. The Chairman asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. Ron Sommer moved Case Number Z-492, be forwarded to the Board of County Commissioners with the Planning Commission's recommendation for approval. Judy Yamaguchi seconded the motion. The Chairman asked the secretary to poll the members of the Planning Commission for their decision.
