A regular meeting of the Weld County Planning Commission was held January 5, 1995,in the Ept\nty Commissioners
Hearing Room(Room#101),Weld County Centennial Building,915 Tenth Street,Greeley;Colorado. The meeting
was called to order by the Chairman,Richard Kimmel,at 1:35 p.m.

REQUEST: Substantial Change Hearing
LEGAL DESCRIPTION: Part of the SW4 NW4 of Section 12,TIN,R66W of the 6th P.M.,Weld County,Colorado.
LOCATION: Approximately 3/4 miles south of Weld County Road 12 and approximately 3/4 miles west of Weld
County Road 37.
Todd Hodges explained staff has received a letter requesting this case be continued until February 17, 1995. Bud
Clemons moved Case Number SCH-13,Martin Brothers Partnership be continued until February 17, 1995. Judy
Yamaguchi seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron Sommer-

CASE NUMBER: USR-1067
APPLICANT: H.S.Resources,Inc.(Continued from December 6, 1994).
REQUEST: Site Specific Development Plan and a Special Review permit for a Land Treatment Facility in the A
(Agricultural)zone district.
LEGAL DESCRIPTION: The SE4 of Section 13,T3N,R66W of the 6th P.M.,Weld County,Colorado.
LOCATION: Approximately 1/2 mile east of Weld County Road 35 and north of and adjacent to Weld County
Road 32.
Patrick Flynn,Environmental Affairs Manager,H.S.Resources,explained the proposal to operate a centralized,
noncommercial land treatment facility for non hazardous oil and gas waste. H.S.Resources is an independent oil and
gas operator who has operated in Weld County since the mid 1980's,also known as Elk Exploration. This facility
would treat oil stained soil and frac sand collected from well sites scattered throughout the County. It is a recycling
process where the hydro-carbons would be removed from the sand and soil through a biological treatment and then
reuse this material as building material(berms,etc.)at facilities throughout the County. The Commission members
had concerns regarding groundwater contamination and after further discussion and explanation their concerns were
addressed. The applicant did not agree with the development standard that addressed a form of permanent septic

disposal on-site. He said there would be no personnel employed at the site. Trevor Jiricek explained the Health
Department requirement addresses an"adequate" sewage disposal system and he would be open to other suggestions
since a"vault" at a minimum would be acceptable. He also suggested a variance procedure through the Board of
Health would be an option. Lee explained the Health Department has allowed portable toilets in other instances of
"unmanned"facilities and the Board could make a recommendation to the County Commissioners.
Ron Sommer moved Development Standard#9,be changed to read that any of the above type sewage systems would
be acceptable with an agreement between Weld County Health Department and H.S.Resources. Curt Moore
seconded the motion.

The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Roy
Wordell,surrounding property owner commended H.S.Resources for their high standards and work ethics,but had
concerns about his domestic well which is near this operation. Patrick Flynn gave an overview of the test
requirements for groundwater and domestic wells in the area and stated that H.S.Resources would test Mr.Wordell's
well initially and then annually while this operation exists. If there should be a problem,H.S.Resources would
correct it.
Robin Greene, Specialist,Colorado Oil and Gas Commission explained land fanning is occurring in many other states
and the Oil and Gas Commission is actively, "in-house"looking at the engineering design as well as the monitoring
systems that are being put in place.
Marie Koolstra moved Case Number USR-1067,H.S.Resources,Inc.,be forwarded to the Board of County
Commissioners with the Planning Commission's recommendation for approval as amended. Jack Epple seconded the
motion.

CASE NUMBER: USR-1071
APPLICANT: U.S. West/New Vector Group,Inc.
REQUEST: A Site Specific Development Plan and a Special Review permit for a Major Facility of a Public
Utility in the I-3 (Industrial)zone district,for 12 cellular telecommunications antennae(52 inches
high).
LEGAL DESCRIPTION: A portion of the NE4 of Section 21,T6N,R67W of the 6th P.M.,Weld County,Colorado.
LOCATION: 25 East Walnut Street,Windsor,Colorado(Unincorporated Weld County).
Katty Staller,representative,U.S.West/New Vector Group,Inc., said they plan to locate 12 cellular antennas on top
of the 132 foot tall existing Amalgamated Sugar Company. They also plan to locate a 12'x 20'unmanned
prefabricated equipment building to house necessary operation equipment at the base of the sugar silo. The purpose
of this facility is to provide and improve cellular telecommunication coverage in the area.

The Chairman asked if there was anyone in the audience who wished to speak for or against this application. Glen
Weldon,Town Administrator,Windsor,and Mel Yllaras,representative,Universal Forest Products,both had
concerns that this property should be annexed into the Town of Windsor. It was determined that the Planning
Commission was not the Board to address this issue.
Bud Clemons moved Case Number USR-1071,U.S.West/New Vector Group,Inc.,be approved as submitted. Jack
Epple seconded the motion.
The Chairman asked the secretary to poll the members of the Planning Commission for their decision. Ron Sommer-
