RE: CHANGE OF ZONE #495 FROM C-3 (COMMERCIAL) TO PUD (PLANNED UNIT
DEVELOPMENT) FOR C-3 (COMMERCIAL) USES - QUINLAN CONSTRUCTION, INC.
A public hearing was conducted on July 12, 1995, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated June 19, 1995, and duly published June 22, 1995,
in the Windsor Beacon, a public hearing was conducted to consider the request of Quinlan
Construction, Inc., for a Change of Zone from C-3 (Commercial) to PUD (Planned Unit
Development) for C-3 (Commercial) uses. Lee Morrison, Assistant County Attorney, made this a
matter of record. Gloria Dunn, Planning Department representative, presented a brief summary
of the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. She noted Flatiron Structures is the property owner and read recommended
language for the addition of Condition of Approval #3d to address the right-of-way issue with the
Colorado Department of Transportation (COOT). Ms. Dunn answered questions from the Board
concerning referrals, which are addressed in the Conditions of Approval and Development
Standards. She clarified the purpose of the Change of Zone is to allow the applicant to proceed
with the PUD process for four commercial uses on six acres. Gary Shaw, Vice President of
Quinlan Construction, Inc., representing Flatiron, stated headquarters were completed on site
about seven months ago and they would like to build three more structures, being 15,000 square
feet each, maximum. He noted covenants will keep standards high and enhance the area. Mr.
Shaw explained CDOT reviewed the site plan for the existing structure and then requested the
right-of-way reservation be increased from 35 feet to 72 feet, noting the 1-25 realignment is planned
for the year 2015. Mr. Shaw confirmed he is working with CDOT and intends to proceed with the
PUD. Ms. Dunn again read the proposed language for Condition of Approval #3d, which requires
the future right-of-way location of the 1-25 Frontage Road be approved by CDOT and be shown on
the PUD Plan plat. Mr. Morrison clarified if the applicant is not able to reach an agreement with
CDOT, then the matter can be brought back to the Board for an amendment to the Change of Zone
and/or removal of the Condition of Approval. The Board concurred with Mr. Morrison's suggestion
to leave the matter open for negotiation between CDOT and the applicant. Mr. Shaw confirmed
he is trying to reach an agreement with CDOT and agreed with the Board's decision.
Commissioner Kirkmeyer commented on the plans for 1-25 and various CDOT meetings. Mr. Shaw
confirmed he had attended said meetings and reviewed drawings concerning the overpass project
which is definite; however, he noted the plans for the year 2015 are still sketchy. Mr. Shaw
confirmed for Commissioner Baxter the applicant's building was already approved by CDOT and
built before CDOT requested the additional right-of-way. No public testimony was offered
concerning this matter. Commissioner Kirkmeyer moved to approve the request of Quinlan
Construction, Inc., for a Change of Zone from C-3 (Commercial) to PUD (Planned Unit
Development)for C-3 (Commercial) uses, based on the recommendations of the Planning staff and
the Planning Commission, with the Conditions of Approval as entered into the record and the
addition of Condition of Approval #3d. The motion was seconded by Commissioner Baxter, and
it carried unanimously.
