RESOLUTION RE: GRANT MANUFACTURED HOME ZONING PERMIT#187 - FOOTE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 18th day of January, 1995, considered the request of Dennis C. Foote, 1230 28th Avenue, #113, Greeley, Colorado 80631, for a manufactured home to be used as a principal dwelling, and WHEREAS, said manufactured home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Block 1, Dearfield Townsite and Settlement, Section 30, Township 4 North, Range 61 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony of those present, finds that said request should be granted subject to the following conditions: 1. The applicant shall obtain a building permit for the manufactured home prior to locating the manufactured home on the property. 2. A septic permit shall be obtained from the Weld County Health Department prior to the issuance of a building permit. 3. A State Highway Access Permit must be obtained prior to any activity within the State highway right-of-way. 4. Access onto State Highway 34 shall be 150 feet west of the end of the guard rail. 5. A Utility Permit shall be required for any new utility lines or connections within the State highway right-of-way. 6. The manufactured home shall not be occupied until such time that the applicant has complied with all of the above mentioned conditions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Dennis C. We conducted a site visit in order to make relevant comments regarding an appropriate access location for the addition of a single family residence on the undeveloped property. We offer the following comments: RIGHT-OF-WAY Right-of-way hap not been addressed by the submittal; however, projected traffic along this section of SH 34 indicates the need for a 150 foot total right-of-way, with 75 feet each side of the highway centerline. Additional width to meet the projected need should be protected by reservation or, preferably, dedication as permitted by County regulations. ACCESS The submittal did not indicate the Foote SH 34 frontage length or address access. Research reveals that the property fronts the highway for approximately 300 feet. Our site visit indicated that an access currently exists which provides for maintenance of the adjacent canal to the east. That access shall be used for no other purpose than the historic use. Access for development of the property must consider the existence of the ditch and guard rail. The adjacent property to the west could someday be developed and would require access from the highway, as well. We suggest that the Foote access be planned to possibly serve as a shared drive in order that the frequency of direct access from SH 34 could be reduced.
